Five members of the Planning and Zoning Con-rrission were in attendance, PLAMNG AND ZONING COWASSION CONSIDERATION OF SCHEDULED ITEMS- COUNCIL CHAMBERS. Chaim-an Ronald Young called the Planning and Zoning ConTnissjon meeting to order at 7:00 p.m, for the consideration of scheduled items. He stated there were six members of the Planning and Zoning Commission present, Commissioner Eggers was absent. Fle stated the replat was a ministerial function. The Development Review Committee had reviewed the request and recommended approval. Vice Chairman Zahn opened the Public Hearing and asked the applicant to give a brief description of his request. Ron Young, 5485 Beffline Road, Dallas, Texas, representing Rolly Gillham stated the applicant would like to subdivide the lot to become two single fare ily residential lots which conformed to the applicable zoning and requested approval of the plat. Geraldine Kirk, 101 Arnett, stated she would like to know Mich direction the houses would face and how the replat would affect the surrounding property. Mr. Young stated PLANNING &ZONING COMMISSION, PAGE 3 SEPTEMBER 15, 1997 the one large lot vvould be replatted into two lots and the houses vvould front Alexander Drive with lots being 7500 to 7700 square feet. The lots vvould be consistent with the property in the area. Kevin Nlercer. Fie stated the City was in the process of getting the zoning throughout the City to be consistent with CLDP (Comprehensive Land Development Plan). He stated the City would have several meetings regarding different targeted areas of the City for the next few months. Fie stated the current zoning for discussion was described in Exhibit"EY to become the Texas 10 Zoning District which the City had developed about three years ago. hie stated the area was located along the far western end of West Euless Boulevard. The Development review Committee had reviewed the request and recommended approval. Chairman Young stated the City of Hurst and the City of Euless had gotten together to create a zoning district that would be consistent going from one city to the next. Conyrissioner OvRns stated about two and a half years ago the meetings were passed through the City Council. Chairman Young opened the Public Hearing for proponents and opponents. Patrick Conroy, 28135 Needles Street, stated he would like to have a more specific description of Texas Ten District. ,dim Macons, conTnercial real estate broker within the Metroplex area, stated he would like to know how this zoning would affect the existing businesses. PLANNING &ZONING COIVMSSION, PAGE 5 SEPT EIVIEER 16, 1 997 Chairman Young was asked to explain the rules and regulations for a Public Hearing. He explained the rules and procedures governing a Public Hearing. Lois Srianekkel, 3724 Mulberry, Bedford, asked if HWY. 10 was the only area up for discussion. John Stonecipher, 2711 Needles Street, stated he was concemed that he would not be able to ask further questions once the Public Hearing was over. Russell Pond, 2803 Needles Street, stated he would like to know what the commercial area behind Needles Street would be zoned. Chairman Young dosed the Public Hearing. V. RECOWN"110N OF - ZONING CHANGE #97-3120 (TEXAS TEN DISTRICT) Consid"the zoning change mqpest of the Cky of ELeaw fern the cm rent zoning cllasdfica"s) as shmn in Exhibit 'W'to TX-10 (Texas Ten D;str" Bo Bass, director of Planning and Development,answered questions regarding the Texas Ten District. He stated Texas Ten would be an attempt to provide the commercial area a higher level of quality such as screening of dumpsters, setback requirements and screening by landscaping, which the basic C,2 zoning does not have. Fie stated the basic com-nercial in nature would look good under the Texas Ten District. He stated familiar businesses such as retail, restaurants, clinics, etc.would be included in the TX-1 0 District. M unidentified citizen asked if Texas Ten was an overlay use study. Commissioner Zahn read the Texas Ten Zoning District Standards from the UDC(Unified Development Code), ConTnissioner Cans stated the existing businesses would be brought up to the new Texas Ten standards whenever they went out of business or would want to add on to their business. An unidentified citizen asked if Texas Ten was a City of Euless or State program. Chairman Young stated there was a Committee built up from the City of Hurst and the City of Euless which worked together to axne up with the City of Hurst standards and the City of Euless had their oven set of standards which were compatible. Con'tTissioner Owens stated the Chamber of Commerce promoted the HEB (Hurst., Euless, Bedford) area to spruce up the area. He stated Texas Ten was City of Euless initiated to protect the corridor. PLANNING &ZONING COWASSION, PAGE 6 SEPTENWR '16, !'993 Sill Armstrong, 2024 Hurstview Drive, asked why there was a separate Texas Ten from the current UDC. NV. Bass stated Texas Ten was custom fatted to the corridor of Hwy. 10. He stated the custom fitting may not be appropriate for Hwy. 157 or Hwy. 183 which the City was working on a specific Hwy. 121 