All severie members of the Planning and Zoning Commission were in attendance , PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS COUNCIL CHAMBERS. PLEDGE OF ALLEGIANCE AND INVOCATION: The, Pledge of Allegipce was f ven b'y Coppissi one r Tyson and the invocation was given by Commissioner Zahn , PLANNING AND ZONING COMMISSION MEETING - PAGE TWO FEBRUARY 21 , 1995 MINUTES: The motion to approye the minutes of the janyry 17 , 1995 , meeting was made by Commissioner Owens and seconded by Commissioner- McMillon . The motion carried to approve the minutes as written , REGULAR AGENDA: ITEM I . PUBLIC HEARING FOR EPLAT #P-94-19 - FOREST POINTE ESTATES Request of Arya Corporation for a re plat of Lot 1 . Block 2 , !al Addition into Lots 1 -61 , Block A, Fores-� Pointe Estates : located west of Fuller-Wiser Road and on. the south side of East Ash Lane . Chairman Young explained the rules governing is public heprinn an'', called the Public Hearing into session to consider qtr„plat #P -94- 19 At this time , Mr . Young asked the applicant , Mr . Henry Rahmani , tc, come forward to give a presentation . The presentation was waived and the floor was opened for questions . Commissioner Owens interjepteq his appreciations to the staff for including the Development Review Committee comments in the agenda packets , Commissioner Tyson asked for Mr . Rahmani to explain how they would handle Tall Timbers Drive . Mr . Rahmani then explained the following : He stated the utilities ... Mould be finished within six to eight weeks i n pr; basically finished with their 10 - unit, condominium project in Cedar Hill Estates , �Mir kahma­ii fiurther stated they will repair the damaged part of Tall Timbers street , however , the homeowners have asked them to include a speed bump , Mr . Rahmani agreed to install a street bump , at the applicant ' s expense , as long as the City 0gineer would being built . Mr . Rahmani also advised that a section., of T,7�. 11 Road close to Fuller Wiser must be removed and installed with 6" comnacted concrete for a permanynt repair . It was added that there will be no overlay over the entire street . There are 3 to 4 spoV-, that need to be repaired . Mr . Rahmani explained that the street will be repaired , not just patched , The Commissioners stated the City would not be involved in whether or not Mr . Rahmani can place a speed bump in the road , because it is a private road . Mr . Rahmani agreed to adhere to t he C i t y speed bump specifications , PLANNING AND ZONING COMMISSION MEETING - PAGE THREE FEBRUARY 21 , 1995 Commissioner Zahn asked if the homeowner ' s association would take over the burden of maintaining Tall Timbers Road . Mr . Rahman-1 explained there are two homeowner ' s associations . k , of Tall Timbers belongs to Forest Pointe . The northern paril, belongs to an association that was disestablished in 1981 . Legal Q the read belongs to the homeowners on the north side to acces-s their homes . ;%fter some discussion , it was that Fore!--J, Pointe Homeowners Association will assume responsibility for the southern part . City Kanner Rod Tyler stated that Lots A and K are private street- , and are required to be maintained by the property owners association of this subdivision accordity; to Note No . 6 of the replat and the deed restrictions , Commissioner Tyson, inquired if this included the whole street or a part? Mr . Tyler advised that the whole street would be maintained . Commissioner Owens asked who would be responsible on the northern section of Tall Timbers Drive for the maintenance of that after Mr . Rahmani has finished the development? Mr . Rahmani stated that the homeowners association would he -esponsible for Lot A , which is the entire street , would be Forest Pointe , Commissioners Owens advised Mr . Rahmani that patching the streel. would no!: be acceptable arid to standards ; either overlay or a complete reconstruction was his understanding . Commissioner Owens asked if the emergency and pedestrian access would be completed before construction begins . Mr . Rahmani agreed that it woull be completed . Commissioner Owens asked if Mr . Rahmani would replace the subdivision fence and Maw would the City be assured it would be done . fir" Rahmani stated the City is holding $215 , 000 to cover the cost of replacing toe fence . Commissioner Owens asked to pinpoint a date the fence would be completed . After discussing jhe reasons why it was necessary to cut into the fence , Mr . Rahmani stated the fence should be completed in six to eight weeks . He said the fence was originally cut to connect storm drains , sewer and water lines and was not cut to fon heav) equipment through , Commissioner Owens asked if the emergency pedestrian opening in the fence could remain open , but the rest of the fence repiaced . Mr . Rahmani agreed . it was noted that lots 37 and 38 are open . PLANNING AND ZONING COMMISSION MEETING - PAGE FOUR FEBRUARY 21 , 1995 Commissioner Owens also commended Mr . Rahmani on saving the area trees , but asked if the trees standing now would remain standing ,. Mr . Raman! could not say which trees would he saved and which trees would need