Semen members of the Planning and Zoning Comrrission were in attendance. PLANNING AND ZONING CONMSSION CONSIDERAMON OF SCHEDULED ITEIUIS COUNCIL C}-IAII WRS. Chairman Ronald Young called the Planning and Zoning Commission meeting to order at 7:00 p.m., for the consideration of scheduled items. He stated there were seven members of the Planning and Zoning Commission present. Dev. and Nlarketing Carol Griffith, City Planner Donna Brovm, Office Technician Dolores Tjerina, Development Secretary Jim Wy, Senior Building Inspector PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by Commissioner Eggers and the Invocation was given by Commissioner Zahn. APPROVAL.OF MUTES Con'rrissioner Zahn made the motion to approve the minutes of the September 16, 1997, Planning and Zoning meeting. The nation was seconded by Comrnissioner Shuler. The vote was as follows: Ayes: Commissioners Shuler, Young, Eggers, Zahn, Bright, Owens, McAAillon Nays: None The motion carried. EULESS BOULEVARD Pubic input regarding the proposed request of Mr. Randy Hobbs; Full Boar Cycles for approval of a Specific Use Permit for motorcycle sales bated at 114 West Euless Boulevard, generally described as Halford Survey, Abstract 711, Tract 1 B1A Bo Bass, Director of Planning and Development, gave a brief description of the location for the motorcycle sales. He stated Mr. Hobbs, business owner, was unaware that a Specific Use Pem-t was required for the motorcycle sales shop. He stated the code enforcement department discovered the use was not in compliance with the zoning district. He stated Mr. Hobbs voluntarily chase to apply for the Specific Use Permit and the Development Review Corttee recortymnded approval based on the uniqueness of the site and business. Chairman Young opened the Public Hearing and stated the rules governing a Public Hearing. Mr. Randy Hobbs, 621 Rankin, Bedford, stated the business at 114 West Euless Boulevard had been opened for 3 1/2 years, He stated the business had been fairly successful. He stated the business attracted people from all over the rnetroplex and brought there to Euless. He stated the more people that e to the City of Euless to visit his motorcycle shop the more recognition f©r the City. He stated he wanted his business to stag in Euless and had no desire to rove to another location. He stated he was for the upgrade to Hwy 10. He stated he was not aware of the outside sales display rules and assumed responsibility for not checking into the code. He stated by displaying the cycles inside the building his business would die and go away. He expressed cones wanting to be in compliance so he could continue his business by staying in the City of Euless. There being no proponents/opponents, Chairman Young dosed the Pubic Hearing. II. RECOMIVIENDATION OF a SPECIFIC USE PELT #97 UP W 114 W EUL..ESS BOULEVARD Consider recommendation of the proposed request of Mr. Randy Hobbs, Full Boar Cycles for approval of a Specific Use Permit for motorcycle sales located at 114 West Euless Boulevard, generally described as Halford Survey,Abstract 711,Tract 1B1A PLANNING &ZONING C011 ASSION, PAGE 3 OCTOBER 7, 9 997 Chaim-an Young stated the business had started in 1994 and asked the applicant where the customers parked, how many at one time and how many cycles were parked out front of the building on an average. Mr. Hobbs stated parking was on the east side of the lot and three cars could park at the same time, 20 to 25 cycles approximately pare out front at a time. He inforrd the Corrssioners the motorcycles were sold on consignment or ones he had purchased but he was not a franchised dealer. He stated all the motorcycces were preowned. Comnissioner Covens asked the applicant why he was requesting the SUP. kv. Hobbs stated the code enforcement department inforn-ed him of the SHIP. Corr ssioner Owens stated he felt the request was more of a code enforcen-ent issue and did not want to deny the request based on the departmental issue. hie asked the applicant if he could reduce the number of cycles parked outside. Mr. Hobbs stated 20 to 25 was real dose to what he felt he needed to attract the driveby traffic. Corr ssioner Owens asked what the ratio of ownership was for the consignment cycles. Mr, Hobbs stated his ownership in the cycles fluctuate from 50%to 950% per =nth. Commissioner Shuler stated the design of the public and private streets need to be revised for parking spaces. She stated she could not recommend the specific use permit with the business not complying with all thirteen SUP Evaluation Criteria requirements. She stated the operation of sales looked good and she was impressed Wth the volume of business. Comrnissioner l+lcMillon stated he was happy to have the business in Euless and would much rather have the building occupied than vaunt. lie stated the dilenTna was trying to work with the outdoor storage. Cot ssioner"I Ion stated there was at least half of the requirements that were not met which made it hard to present the case to the City Council for reconTnendation. Comrnissioner Bright stated she would hate to see the business go away but she agreed with the others that there was not enough criteria to support the request. Coryrissioner Eggers stated the lot did not appear to have enough parking for any type of business of today. He asked the applicant what the nonpaved area was used for. Mr. Hobbs informed the Corr ssioners the area to the rear of the building was not being used. Commissioner Eggers suggested the area the used for his showroom because he felt the majority of Mr. Hobbs' business was from customers that traveled specifically to the business instead of driveby traffic. Commissioner Eggers stated the showroom being located in the rear of the property would allow more parking spaces in the front. Air. Hobbs stated the motorcycles being parked out front made his business happen. Commissioner Eggers suggested a wood rail fencing by the street along with the landscaping. PUEUC HEARING ® AMENDMENTS TO LJDC SECTION 844K TABLE 4-A - #PZ-97-07 Public input regarding the proposed amendment to the Unified Development Code (UDC) pertaining to certain uses within the TIC--10 District Bo Bass, Director of Planning and Development, gave a brief overview of the Texas Ten Zoning District. He stated the City Council and the Planning and Zoning Commission chose to modify the standards for the Cm2 corrrmercial zoning district, specifically taking a series of uses permitted by right to specific use pen-Tit only. Fie stated the similar uses that existed in the C-2 zoning district should be changed for the Texas Ten Zoning District to reflect consistency. He stated the recomrnendation was to consider changing permitted by use kennels and pounds indoors only, fuel dealers bulb, taxi cab companies, bus service, miscellaneous equipment rental and leasing, parking structures commercial, top and intedor, body repair, tire retreading, tire repair, paint shops, general repair, car washes, electrical repair shops; welding repair, an-nature rewinding shops and trussing services to specific use permit only. Chairman Ronald Young gave the rules and procedures governing a Public Hearing. Chair-ran Young opened the Public Hearing. There being no proponents or opponents, ChainTen Young closed the Public Hearing. IV. RECOMWNDAIION OF-AMENDMENTS TO UDC SECTION 84-84,TABLE 4-A -#PZ-97-07 Consider recorremendation of the proposed amendment to the Unified Development Code (UDC) pertaining to certain uses within the TX-10 District Commissioner Eggers asked what the setback was on the Texas Ten Zoning District for Hwy. 10. He was concerned the City of Euless Animal Shelter would be affected by not being in compliance. Mr. Bass stated the boundaries for Texas Ten District would be roughly 300 feet and the shelter would be in compliance. Commissioner Shuler stated any businesses prior to the approval would not be in compliance. Conyrissioner Eggers made to motion to approve the recomn-endation of#PZ 97-07. Corrrissioner Owens seconded the motion. The vote was as follows: Ayes: Commissioners Shuler, Young, Eggers, Zahn, Bright, Owens, WMillon Nays. None The motion carried. Chairman Young welcomed Carol Griffith, City Planner, to the Planning and Zoning Meeting. He stated the Commissioners were pleased to have her on staff.