zoning district and would be mentioned at another zoning meeting. Mr. Bass stated the existing businesses along Hwy. 10 vmuld not be affected as long as the folloWng items do not occur: 1.)They voluntarily close the business, then any new owner would have to c orne into compliance, 2.)greater than 51%of the total value of the structure would be lost due to fire, act of God, etc, then by code or by Texas State Law the City would be able to make the owner dame up to the Texas Ten Standards, 3.)if the use was abandoned for six months per State Law and per UDC, and, 4.) if the owner wanted to expand the building then the Texas Ten Standards would have to be met. CxmTrissioner Zahn stated the consistency was of the utmost interest in the development along the Hwy. 10 corridor. Chairman Young stated the potential buyers should evaluate property that is for sale, building standards and what uses are permitted in that district and before they purchase the land and regret not doing a study of the development standards. Commissioner Shuler made the c omrnent the same requirements that view high standards that the citizens have to keep up on their property keeps someone from coming in next door and putting up a shack or something that would cause surrounding property to be a disadvantage. She stated the code requirements would be to protect as well as everyone having the same standards. Commissioner Zahn made the motion to approve the recommended zoning change 7-- 31 ZC as presented. Commissioner Owens clarified with the audience that then vms the time to speak if they had any further comments. Corrinnissioner Shuler seconded the motion. PUBLIC HEARING m ZONING CHANGE #97-3220 W XAS TEN DISTRICT) Public input regarding a zoning change request of the City of Euless from the current zoning classification(s) as shown in Exhibit "B"' to TX 10 (Texas Ten District) Bo Bass, Director of Planning and Development, gave a brief description of the property being on the south side of Hwy. Igo He stated the bulk of the property vvas currently zoned C-2 Commercial with the uses being basically similar. He stated there would be better landscaping; screening requirements, durnpsters and loading areas. He stated the DRC recommended approval. Chairman 'young stated there was no sinister plot as to why the Texas Ten Zoning Districts were grouped apart with one on the north side of Hwy. 10 and the other on the south side of l Mq, 10. Chairman `young opened the Public Hearing and asked for proponents and opponents. Fie gave a brief description where the boundaries were for the area of discussion. Huel *aver, Weaver Development Company, stated he owned the piece of property gear Royal Parlay and back to Vfestpark Way. He stated he would like to know hove Texas Ten Zoning District was going to help him when he was L-1 (Limited Industrial District) and 1-2 (Heavy Industrial District). ComrTissioner Cans asked Mr. Weaver the size of his property. Mr. Weaver informed the ConTrissioners the property was about 0.5 acres. 'III. RECOMVIENDATION OF W ZOMNG CHANGE #97.3220 - (TUAS TEN Consider the zoning change request of the City of Euless from the current zoning classification(s) as shown in Exhibit "B"' to TX-10 (Texas Ten District) Bo Bass, Director of Planning and Development, stated the City Staff was recommending to Planning and Zoning Con fission and the City Council that Texas Ten Zoning District be extended down some of the major approaches specifically adjacent to the Athletic Complex and adjacent facilities. He stated the Texas Ten Zoning would extend up and down Hwy. 157 and west of Hwy. 157 and east of Hvvy. 157. He stated the zoning would definitely limit the uses in a Heavy Industrial District and suggested to Mr.weaver he may want to plea to City Council on October 14, 1997. Mr. Weaver stated he was very much opposed to the zoning change for this area because it was going to hurt the sell of his PLANNING &ZONING CO111 SSION, PAGE 8 SEPTENWR 16, "1997 Irk. Comriissioner 04ens clarified with Mr. Weaver that he had received the proper mailout which had been received at least 10 days prior to the meeting. Comm issioner Shuler stated clarification for the zoning of Mr. Maver's property being L-1 and 1-2. CoTi-nissioner Owens stated the taxpayer's money which was invested in the Texas Star ball park area was going to enhance Mr. Weaver's property and that it should help the sel I of the property. He stated the owner had it for fourteen years and he would not put a stigma on sonieone's property because if the Golf Course did not do well then he would recommend the City put the Texas Ten Zoning District on it as well. He stated the location was a house keeping matter. He stated the DRC recommended approval. Chairman Young opened the Public Hearing. There being no proponents or opponents he closed the Public Hearing. Corrryissioner Cans asked for the definition of ownership lines. NV. Bass stated the ownership lines were described as being an owner who would own property with the same type zoning instead of splitting up several parcels of land. PUBUC HEARING-ZONNG