PLANNING AND ZONING COMMISSION SEPTEMBER 19, 1995 MINUTES The lire-Cornmission meeting of the Planning and Zoning Commission was called to ,order by C lia r man Ronald Young at 5.30 p.m., in the downstairs Administration Building Conferences? Room. Seven members of the Planning and Zoning Commission were in ,attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS a COUNCIL CHAMBERS. Chairman Ronald YOUng opened the Planning and Zoning Commission meeting at ?:00 p.m. for the consideration of scheduled €te€ns. He stated that seven members of the Planning and Zoni ng Corn,mission were present. Furthermore, the agenda for this meeting had been properly pasted in accordance with applicable law. City Planner Barbara Chambers, Office SUperVisar Linda Lux, Staff Secretary VISITORS PRESENT: Alex Bickley Sadhana Sanger Trod Fuller Bill Holischer Ban Zacharias Richard Connelly Don Whigham PLANNING AND ZONING COMMISSION MEETING M PAGE TWO SEPTEMBER 19, 1995 PLEDGE OF ALLEGIANCE AND INVOCATION- The Pledge of Allegiance was given by Commissioner Eggers and the invocation was given by Commissioner Zahn. MINIJTES The motion is approve the Planning and Zoning Commission minutes of the September 5, 1995: meeting vas made by Commissioner Owens and seconded by Commissioner Eggers. The vote was as follows. Ayes: Commissioners Owens, Eggers, cMi!lon, Baldwin, Bright, Young, Zahn Nays, None The motion carried. The motion to approve the Capital Improvements Advisory Committee minutes of the September 5. 1995, meeting was made by CommissionerEggers and seconded by Commissioner Zahn. The vote was as follows, Ayes: Commissioners Eggers, Zahn, Owens, Baldwin, IttcMillon, Bright, Young Flays: Done The motion married. ITEM I. SITE PLAN #95-22-SP - WESTPARK PROFESSIONAL CENTER Request of Debra and Mile Halyard for approval of a site plan for a restaurant within a C-2 (Community Business) zoning District on the southeast corner of Doc McGinnis Drive and West Airport Freeway Randy J. Byers; Director of Public Works and Development, stated this request was for an approval of a site plan for a restaurant within a C-? Community Business Zoning District, He stated the Development Review Committee (DRC) had reviewed the site plan and found the information provided to be consistent with the zoning a nd subdivision regulations of the Euless Unified Development :ode and, therefore recommended approval. Paul Kruckemeyer, City Engineer, stated the Engineering Department found the request satisfactorily met their requirements and therefore, recommended approval. Rod Tyler„ City Planner, stated the property complies with all zoning codes and PLANNING AND ZONING OMMIS lO MEETING - PAGE THREE SEPTEMBER 19, 1995 subdivision rules, and regulations, Billy Ovens commended staff on the information contained in the Commissioner's packets and stated it was easy to understand, Commissioner Ovens made the motion to approve Site Plan #95-22-SP as presented and Commissioner Eggers seconded the motion, Ayes: Commissioners Ovens, Eggers.. Baldwin, Bright, McMillon, 'young. Zahn Nays: lone The motion carried to approve Site Plan #95--22--SP. ITEM 11, SITE PLAN #96-26-SP - EULESS INDUSTRIAL PARK Request of Richard Connelly for American EZ Type, Inc., for approval of a site plan for the expansion of the existing print shop within an L--1 (Limited Industrial) zoning district, described as 1103 Stanley Drive Randy Byers.. Director of Public Works and Development; introduced the Euless Industrial Pars site plan stating this request was for an approval of a site plan for the expansion of an existing print shop within an L_1 zoning district. He stated the Development Review Comrnittee (DR C) had reviewed the site plan and had found the information provided to be consistent with the zoning and subdivision regulations of the Euless Unified Development Code and therefore, recommended its approval. Pod Tyler, City Planner, stated this was simply an add on and the site plan Diet all zoning change requirements, He stated the detail landscaping plan would comply with the current landscaping ordinance. Paul Kruckemeyer, City Engineer, stated he had no comments other than the, architect and developer net all requirements and this would be an improve ment. Richard Connelly, 4215 Beltwood, Suite 105, Dallas;. Texas, stated his company had been before many cities with developments and he stated the staff members of Euless deser,fed his complements. He stated they were very diligent and helpful in assisting them i n reaching their goal. Commissioner Owens made the motion to approve Site Plan#95-25-SP as presented and Commissioner Bright seconded the motion, The vote was as `allows, Ayes: Commissioners Owens, Bright, Baldwin, McMillon, 'young, Zahn, Eggers PLANNING AND ZONING COMMISSION MEETING - PAGE FOUR SEPTEMBER 19, 1996 Nay& None The motion carried to approve Site Plan #95-25-SP. ITEM III, PUBLIC HEARING e ZONING CASE #96-23 a OAK FOREST ADDITION Request of Christopher P. Culpepper for Woodmont Realty Associates, for a change in zoning on 13.5 acres known as lots 2RR and 3-R; Block 2: Oak Forest Addition,, from its present zoning of CT1 (Neighborhood Busi ness District) to C-2 (Community Business District); located on the northwest corner of forth Main. Street and West Harwood Road Randy Byers, Director of Public Works and Development, introduced the zoning case giving the ge neral location, The Developme nt Review Committee had reviewed this request and believed it to be consistent with the City's Comprehensive Land Development Plan a nd therefore, recommended its approval. Chairma n young explained the rules governing a Public Hearing and then he opened the Public Hearing, Christopher Culpepper, represented Harwood Holdings Associates, L,P.; stated this request was for a retail shopping center with AQlbertson's as the lead tenant The Albertson`s would be a 55,000 sq. ft, grocery shopping area with an Auto Zone. There is 13.5 acres and the development would be in two phases. The A lbertson's and Auto .one both require a C-2 zoning. The applicant also furnished an elevation for the Commissioners to review. Chairman Young called for any proponents and/or opponents to the request, There being none, he called for any closing statements by the applica nt. The applicant stated the property would close in November, 1995, The development of the Albertson`s will start in 3-4 mo nths, The target date of opening is November, 199 . Commissioner Owens asked if the Lone Star Gas pipeline would be a problem. The applicant stated 'here would be no buildings on the pipeline, only pavement. Commissioner Baldwin had questions regarding ingress and egress= however, Chairma n Young stated that the zoning request was the only issue bung discussed at this meeting. The applicant did respond by stating Ingress and egress would be approximately 350' away from the intersection. IV. PUBLIC HEARING o SPECIFIC USE PERMIT #96-17-SUP Consideration of a Specific Use Permit for the Euless Sports Bar to sell alcohol within a C-2 (Community Business)zoning district on the southeast corner of�Alest Euless Blvd. and High€farad give; described as 1447 �-%'est Euless Boulevard Randy J. Byers, Director of Public Works and Development, introduced the Specific Use Permit request stating this was a Public Hearing to consider the Euless Sports Dar to sell .alcohol within a: C-2 zoning district. Chair man Young explained the rules governing a public Hearing and then he opened the Pub lic Hear€ng for -17-SUB. l Ales: Bickley, 142 Midway Drive, Dallas, Texas; represented the owner Sadhana Sanger. He stated this Specific Use Permit was unique in that they did not want to change their use or build any buildings. They only were present to request approval to improve the property. He stated the City was requesting 61 parking spaces; however, they would provide 67 parking spaces with striping. He stated the current use was already authorized in the C-2 zoning. Chairman Young called for any proponents, there being none, he called for any opponents that would life to spear, Don Whigham', 1 300 Euless Boulevard, stated he was m opposition of the request to sell alcohol. He stated there were 46 offices in the building on Euless Boulevard and he was concerned the area would decline with the continued sale of alcohol. He stated he appreciated the applicant's intentions to improve the site. Mr. Bickley stated he respected Mr. higham`s opinion and he wanted to be a good neighbor however, alcohol was already authorized in that district. He stated it only made good sense to allow them the approval for improvement to their neighborhood. Where being no further or opponents, Chairman young closed the public hearing. PLANNING AND ZONING COMMISSION MEETING a PAGE SIX SEPTEMBER `t , 1995 There was discussion among the Commissioners regarding the facility currently operating out of compliance since they were not linked with the hotel. Mr. Bickley stated ;hey did not serve any food and they were strictly a bar. Chairman Young asked Mr, Bickley what made him thinly this was an appropriate use and was the use compatible with the neighborhood. liar. Bickley stated the zoning of C-2 permitted alcohol sales and they were next to a restaurant with a bar in the area, He stated they were well screened and they had been there for a long time, but it needed to be improved. Mr. Bickley stated a bar in the area made good sense. Commissioner —Eggers asked the applicant for a time table to build the parking lot. Mr, Bickley stated, forthwith. He also stated they would do some painting on the outside and a little painting on the inside. 'Comm. ssioner Owens had questions regarding the game room and would there be gambling on premises, Mr, Bickley stated there would be no gambling that they would know about. Commissioner Baldwin asked how the applicant had been operating for so many years without a license. The applicant stated the owner purchased the facility only eight months ago and is operating under a different license. Commissioner Owens made the motion to deny #95.17-SUP on the oasis that it is not the highest and best use and does not enhance the property surrounding the operation. The motion was seconded by Commissioner Baldwin. Chairman Young stated that according to Section 34_153 of the City of Euless unified Development Code, the Commissioners are presented with 13 items for evaluation for a specific use permit, It states in the ITC that the P&Z cannot recommend approval unless they are satisfied that each of the 13 items are properly addressed. He stated that he is not satisfied that the proposed use promotes the general welfare and convenience of the city. He also stated he was not convinced that the issuance of the SUP does not present a pediment to the orderly development or redevelopment in this area, Commissioner Eggers stated he was not convinced to approve this request based on Item 13; the issue of tfie benefits outweighing the losses; because the police department has frequently been called out to this area. The vote was as follows: Ayes: Commissioners Owens, Baldwin, Mct lllon, Bright, Young, Zahn; Eggers Nays.
