The Pre-CorrvTission meeting of the Planning and Zoning Comer ssion was called to
order by Chairman Ronald Young at 5:30 p.m., in the Building ``A" Large Conference
Room: Six members of the Planning and Zoning Commission were in attendance.

Chairman Ronald Young called the Planning and Zoning Commission meeting to order
at 7:00 p.m.for the consideration of scheduled item. He stated there were six members
of the Planning and Zoning Comrnission present. Corwissioner Eggers was absent.
Furthermore, the agenda for this meeting had been properly posted in accordance with
applicable law.

Bo Bass, Director of Planning and Development, stated the request for a Public Hearing
for Specific Use Permit# 41-SUP. He described the location and described the area
of property owner notification.

Chairman Young explained the rules and procedures of a Public Hearing then opened the
Public Hearing.
Mr, Bob Welty, 13601 Crestview Drive; Dallas, Texas, represented the owner, Duke Inc.
He gave a brief history of the proposed site. He stated the site was bounded by Bear
Creek Parkway on the west; SH 360 on the east, on the north by the existing Fountain
Wood apartments and on the south by the Bear Creek city park. He stated the site was
heavily wooded and considered a "Forest Zone He informed the Corrssioners that
501% of the site falls within the flood plain. Mr. Welty stated, because of the uniqueness
of the site, the applicant proposed building a three story project in order to get sufficient
density to prove the project feasible. The density allowed by City ordinance is 25 units
per acre and the project is proposing 14.4 units per acre. The applicant is proposing a
secured gated project with entrance from Bear Creep Parkway and the frontage road of
SH 360. Mr.Welty infom-ed the Corr'issioners, at the request of the City Engineer, they
had conducted a traffic impact study on the frontage road off of SH 360. The general
character of the project is red brick and plaster. The unit mix is 1, 2 and 3 bedrooms with
carports and garages.
There being no proponents or opponents, Chairman Young closed the Public Hearing,

Bo Bass, Director of Planning and Development, reminded the Commissioners the
purpose of the Specific Use Permit is to mitigate any potential negative impacts the land
use could have on surrounding land He stated it was not a land use issue because the
propose multifamily is a permitted use. Mr. Bass stated the code provides 13 criteria for
the Com-rissioners to use in terms of deterrrining what impacts need to be mitigated.
He reviewed the 13 SUP criteria with the Commissioners. Mr. Bass informed the
Commissioners that the structure is sprinkled, the parking standards are exceeded, iron
gates completely around the property, 90% masonry; 6' wrought iron gates/fence
completely around the property and 51% of the parking spaces are covered parking.
Com nissioner Zahn had questions regarding an opening on the park side of the wrought
iron fence that would allow pedestrian access into the park. Mr. Welty stated a portion
of the City's jogging path is on their property and they intend to use it.
Commissioner McMillon stated there were three of the buildings in the 100 year flood
plain and this needed to be mitigated. Mr. Welty stated this was an engineering issue,

hov&ever, there are two flood plains on the property. One of the flood plains is FEMA
flood plain line which is 1 1/2 - 2 feet lower than the ultimate 100 year flood plain. He
stated their design of buildings are 100% outside of the FEMA flood plain line. There
were corners of three structures that infringe on the ultimate 100 year flood plain. Mr.
Welty stated it. was their intention to improve the area in the flood plain wherever they
build into it. Commissioner 11 cMillon repeated the clarification back to the applicant and
stated, "do you intend to build up the love lands around the three buildings and take there
out of the flood plain"? Mr. 'qty stated they would build that area up and take it out of
the flood plain and the flood plain would have the same amount or an additional amount
of water flow. Cor nissioner ltilcMillon suggested the applicant work closely with the City
Engineer. Mr. Welty committed to a civil engineering drainage study and stated he would
have the study completed two weeks from the date of this meeting because it would be
necessary prior to obtaining building permits.
Paul Kruckemeyer, City Engineer., stated he would not recommend making the drainage
study a hinderance to the Specific Use Permit, but he wanted the motion contingent on
the drainage study being completed for the Land Plan and/or Site Plan. Mr. K.rucken-eyer
stated he had been working with the applicants engineer and he felt they were aware of
what they needed to accomplish and were working toward a solution.
Commissioner Shuler voiced some concerns regarding the lacy of pole lights on the right
side of the property. Mr. Welty committed to providing adequate lighting. Mr. Welty
discussed the Villages of Sear Creek Architectural Review Committee (Karen Boyd)
asking the them not to build sidewalks but stated the sidewalk issue had been resolved.
He stated again, he intended to provide ample lighting.
Conrr�issioner Owens cor ended the applicant on submitting a good product. He stated
he could rather have seen some better tax revenue businesses, but since this was a
permitted use he was glad the applicant mitigated some of the bad points.
Commissioner Shuler made the motion to approve #96-41-SUP with the addition of a
least one pole light on the southeastern side of the property. Commissioner Cans
seconded the motion. The vote was as follows:

