The Pre-Commission meeting of the Plannino and Z o€3inq C'om ;scion was called to
order by Vice Chairman Georae Zahn at 6:15 P.M., in the downstairs Administration

The motion to approve the rninutes of the June 21, 994, Planning and Zoning meeting,
as presented, was made by Comm"issioner Owens and seco nded by Commissioner

present to answer any questions they might have.
Commissioner Owens inouired about the owner listed for taxes on the tax certificate
included in the packet. W Smith advised the Commissioners that Anatole Joint Venture
is no longer the owner, now that tie has purchased the property anoithe taxes have been
paid current to date.
Commissloner Baldwin made the motion to approve replat #P-94-08
International/Regional 'ndustrial Complex as presented and seconded by Commissioner
McMillon. I'Me vote was as follows,

IT NO. 2 - PRELIMINARY PLAT #P-94-14 - SAE BIT BAPTIST CHURCH ADDITION
Request of J, Kent Marsh (agent) for Taco Bell Corporation for the
preliminary plat of "!,,,0 acres for Lots I and 2, Block A, Saebit Baptist
Church Addition, generally located on the south east corner of Highway 10
and South Main Street.
Rod '!Fyier, City Planner, iintroduced the Preliminary Plat review for Saeb':t Baplist ,"hur-
ch
Addition. He stated that the Procedure for a preliminary plat begins with the Land Plan
and then the preliminary plat which is described as the "draft" for the final platting, This
property is located on the corner of Main Street and Highway 10. The 'Planning and

� , previously approved the Land P:an site plan on April 5. 1994., with Council
approval or, May 10, 1994. This preliminary plat is consistent with the approved site plan
and they have already submitted detailed construction plans to the City Engineer's office.
The DRC, has reviewed this plat and finds that it is consistent with the 17 D11"'. and
recommends approval si-ibject to the filing of the vacated plat and the oft.-site access
easements-
Mr, Kent Marsh, Director of Planning with Huitt.-Zollars, Inc., was present for the proposed
preliminary plat He stated he was aware of the process for filing the vacated plat and
off-site easements subject, to the, final platting.
Commissioner Owens and Tyson were concerned with the filing of the vacated plat and
the off-site easements and felt this should be done before the approval of this plat.

Mr. Mlarsh statert they are needing to secure the buifdmq permits as soon as possible in
order to dernolish the buildings and remove all the existing slabs from the property.
Rob Tyler advised the Commissioners that the original Specific Use Permit which was
approved :bout two :wars ago for the church, required the removal of all the existing
slabs and buildings and they were required to give a 90--day notice before the demolition
of the house, The specific €..1se Per mit which was approved on April 5 1994; ;toes not
neq!x,e the 90--day notice for the be€nolition due to e oroup of citizens who are try-ing to
save the house; by having a fund-raiser,
Mr. Marsh stated that he was contacted East week and is aware of the fond raising
committee to save the house. Mr, Marsh advised the Commissioners that Ta0a Bell
would change their schedule for demolition of the, house if the Planning and Zoning
Commission would agree, to two conditions being met', i Taco Bell wants building
permits issued immediately prior to the demolition, and, (2) they would change their
schedule and grant a 30--day delay before the demolitilion of the "f=uller" house (August
5, 19941,

for pining with. the City in a private arse: public historical event. He also stated this was
something the City has bee n € eeding for a longtime and he appreciates tale COly Council
and Councilman Walker for their assistance.

ITEM NO. 3 - PUBLIC HEARING Q ZONING CASE #94-06
Request of Warre n E, 1--1 an, Inc., for a change of zoning on 8,54 acres on
a portion of Lot 2, Bloch: 2, Cal, f=orest Addition,, from its present zonin of
C-1 (Neighborhood Business District) to P-11.. l'Sincgle-Family Limited
Dwelling District,. This property is generally located west of Borth Mam
Street and north of H r oo€t Road.