to Q- , cut for construction purposes . it would who was purchasing the lot , the type of floor plan chose-r.., and if the existing trees coula be kept without being disturbed . Commissioner Owens asked i f the p! at submitted at the meeting will be the final version . He asked if Paul E . Thomes or Tall Timbers Association would be legally relponsible for the northern half W..'' Tall Timbers Drive . Mr . Rahman] responded that Mr . Thomes is not responsible for Tall Timbers Drive . Commissioner Zahn asked if the northern fence would be completed ,JUSt as S00n as the utility installation was Completed . Mr Rahmani responded this was correct . Commissioner Owens asked for clarification from engineering whether the City was approving Mr . Rahmani to sell houses , build , grani., permits , etc . , before the utilities were in place . He also stated the drainage is not in place , City Eqqineen Paul Kruckemeyer , stated Mr , Rahmani cannot obtain , ' I all the public imprgy,ments are in place a building permit UP-1 -1 and approved , including fencing , draining , utilities , etc . Chairman Young asked if there was anyone else who wanted to speak rai behalf of the project . Mr . warimani stated it �,ad a. pleasure working with City staff , W Kenneth Pare, 504 E_ Asti Lane CLot 20) , approached the Commission askigg specifically what their responsibilities were as far as road maintenance . Chairman Young stated Mr . Rahmani is wanting to make his homeowners association , Porest Pointe , responsible for Tall Timbers Road , Mr . Pore acknowledged this fact, and the fact that he is not a member of Forest Pointe homeowners association , Chairman Young asked if City staff had receiveo any telephone calls or written corre5pond I ence either in favor or against this public hearing . City Planner , Rod Tyler , stated there had been no calls or letters from, any property owners . Chairman Young closed the, public hearing and called for a motion . jack Emmons . 400 E . Ash Lane approached the Commission and stated he has had to realign his wheels twice in the past year due to a bump in the road ., He asked if this particular bump on Ash Lane- could be removed , if it is determined that the bump is within the public right-of-way , then it is the City ' s responsibility , PLANNING AND ZONING COMMISSION MEETING - PAGE FIVE FEBRUARY 21 , 1995 Commissioner Zahn made a motion to approve #P-94- 19 , Forest Pointe Estates . Commissioner Owens seconded the motior with an amenament t-"-,at mr . kahmani ' s homeowner ' s association , Forest Pointe , be named on the plat . Commissioner Zahn accepted the amendment . The vote was as follows : Ayes : Commissioners Zahn , Owens , Baldwin , McMillon . Bright , Young and Tyson Nays : None The motion carried , 11 . PUBLIC HEARING FOR REPLAT 0-94-21 - OAKLAND ESTATES SUBDIVISION Request of Naomi J . Svochak for a replat of Lot 20 , Block 2 , Oakland Estates Subdivision into Lots 20-A and 20-B . Block 2 Oakland Estates Subdivision ; described as 1603 North Alain Street , Randy X Byers , Director of Public Works & Development , introduced the request of Ms . Naomi J . Svochak for a replat of her propyrty He further stated that the Development Review Committee reviewed this replat on December 20 , 1994 , and felt that all concerns had e Jc' --essed and recommended approval . However , it. has been noF} iced py he City Engineer ' s office that there are some inaccuracies in the legal description by the surveyor and staff now recommends denial of this replat . Chairman Ronald Young explained the rules goverining a hearing and called the Public Hearing into session to consider the Replat #P-94- 21 Oakland Estates Subdivisiorn He asked that the applicant or the applicants representative come forward to give a presentation . QN , Scott Samuels , representing nis , Svochak , resides at 1505 Donley , Euless , Texas . He and Pis wife purchased an acre lot from Ms . Svochak in order to build a nouse on Lot 20 -B an Ash Lane . Mr , Samuels was not aware of any inconsistencies in t:h-,c,% survey , he e thought that all comments had been corrected . Commissioner Tyson inquired as to the improvements to Ash ..ane , Mr . Samuels stated that all the residents on F, side of Ash Lane have not been required to pay for street improvyments . H e stated that the south side of Ash Lane has been improved and if Ash Lane is ever widened then the owners would have to pa,d for th"n - additional costs , but he understood that the fee migMt possibly be waived or a variance granted , PLANNING AND ZONING COMMISSION MEETING - PAGE SIX FEBRUARY 216 1995 City Engineer , Paul Kruckemeyer , advised the Commissioners that as of now there are no plans to widen but later in the future there may be a necessity to widen and curb and gutter the street, Chairman Young advised the audience that there were some inconsistencies in the replat . Along the north line there are two ( 2 ) dimensions which are wrong in Lot 20- B . The point of beginning is incorrectly described , Commissioner Owens felt that a precedence would be set by taking the large lots and subdividing them into smaller lots , since this area