Paul Kruckerneyer, City Engineer stated the applicant provided a traffic survey as
requested along the frontage road. Fie stated the survey came back with some
recomn-endations to do work on the frontage road itself. Mr. Krucken-eyer stated the
Engineering Department would mrk with the applicant to gain approval from TxDot. He
stated he agreed v&h the recommndations of the consultant.
Cornrr�issioner Owens thanked Mr. Kruckerneyer for requesting the applicant to provide
drainage in a pipe going to Bear Creek and for the traffic study.
Corryrissioner ltlillon made the motion to approve#96-42-SP, with an addition to the
emotion, of the three buildings that appear to be built out in the 100 year flood plain will
be addressed to the satisfaction of the City Engineer and the buildings be rnitigated out
of the flood plain prior to the City Council meeting. Conyrissioner Zahn seconded the
motion. The vote was as follows:
Ayes: Commissioners McMillon, Zahn, Covens, Shuler, Bright, Young

Mr. Welty was reminded the Corrv�nissioners were requiring him to submit the civil
engineering drainage study within a tvm time frame in order to be placed on the next City
Council agenda. Mr, Welty stated he would subrnit the study in a timely fashion in order
to make the next available agenda for City Council.
ITEM IV. CONSIDER APPROVAL OF LAND PLAN - 274LP - VILLAGES OF
BEAR CREEK BACK 5, LOT 2

Mr. Bo Bass, Director of Planning and Developrrient, infonTed the Commissioners the
Development Review Corttee had reviewed the land plan and found it rnet the
applicability ordinance and recommended approval of the land plan. He gave the

general location and stated the land plan was to establish that adequate public
improvements exist; both in the ground and they could be provided to the site.
Paul Kruckemeyer, City Engineer, stated public utilities were available and adequate for
the site.
Corrmssioner (ins wanted assurance the Fire Marshal was satisfied with the grass
crete between buildings 5 and 6. Michael Logan, Fire Marshal, stated the grass crete
would allow the fire apparatus to sit on it if they ever needed a ladder.
Commissioner Owens made the motion to approve #96-27-LP and the motion was
seconded by Commissioner McMillon. The vote was as follows:

Bo Bass, Drector of Planning and Development, stated the applicant was requesting a
revision of the preliminary replat containing Lots 4, 5 and 6, Bloch 2, Oak Forest Addition
into Lots 4R, 5R, 6R, 7 and 6, Block 2. The revision was needed to modify the lot layout
and adjust the proposed public improvements to serve the new lot layout. He gave the
location of the site. He stated the Developn-ent Review Committee had reviewed the
preliminary replat and recoar-ended approval. He informed the ComrNssioners the
preliminary replat was a ministerial function.
Chairman Young opened the Public Hearing.
Greg Mason, Director of Development of National Autotech, stated he was available for
any questions from the Convissi®Hers.