opened the public hearing for Zoning Case #94-05.
Rod Tyler; City Planner, stated this zoning case is a categorical change located on the
side of Harwood Road and west of North Main behind Blockbuster. The property is
currently zoned C-1 ;Neiqhborhood Business) and has been for many year$, The
applicant is requesting the zoning be change(, to R-1 l_. Sinole-Family Limited' which
allows a minimum lot size width of 50 feet, trinimum lot size of 5,500 square feet and
1,5500 square foot minimum area size, which is similar to the R-1 zoning district. The
surrounding land uses include apartments to the west, vacant land to the north and east
and residential homes to the south, There is a gas line, which runs through the property
in a north northeastern direction which has a big influence on the layout of the proposed
site. if this zoning change is approved, the applicant would be subject to only ti -zoning
requirements specfied i n the UDC for the R-1 1. arid any additional requirennents could not
be enforced by the City-
Vice Chairman Zahn asked for the applicant to come for-ward and make his presentation
for Zoning Case #94-05.
Mr. Warren . Hagar.. with Warren Hagan, lnc,, 5010 Grapevine Highway #472, Hurst,
Texas, was present representing the ownerldeveioper, Harwood Holdings Associates.
Mr. and Mrs.,LAp Stinson with Texas Best Custom Homes, are both the developer and
home builder inth€s zoning case, They are purchasina this piece of property from the
present owner, Harwood Holdings Associates, which owns the entire parcel of property
and except for this section of property the remainder will remain commercial. Aspart of
the purchase agreement, the owner and the buyer are going to share the costs of
resolving a long standing drainage problem by extending the storm sewer system from
where it ends in connection with the development of Food Lion up to and including the
intersection. The storm sewer system must be in accordance with the requirements of
flie City and they have, rnet with the City Engineers office, Mr, Hagan stated that the
pipeline would be best situated in the median so that the houses are separated from the
pipeline and the pipeline company could have easy access so this would dictate the
layout of the proposed development, There would be a boulevard street which is partially
landscaped and has pavestone crossovers with 60 foot tai rnarounds on the two cul-de-
sacs. This proposed la out wouid provide for a quiet crime free atmosphere for which
there would only be one entry into the development. They are proposing 34 lots which
meet the minimum requirements of the R-1 L zoning district and there are 4 lots per acre
and most lots are much larger than the rninimum and average 8,520 square foot per lot
area. There will be a masony buffer along the side of the apartments and the fence
along Harwood would probably be wood, Mr- Hagan stated that the price of the homes
will be between $100,€ 00 and $110,000,

hearing and called for discussion among the Commissioners.
C ommissioner Tyson was concerned with the proposed zoning district of R- i L which
appears to be regular homes with no open space-, which resernbles the R-1 zoning
district. He stated that the only open space is situate' along the median areas in the
proposed deveopment. Heiiked the overall concept but would like to see it broadened
more with the R-IL zoning and have more oper, space, possibly a homeowners
association with the streets maintained by the association.
Commissioners Owens stated he does not feel this is -a good use of the property.
especiatly with so many residential homes in the area, there needs to be more local
businesses for the surrounding neighborhoods. He arse stated that too much good
com mercial property has been turned into residential property throughout the City. He

property would be best zoned as R-1.
Mr, Hagan advised the Commissioners that the proposed gr een areas along the medians
would be landscaped and irrigated. He further stated that this request deals with the
parbal use of the whole tract and the remainder of the area would still be zoned
;., Sornmer6ai with at least 300 feet or more for this usage running along North Main S treet,
He stated that the market dernands more single-farm",yrio.mes with smaller lots which are
close, to commercial areas in this price range.
Commissioner tvlcMillon stated that he has envisioned this property as being commercial
i ty,
and he is not sure that th s is the best usage for this proper
Commissioner Tyson stated that he does riot feel that the City or a homeowners
association should be burdened with a 40 foot pipeline easement running through the
middle of the development enclosed with the street right-of-way.
Mr, Hagan stated that maybe they could come back with a different type of land plan with
more amenities which the Commissioners would favor.
Rod Tyler advised the Commissioners that if this zoning change: is approved then the
next step for the applicant would be a Land Plan and the preparation of construction
plans consistent with the Land Plan.
Commissioner Baldwin suggested that maybe the applicant could come back after,there
has been further study on this proposed zoning case due to the (,o€ missioners having
some concerns.

Hod Tyler advised the Cornmissiorlers that the filing fee, which has been .paid cannot be
refunded unless the applicant withdraws the 70mng case within 24-hours, of which the
applicant would receive only one--tuff the filing fee.
Commissioner Owens made the motion to deny Zoning Case 994-505 and 3dgtas �>econded
by Commissioner Baldwin,
C,orrirrtissioner Tyson suggested that the Commissioners give this rr€o€-e thought before
denying and possibly consider a concept with more amenities.
Commissioner Owens withdrew his earlier Motion to deny the zoning case and
Cornmissioner Baldwin withdrew her second,
Cornmi.ssioner Tyson made the notion to table Zoning Case 94-05 and to be brought
back before the Planning and Zoning Commission by Auqust 2. s 994. Commissioner
Owens seconded the motion.
The vote was as follows:

Nays: None

ITEM NO, 4 - PUBLIC HEARING - ZONING CASE 94

(Multi-Family at 12 and 16 u-nits/acre) to PD ('Planned Dewelopment _
single-Farnily Detached, zero lot line units, private streets , This property
is generally located on the south side of Harwood Road between Bear
Creel,. Villas and Bear Creek Bend-I!.
Rod Tyler, City R'anner, stated this zoning case is a change from multi-family to a
Planned Development for 30 single-fanny y dwellings with small lots, accessed by private
drives with a gated entry. The property is located on Harwood Road between Fuller-
s, riser Road aril North Main Btr'eet adjacent to Bear Creek Bend I and it and west of Bear
Creek_ Villas, The applicant is proposing a single private entry off l�lar�avf Road �€�l€io
wlll have three (3) cul-de-sacs and will be maintained by a homeowners associ Ition. The

applicant is purposing a brick fence along Harwood Road with trees similar to Bear Creel
lend and a wood fence around the remainder of the property. 'The average lot size being
proposed will be 5,832 sq;,Jare feet with no less than 4,830 square feet and the m ni€num
unit size wii l be no less than 1,500 square feet. Mr, Tyler further stated that there is are
encroachme nt of an existing} a lac-ent building which is two ( ) feet from the property i1ne
and also a sidewalk. and fence encroaches onto this property. Mr. Tyler stated that the
appl,,cant is proposing some open space but it will not have any recreational facilities
associated with it. the Development Review Committee had concerns regarding fire
protection and pare.€nq within the fire lanes. amount of open space and some eddliona3
amenities,
V c;e Chairman Zahn again explained the rules and promd€gyres governing a public hearing
and opened the public bearing for Zomng ("'.e:se #94-07 and asked for the applicant to
come forward and cake his presentation.
Mr. Eric Thor€yes, 790 Windomere sr'Vay, feller; Texas, was present and :stated that this
proposed zoning change is similar to tn. e deve opment on Made a nd Baze Road, He

Tyler regarding the e ncroachmpnt into the property line: stating the building is ten (10)

area closest to the encroachment is open space with the nearest lot being sixty (60; M
serenity (70) feet away. He advised the audience that the homes would be priced from
about $120,000 to $160,000,

development had two concerns. His first concern ;vas. f t z if the City was proposing any
street improvement's affecting the traffic on Harwood goad. and, �Li if here s an
ordinance for dust control for construction 3 projects.
City Planner Rod Tyler stated that Harwood road is scheduled in the future for street
assess€rents and improvi:>rnents and the developer wo;Uid be required to also make some
improvements.
Assistant City Engineer Andrea Baxter advised the Commi ssioners a€td audience that the
City Engineer's off ice monitors the dust from construction projects and if they w;ll call her
office when they are having the problem then they will monitor the problem and send out
water trucks to the site.
There being no further proponents'tioppone€its, Vice Chairman Zahn closed the public

Develoomeats which have been approved within the last year and she is concerned v¢ h
how these particular plans are working, since we have yet seen any completed yet. She
favors this type of development; with the gated entry ways and fenced-in communities,
but 'is co ncerned that we are approving to rn any of these developments before we see
the final results. Theses developments have private streets with the homeowner
association maintaining then a nd the streets are narrow. She asked f we were creating
a burden for the City as tar as fire pr0teCt€0€1?
Mr. Thornes advised the Commissioners that every house would be on a cul-de-sac with
off-street guest parking a nd fire lanes and he sees no problems with any fire emergency
;vehicles within the proposed development..
There was concern among the Commissioners that they would like to see more frees
sasfed or. the lots and would like: a tree survey do ne and presented to the Planning and
Zoning Commiss€on. There tai{as also concern with the private streets not being built to
City standards, as well as the amount of open space and the addition of more amenities
within the proposed development. It was mentioned that the applicant €fight co nstruct
a r,;:i€rrWi ty Pool for the proposed development. The Commissioners arse stated apai n
that they were concerned with the encroachment of the building on the adjacent property
and would like this iss ue resolved before the Planning and Zoning �C€ mmission goes any
flurther.
Zric homes stated the streets will be built to City standards and since these homes and
lots would be larger, then the lets would accommodate swimming pools if the owners so
desired to have them installed. He said he would consider a cabana type area Iin the
open space or possibly a pia§1 area for children within the proposed development. He
state-;d he would be ;open to any ideas or direction from the Commissioners and he would
be willing -to look at an alternative layout for the proposed development.

R,,,)d Tyler stated the COMmissioners re-cezived, in their packets, a copy of a survey letter
from Texas Innovation Grounc which makes reference to who ma"intains the private streets
within gated ne;ghbor •ood!> in some of the surrounding cities. He also enclosed two
articles On qated com.mupities and a housing profile for the Aflington. -Fort Worth area.
He also advised the '%-"ommissioners that the next Pan ?i€ and Zoning agenda would
possibly have five or six iterns for d;scusssion and stated de-velopmentactivity is picking
up significantly in the City,
