MINUTES
The Pre-Commission meeting of the Planning and Zon,ing Commission was called to order by (Chairman
Ronald Your at 6:00 P,M— M, the downstairs Administration Bel iids ng Conference Room. Six members
of the Planning and Zoning Commission were in attendance.

Chairman Ronald Young opened the Planning and Zoning Commission meeting at 7-00 P'M�' for the

MINUTES,
Chairman Ronald Yofuno asked the Commissioners for any corrections or additions to, the minutes of
the October 4, 1994; general meeting of the Planni ng and Zoning Commission and the Capital
Improvements Advisory Committee meeting of October 4, 19` 4,
The motion to approve the minutes of the October 4. 1994. Planning and Zoning Commission meeting
and the Capitai Improvement Advisory Committee meeting was made by Commissioner Baldwin, and
seconded by Comm'ssioner Owens. The, motion carried.

COMPRBHENSiVE LAND DEVELOPMENT ENT PLAN.
ITEM II. PUBLIC HARING -- ZONING CASE #94-17,
Request of Mr, David L. Johnston for South Vest Properties. L.P_ for a change of zoning
on 4.17 acres known as Lot A-Es and a portion of Tract 12" of the Ray Shelton Subdivision,
from its present zoning, of PD (Planned Development for dingle-Family Detached; Multi-

Rod Tyler, City Planner, introduced Items I and Il. He stated that Item #1 is a. proposed amendment

colu mns along North Main Street, The Develop ment Review-Committee recommended approval of this
item,
Chairman Ronald Young explained the rules governimg a Public, Hearing a nd then opened the Public
Hearing for Zoning Case #94-17. He ca'led for the applicant's representative to come forward to make
their Presentation.
Peter Stays represented t he applicant; South West Properties. Ile stated that the apartment units to
the north of this property to Ash Larne are owned by the applicant. The front portion of the property is
zoned C-:2 and the back portion was zoned Ply 839 a long ti€ne ago, which permits 429 mini-warehouse
structures on the back of the property. He gave the Commissioners an overview of the appearance
of the "front door" on lain Street. "he only building that will be fronting the property is the club house,
recreatio n building and the pool, The remainder of the buildings will be well screened from N. Main
Street. Fie stated that the, architect has designed an impressive street landscaping plan wish 22 trees
being planted in the front area. Security gates will be provided for the property, Access will be given
,.:...to the leasing office and recreation building without security{ gates. lie stated the applicant had issued
a letter to the City Manager's office stating they would contribute $103.00 pe r unit for the Police
Depadment and Fire Department to become eclOppeo with the Opticom System in order to have access
into the complex, This will :$9,000.00 being contributed to the City The entrance to the
complex will be a boW vard entrance as apposed to a single lane; Firs; Lane entrance, Mr, Stales stated
the project will cost in excess of $3;000,000.00 to build. Also included in the budget is an additional
$500;000.00 for improvements to the balance of the existing units to include new roofs and paint.
There being no further proponents or opponents, Chairman Young closed the Public Hearing for
discussion among the Commissioners.
Com missioner Zahn expressed his approval on the project and stated it was a better use than the
Current mini-warehouse ;zoning on the property.
Commissioner McMillon stated tae concurred with Commissioner Zahn. Commissioner Baldwin stated
she appreciated the applicant giving the Commission everything they had asked for regarding the
requirements.
Commissioner Owe ns suggested tl~e applica€-�t be consistent on the wrought iron fenc.e and do away
with the wo od fence in order to save o n maintenance a.t a later date. The DRC had asked for a b'ic�
fence along the south side to separate this project from the co€ merciai property. Commissioner Owens
stated: he is normally a strong advocate for brick fences on major thoroughfares for noise abatement and
noise attenuation, He stated he drove around the area and noticed the red tipped phoetinias along the

south side and the fencing would look nice if it were consistent with the feencing in the front.
Commissioner 'Tyson agreed with Commissioner Owens. He felt the visual access from Main .Street
would inClUde this fence on the southern most border. Commissioner Tyson felt the property would look
good everywhere else with the exception of the southern most part, Peter Staks informed the
Commissioners the applicant would be willing to erect a brick and wrought iron fence. The applicant
does not own the east and north fences. Comm, issioner Owens asked if the applicant owned any
property south of the existing property. Mr. Staks stated they did not,
Commissioner Tyson referenced the trees around the mass of the building. Peter Staks stated the
existing trees are adequate for screening and they have supplemented with seven additional trees. The
landscaping shown on the Planned Development is what the fi nished product will have. The parking
spaces were questioned by Commissioner Tyson. Mr. Staks informed the Commissioners that several
years ago Mike Starek performed a parking study on multi-fwnily facilities at different times of the day.
The results indicated that 1,3 parking spaces were the maximum use of any facility. At that time the
City approved 1.5 in order to cover any parking that would be needed. This numbervvould have been
determined from the number of one bedroom apartments, two bedm4i-m apartments, etc. The parking
spaces at this project will riot be designated parking.
Commissioner Owens had questions regarding living quarters in the leasingfrecreation building, Peter
.......Staks informed the Com missioners that no one would be living in this building. It will be a free standing
leasing building with furniture.
Chairman Young brought up some concerns as voiced by Letty Lynn tvlaloney, He stated the visual
Impact was one of leer concerns, howower, he did not find that to be the case because of existing trees
and the landscaping that would be provided. She also had a concern regarding increased traffic. The
location of the entrance and exit removes the traffic flow at least 250 feet from the corner of her
property.
Commissioner Owens warited the City Engineer's opinion on this proposal and asked if he had
determined 0' there were any problems w:th drainage. Paul Kruckerneyer, City Engineer, stated the
applicant was aware of all City requirements
Comm.ssioner Owens made the motion to approve the recommendation to a? end the 1993
r
omprc-.,,h-ensive Land Development Plan and Zoning Case #94-17, without any stipulations and as
presented by the applicant.
There were questons from the Commissioners regarding the construction of the brick!wrought iron,fence
along the southern part of the property being a part of the motion, Commissioner Owens stated the
applicant agreed to construct the fence: and he did not want to make it a part of the motion.
Commissioner Owens withdrew his motion.

Commissioner Zahn made the motion. to approve the recommendation to amend the 1993
Comprehensive [-and Plan as noted in item i; and to approve Zoning Case #94-17 with the stipulation
that the fence from the security gate on the south border back to the existing fence o€. the deevelopme nt
be wrought iron with brick eel€.€€€errs as opposed to wood fencing, Comrnrsaronar McMillon seconded the
motion. The vote was as follows:
Ayes Commissioners Zahn, McMillon, Owens, Baldwin, Young, Tyson
Nays: None
The motion carried.
Chairman Young informed ttge applicant that this case would go before the City Council in three weeks
on November 2Z .1994.