Chairman Young explained the approval of plats was a ministerial function and stated the
requirements of the UDC had been met.
Paul Kruckemeyer, City Engineer, stated he recommended approval of the replat.

by ConTnissioner Bright. The vote was as follows:

Bo Bass, Director of Planning and Development, gave a brief overview and the location
of the request. He stated the maximum density allowed by the CUD #1048 was 21.8
units per acre. The density proposed with this replat was 19.2 units per acre which is
below the mxirnum density permitted by zoning. He stated the Development review
Committee had reviewed the request and found the "conditions of approval" had been

adequately addressed and recommended approval. He informed the Commissioners the
Code requires all multi family adjacent to a single family zoned area must be, within 100
feet, single story in nature. The applicant proposed to meet that aspect of the code.
Chairman Young explained the rules and procedures of a Public Hearing and them
opened the Public Tearing.
Mr. Bob Welty, Rawls hefty Architect in Dallas, represented the owners of the Bear Creek
Partnership. He gave a brief history of the site. He stated the improvements were
installed in the 1980s. The site plan had been approved for a mufti-family site for 2€6
units in size. He stated the newly proposed project is similar in nature because they
would like to save some of the paving and utility work. The project will have a single
entry point located rr�idway between bill Trail Drive and Mid Cities wive. The entry point
currently exist, however it is substandard to the Fire Department requirements. He stated
they had added a secondary emergency egress for the Fire Department on Hill Trail Drive
Mich is located near the southeast corner of the property. There is a one story height
limitation from the centerline of Fuller Wser Road to the east due to the single family
subdivision. Mr. Welty stated they had corroied with the code for single story height.
There will be a number of covered parking spaces and they will preserve all natural trees
around the perin -ter of the property. He stated the project gill be constructed from brisk
and plaster and would be a pleasant scenic drive through the project.
There being no further proponents or opponents, Chairman Young dosed the Punic
Hearing.

Commissioner 04vens had questions regarding the fencing along the east property line.
He stated he had a personal feeling regarding the safety of the citizens because of the
ability to see through the fences. He stated wood fencing would not be acceptable.
Commissioner Bright stated she also had some concerns regarding the wood fencing
because of safety issues and deterioration. She stated she liked the project with the
exception of the wood fencing.
Commissioner Zahn asked the applicant for clarification on the location of the wrought
iron fencing around the property. He also stated he had concerns regarding the wood
fencing on the backside of the property and he felt the wood fence would take away from

the value of the project.
Mr. Welty stated the reason for the wood fencing was to provide privacy since the
abutting project is under construction. He infon-ned the Commissioners he would provide
the wrought iron fence since it was a rna.9 or concern with the Corrrnissioners.
Paul Krucken-eyer, City Engineer, stated the original public improvements do not meet
the current standards, however, Mr. Welty has agreed to upgrade the drainage standards
and facilities, Mr. Kruckerneyer comrnended Mr. V\k,* and his design team for working
with the existing facilities and salvaging as much as possible. He stated he approved of
the access, curbs and streets.
Commissioner Shuler asked the applicant about the proposed lighting. Mr. Welty stated
there would be arnple lighting, however, if the proposed lighting was not adequate they
would provide additional lighting.
Chaim-on Young reminded the Commissioners they vvere considering the use of the
proposed project only and not the drainage.
CxxTrrissioner Owens made the motion to approve#96-45-SUP with the addition of Mr.
V blty`s voluntary con*rnittrent to provide wrought iron fencing on the east side of the
property, Commissioner Shuler seconded the motion. The vote was as follows:

property and the location. He stated the purpose of site plan is to make sure that it meet
the r�nirnum standards to the code and fits well on the site. He stated the DRC had
revieomd the proposal and recon-r-ended approval.
Paul Krucken-eyer, City Engineer, stated everything regarding this site plan request was

Commissioner Zahn made the motion to approve SP with the voluntary statement
from Mr. V\/elty to construct a wrought-iron fence along the east side of the property.

in size to serve the site.
Commissioner Cans questioned the Fire Marshal regarding fire sprinklers on all three
floors of the building. Michael Logan stated they fire sprinkler system was adequate and
no certificate of occupancy would be issued until the system eras completed.