CHANGE#97-36-ZC-(L-1 LIFTED INDUSTRIAL DISTRICT) Public input regarding a zoning change request of the City of Euless from the PLANNING &ZONING COMWIISSION, PAGE 11 SEPTEMBER 16, 1997 current zoning classification(s) as shown in Exhibit "B" to L-1 (Limited Industrial District) Bo Bass, Director of Planning and Development, gave a brief description of the location. He stated the staff had reviewed the area and found the current C-2 zoning to be in a Limited Industrial District. He stated the DRC recomn-ended approval. Chain-nan Young opened the Public Hearing. Olin Lane, 3404 Bryn Nlaur, University Park, Texas, stated he was the owner of Lot C, Plaza Grande Addition, which was the most western part of the City on the north side of Hwy. 10. He stated the surrounding area was the Tarrant Printing Company. He stated his property had 150 feet frontage on Ftwy. 10 and 140 feet of depth. He stated the L-1 zoning would put an honest burden on his lot because of the 110 feet setback requirement. He stated the setback would reduce the size of the lot for future use to be less than 401/16. Fie asked that the CorryTissioners reconsider the proposal. Chairman Young dosed the public hearing. Commissioner Zahn recommended lot C, be changed to the Texas Ten Dstrict instead of L-1 due to the size of the lot. ConTrissioner Cm ens asked Mr. Bass if Case #97-36-ZC could be taken out for reconimndation and brought before the Commissioners on another date. Comrnissioner Owens stated there may be something in the PD zoning that w�uld not allow for the recomrTL-nded change such as a time frame. Mr. Bass stated it would be okay to table Case #97-36-ZC. Fie complinvnted W. Lane of his knowledge concerning the requirements of lot setbacks and out parcels. Cornr-Nssioner Zahn stated Mr. Lane had a valid point with Tarrant Printing working under a PD(Planned Development)with an underlying C-2 District. Commissioner Zahn stated the business would always work under a PD until they cease to exist. Com-nissioner Zahn made the comment that Tarrant Printing may at some time be changed to Texas Ten Dstrict if they should sell out or someone ask for rezoning. CornT issioner Zahn stated he did not think it would be a mistake if the C-2 zoning was changed to Texas Ten. Cornrnissioner Owens asked if case#97-36-ZC would have to be readvertised. Mr. Bass informed the Cornnissioners renotification was not necessary. XV. He stated the property was currently zoned C-1 and was therefore a legally existing non-conforrning land use. The City Council and staff was recommending to make it a legally existing conforming land use. Therefore, the DRC recomrnended approval. Chairman Young opened the Public Hearing. XVIII9 PUBLIC HEARING ZONING CHANGE #97-38 ZC - (R-2 SIDLE FAMLY RESIDENTIAL DUPL.EC EMSTFdCT) Public input regarding a zoning change request of the City of Euless from the current zoning classification(s) as shown in Exhibit "EY to R-2 (Single Family Duplex District) Bo Bass, Director of Planning and Development; gave a brief description of the proper along the east side of Raider Drive, He stated the City was trying to create a more effective buffer between the single family lots and the institutional uses of the school and the multi family to the wrest of Bider Give. He stated the area in the existing categories consisted of multiple types of zoning, C2, PD, R-4. He stated the proposal of the area vms to bring it into compliance with an R-2 Duplex District. He stated the DISC had reviewed the area and recommended approval. Chaim-an Young opened the Public Hearing. Jim Packer, 3405 San Bar Lane, Bedford, Texas, stated he was disappointed that he received notice of the public hearing regarding the zoning change and was not notified that his property was the zoning change. He stated he was not in favor of this zoning change. He stated the City was not taking the grandfather clause into favor. He stated a lot of money had been spent on his property to enhance the area and this zoning change could inconceivably cast hire $100,000.00. He stated the zoning change would not fit being an R-2. He was involved in the developing of the current R-4 properties. He stated the apartment complexes that were existing on the property would not conform to the new zoning. He stated if a building should burry the City would tell them they could not rebuild what wras there and would need the R-2 zoning district. He stated he went through some hard times back in the Ws and they did all they could to keep Sycamore Square Apartments alive. He stated he had someone that had expressed an interest in the vacant PD zoning lot and now the City was proposing to make the lot virtually undesirable to anyone. He stated the Planned Development was for seven fourplexes and the property was more or less ideal for the fourplex plan. Jeff Byedy, 901 Forest Olen, Bedford, Texas, owmer of Sycamore Square Apartments, stated the property directly west of the apartment complex would be the R-5 zoning of the previous case. He stated south of the complex would be the Texas Ten District. He commented he would like to rec,omrmnd R-4 so they may continue with the current use PLANNING &ZONING COWASSION, PAGE 14 SEPTEMBER 1B, 1997 if something should happen to their property. He stated their situation was unique because each of the seventeen lots were plotted separately for the Deed Restrictions. He stated concerns that if the building bum the owner would be able to rebuild to the existing zoning. Mimi Byedy, 941 Forest Glen, Bedford, Texas, stated the Sycamore Square apartment's were very well maintained and the apartments were usually 144010 occupied. She stated the apartment complex as it was today is a complete buffer zone. She stated the property takes had tripled sine they had bought the property. She stated the City was hurting economically as well as everyone in that area. She expressed the desire to see the area rezoned to RM4 so the properties with R-4 and PD would not have the transition. Jim Sinclair, 2814 Spring Valley, Bedford, Texas, owner of 1243 Raider Drive, stated he purchased the old day care center about six years ago to build an office building. He stated he had invested about $154,440.44 in improvements to bring the gilding up to code. He stated the building was attractive and the rezoning would impair the site for remarketing compliance with the R-2 zoning use. He stated his investment was for a con ercial use. He stated concerns with the financial situation if the rezoning was to R-2 zoning duplex use. He stated he was contractually and bound by lease and contract of sale to comply with the€orrinvrcial use. He stated he would be in violation of the lease and contract of sale and would be financially damaged. He cornrnended the City for what they were trying to do. Fie asked the staff to reconsider and leave C-2 zoning in tact. Chairman Young closed the Public Hearing. YJXA RECOMMENDATION OF ZONING CHANGE#97a38-ZC m(R-2 SINGLE FAMLY RESIDENTIAL ALEX DISTRICT) Public input regarding a zoning change request of the City of Euless from the current zoning classification(s) as shown in Exhibit "B" to R-2 (Single Family Duplex District) Cor i ssioner Glens stated there was not much difference with buffer concerns between R-2 and R-4. He stated the arguments were well put concerning the R-4 apartments close to Hwy. 14. He stated he was interested in going with the apartment owners opinion and go with Rm4 zoning instead of the R-2 zoning. Commissioner Shuler stated she would like to hear what staffs opinion would be for the advantage to the City and the disadvantage to the property owners as they had presented their presentation to go with R-4 zoning instead of R-2 zoning. Bo Bass, Director of Planning and Development, stated the citizen°s points were valid. Fie stated the area could be postponed until the owner would come before the City to request a change. He stated he was sorry there was no clear cut answer. He stated his objective as a staff member was to inplen-ent the Comprehensive Plan and change the property to R-2 but that was not necessarily the correct thing at that point and time. ConTnissioner Shuler asked Mr. Sass if the case could be tabled. Mr. Bass stated it could be tabled and brought back at a later time. Fie stated all the points mentioned were valid and tough issues. Mr. Sass gave the description of a non-conforrring land use by not being in the proper zoning area. Mr. Packer stated that Raider Drive was a thoroughfare and the existing R-4 zoning which was granted, bought and paid for. Flee stated the R-4 should be a sufficient buffer. He stated they had spent much money on the parcel of land that was approved by the City for the P®zoning and now they had been informed of the rezoning. Comrnissioner N'Icl`selillon stated concerns with the mixed zoning. He stated he understood the reasoning but he did not see the need to go with a zoning that was not in use now. He stated he was not in favor of tabling the issue because the same issues would resin. He stated he was not in favor of the R-2 zone. Conryissioner Bright stated the citizens presented a good case. She suggested RA zoning which would make it consistent. Commissioner Zahn stated he agreed with the RA rezoning. He stated concerns with the buffer providing the transition from the school and the residential area. Conyrissioner Owens asked if the R-4 would be for the C-2 as well. Commissioner Zahn stated he meant for the entire strip. Commissioner Owens stated lam. Packer presented a good argument and he was willing to go RA zoning. Mr. Bass had discussion with Mr. Sinclair about the RA zoning hurting the resale of his property and the possibility of financial problems such as a commercial business in a R-4 zoning district. C,onrnissioner Zahn made the motion to recon-nvnd changing the zoning request from R-2 to R-4 and recommending it to City Council for approval. She needed further understanding of the 200 feet radii and how was it affecting her property, ConTrissioner Zahn stated the townhornes setting on the R-5 would not be a problem until something should happen and they would have to rebuild to the R-5 standards, so why not dean up the zoning issue to be consistent.