has predominately been larger lots . He nv,% -,, s against this project but feels the lots should stay as they are and he ti,oild not vote in favor of this replat , There being no further proponents or opponents , Chairman Young closed the public hearing for discussion among the Commissioners . Commissioner Tyson expressed concern with ( 1 ) cutting up the large lot into two smaller lots , as well as the - escrowed for improvements since the City requires all developers to do the same , 1M Chairman Young stated for the record that he is not in opposition o w a i v i n g t he e r ow f e e s & t h i --, t i. e w h-1 i c h,� w ul d ate e recouped when improvements started , but has a problem with the technical aspects of the plat . Chairman Young called for a motion , Commissioner McMillon made the motion t.-o d(-,ny #P-9,4 -21 Oakland Estates Subdivision based on staff recommendation due to technic V errors and the motion was seconded by Commissioner Zahn . The vote was as follows : Ayes : Commissioners McMillon , Zahn , Baldwin , Bright , Young and Ty son Nays : N o n Abstain : Commissioner Owens The motion carried . 111 . PUBLIC HEARING FOR REPLAT #P-94-24 - OAKWOOD TERRACE Request of Dr . Kevin Witt for the replat of Lot 3- A, Block 1S Oakwood 'Terrace Estates into Lot VAR . Block Terrace Estates ; described as 503 West Euless Boulevard . Randy i . Byers , Director of Public Works & Development , introduca.-I the request of Dr . Witt for a replat and stated that t he 'Development Review Committee has reviewed this item and t%, recommended approval of the replat . PLANNING AND ZONING COMMISSION MEETING - PAGE SEVEN FEBRUARY 21 , 1995 Chairman Young opened and called the Public Hearing into session to consider the Replal #P- 94 - 24 for Oakwood Terrace He asked tye applicant or , tMe applicants representative to come forward to give a presentation , Dr . Kevin Witt , 503 West Euless , stated the building has been at this location for nearly thirty, year; and is presently owned by him. He stated the site plan had previously been approved by City Council an January 24 , 1995 , and he plpns to remade! the exisqiyg office building to give it a more professional ppearance and in the future he hopes to expand by building a rehan center , There being no furthe; pryonents or opponent; , Chairman Young. closed the public hearing for discussion among the Commissioners . City Engineer , Paul Kruckemeyer , advised the Commissioners he was satisfied with the replat and sees no problem with " t approved . Commissioner Owens made the motion to approye Rep lat #P-94-24 as wresented and the motion was seconded by Commissioner Baldwin . The voSe was as follows : Ayes : Commissioners Owens , Baldwin , McMillf-,n , Young and Tyson Nays : N o n e, The motion carried . !V. LAND PLAN OP-94-02 - VILLAGES OF BEAR CREEK ADDITION Request of Mickey Elam , V . P . , for Euless Apartments . Ltd . , for approva ,1 of a Land Plan for 12 . 527 acres cut of the R . Crowley Survey , A-312 , Tracts 4E3 and 4G ; located on the northeast corner of Fuller -Wiser Road and East Ash Lane , Randy j . Byers , Director of Public Works & Development , introduced thin Villages Qf bear Creek. Land Plan and stcat�':,%d '-'Ji�e Development Review Committee had reviewed this request and found that i t meets We applicability ordinance and therefore they recommend approval . Mr . Walter Elliott , Elliott Hughes , Inc . , 1001 W . Euless Boulevard , represented the owner and developer for the pyperty located on East Ash Lane and Fuller -Wiser Road . He Stated that the applicant would like to start as soon as possible an the construction of the apartments , Paul Kruckemeyer . City Engineer , advised the Commissioners that the PLANNING AND ZONING COMMISSION MEETING - PAGE EIGHT FEBRUARY 21 , 1995 Land Plan is in good order and he recommendy , approval of the Land Plan . He further stated they have been WOrKIng Very Closely With the developer on this project . Commissioner Owens stated that this project is an upscale projeS and feels this will be a good project in the City , Commissioner McMillon made the motion to approve Land Plan #P-9 5-0? as presented and the motion was seconded by Commissioner Zahn . The vote was as follows : Ayes : Commissioner's Mchlillon , Zahn , Bright , Young and Tyson Nays ; N o n e The motion carried . REPORTS: '" ity Wgineer Paul Kruckemeyer stated that inquired as to whether Mr . Rahmani could start building prior Vo, Mr , the public improvements being finished ( Item No . 1 ) ? stated that Mr . Rahmani has the right to pull building permits prior to the public improvements being in place since he nas , plAt up the money for coNtruction . Mr . Rahmani must make certain that the bung does not precede the fire protection , and he Can aCtuqlly be ConSIruCling nouSeS as the streets are going in as long as tire protection is available . The reason being that lifc, has enough money cover all the improvements hi our account so that if he walked away we could put them in ourselves , Commissioner Bright stated March 2 , 1995 , is Texas Independence Day and her office will be having a Chili luncheon for everyone .