Bo Bass; Director of Planning and Development, stated the applicant proposed to
construct a 64,731 square feet office/warehouse near the northeast corner of Royal

Parkway and S. Pipeline Road. He stated the City Council, at their February 11, 1997,
meeting, granted an exception to the recently adopted 10)% masonry requirement to
approximately 80%masonry. He also infom-ed the Commissioners the site plan complied
with the exception granted by the City Council. The Development Review Committee had
reviewed the request and found the information to be consistent with the Euless Unified
Development Code and recommended approval of the site plan.
Mr. Peter Bro m, Thorley Architects, represented the applicant and stated he was available
for any questions from the Commissioners.
Commissioner Owens stated he was receptive to the request and thanked the applicant
for staying in the City of Euless.
Paul Kruckemeyer, City Engineer, stated the Engineering Department had worked closely
with the applicant's consulting engineer and he recommended approval.

Bo Bass, Director of Planning and Development, stated the applicant, Clark Butler, was
proposing to construct a 20,249 square feet office building on the southwest corner of
V\Alshire Drive and S.H. 133. The building is proposed to be a two story, glass and steel
building with parking underneath on ground level. Mr. Bass informed the CorTvTissioners
the site is currently zoned C--1 and the proposal would not be a use issue. He stated the
building is proposed to be three stories with the parking area on the lower level and the
top two stories are glass and steel. Mr. Bass stated stucco had been proposed on the

north elevation. The purpose of the site plan approval is to verify that the minimum
standards of the code have been met. The Development Review Comrnittee had met and
reviewed the request and found the information provided to be consistent with the zoning
and subdivision regulations of the Euless Unified Development Code and recorr ►ended
approval,
Clary Butler, 12525 Montego Plaza, Dallas, Texas; stated he would be available to
entertain questions from the Commissioners,
Corrrnissioner Owens stated he had concerns regarding the stucco on the north
elevation. Fie asked the applicant if there were any reasons they were not proposing
masonry. Mr. Butler stated the final determination had not been made to use stucco. Fie
stated the panels on the north and south elevations were sheer walls/wind loads and troy
possibly be masonry. Cornrr�issioner McMillon stated he had the same concerns
regarding the stun proposed on the north elevation.
Paul Krucken-ever, City Engineer stated the applicant had addressed all of the
Engineering Department issues. He stated the drainage would be taken to a concrete
box being placed underground along the northern line of the property line. He informed
the Corrssioners the reason there is no off-site irrrpoover ;nts being required at this
time was because Mr, Butler was working with the adjoining property owner. The
extension of the box culvert is on the adjoining property. This issues would be addressed
at the time of construction plans and permits to do construction.
Mr. Bob West, Attorney, 301 Commerce Street, Fort Worth, Texas, represented Mr.
Richard Keraig. Mr. Keraig is the land owner to the west of the proposed site. He is not
the immediate adjacent property owner, but one tract to the west. Fie stated they were
present at the public hearing to follow the progress of the development regarding drainage
issues. He stated Mr. Keraig's land has some drainage issues on it with some reeks
that cone together. He stated they did not oppose the request from Mr. Butler, however,
wanted to be assured it did not change the drainage flow on his clients property.
Paul Kruckemeyer, City Engineer, stated the outfall from any drainage will be at the
current location where the water is flowing, He stated the location of the storm drain on
the plat is substantially removed from the existing channel would be. The City Engineer
is also working with Mr. Butler on the project for the adjacent land and working out the
drainage details. If for some reason the adjoining lot does not proceed further, Mr. Butler
would have some off-site improvements to make. He stated Mr. West could be assured
where the water eaters his client's property is where the water will enter after the project
is completed.

Conyrissioner Shuler expressed some concerns regarding the wood fence dun ster
screening. Mr. Sutler stated the fend would be a bloc fence stucco that would tie into
the exterior design of the building.
ConTnissioner teens made the rnotion to approve X48 SP as presented with the
understanding the City Engineer is more than confident the drainage issues are solved
regarding this property. Corssioner Shuler seconded the motion. The vote was as
follows:
