MINUTES
The Pre-Commission meeting of the Planning and Zoning Commission was called to
order by Chairman Ronald Young at 5:30 p.m., in the Building "A" Conference Room.
Six members of the Planning and Zoning Commission were in attendance.
PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS
COUNCIL CHAMBERS.
Chairman Ronald Young called the Planning: and Zoning Commission meeting to order
at 7.00 p.m., forthe consideration of scheduled items. He stated there were six members
of the Planning and Zoning Commission present. Commissioner Joy Shuler was absent.

PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by
Commissioner Bright and the Invocation was given by Commissioner McMillon.
APPROVAL OF MINUTES
Commissioner Owens made the motion to approve the corrected minutes of the October 21,
1997, Planning and Zoning meeting. The motion was seconded by Commissioner Eggers.
The vote was as follows:
Ayes: Commissioners McMillon, Young, Eggers, Zahn, Bright, Owens
Nays: None
Absent: Commissioner Shuler
The motion carried.
REGULAR AGENDA
Chairman Ronald Young gave a brief summary of cases.
Bo Bass, Director of Planning and Development, gave a brief overview of how the zoning
changes would effect the existing zoning uses. He commented as long as the current
business existed the use would not be effected even if there was a change of ownership.
He stated if the use was discontinued then the new zoning requirements would take affect.
Chairman Ronald Young representing the City as the applicant, gave a brief review of the
zoning change requests. He asked the participants from the audience to make their
presentations brief.
Commissioner Billy Owens made the motion to move Item 1 to the last Item of the Agenda
due to the fact the case was City oriented. Chairman Young stated he was opposed to the
motion.
The motion died for lack of a second.
REGULAR AGENDA
ITEM 1 CONSIDER APPROVAL OF _ FINAL PLAT - #P-98-21 - TEXAS STAR
ADDITION
Consider the request of the City of Euless for a final plat of Texas Star
Addition, Block A, Lot 1; Block B, Lot 1, Block C, Lots 1, 2; generally located
West of Texas Star Parkway, South Pipeline Road and Hurricane Creek and
West of the floodplain limit

Bra Bass, Director of Planning and Development gave a brief description of the proposed final
plat and its location. He stated the final plat approval was a ministerial function however,
DRC (Development Review Committee) had reviewed the plans and found no technical
problems and recommended approval.
Chairman Ronald Young stated he had reviewed the plans and found no technical problems
and asked for a motion to approve the final plat.
Commissioner Zahn made the motion to approve final plat #P-96-21 as presented.
Commissioner McMillon seconded the motion.
Commissioner Owens asked Andrea Baxter, Assistant City Engineer, if the sign along West
Euless Boulevard could reference cafe instead of grille. He stated the word grille did not do
the facility justice.
Andrea Baxter, Assistant City Engineer, stated she would forward the information to the
proper authorities.
The vote was as follows:

ITEM 2, PUBLIC HEARING - ZONING CHANGE - #97-4040 - NORTH INDUSTRIAL
BOULEVARD
Public input regarding the request of Jana Porter for a zoning change from C-2
(Community Business District) and R-3 (Multi--Family Dwelling District 12
units/acre) into R-1 C (Single Family Custom Dwelling District) on the 21.735
acres of land out of the George Linney Survey, Abstract 939, generally located
500 feet North of West Ash Lane and East of North Industrial Boulevard
Bo Bass, Director of Planning and Development, gave a brief description of the property for
rezoning. He stated the Comprehensive Plan shows the area to be residential in nature,
specifically low density residential (12 units per acre and currently zoned commercial. He
stated the DRC recommended approval.
Chairman Ron Young opened the Public Hearing and asked for proponentslopponents.
Bart Jetton, 8904 Jason Court, stated he and Jana Porter's contract for the property was
contingent on the zoning change. He stated Mazzie Eden was not in favor of multi-family

zoning for the property.
There being no proponents/opponents, Chairman Young closed the Public Hearing.
ITEM 3. RECOMMENDATION OF - ZONING CHANGE - #97-40-ZC - NORTH
INDUSTRIAL BOULEVARD
Consider recommendation regarding the request of Jana Porter for a zoning
change from C-2 (Community Business District) and R-3(Multi-Family Dwelling
District 12 units/acre) into R-1 C (Single Family Custom Dwelling District) on the
21.735 acres of land out of the George Linney Survey, Abstract 939; generally
located 500 feet North of West Ash Lane and East of North Industrial
Boulevard
Commissioner Owens stated he liked the large lots with 3500 square feet living area and was
appreciative of the opportunity to offer homes from the price range of $300,000.00 to
$500,000.00.
Commissioner McMillan stated he was in favor of the project.
Chairman Young stated Commissioner Bright was excusing herself from discussion.
Commissioner Eggers stated he was in favor of the project and felt it was excellent for the
City of Euless.
Chairman Young stated he liked the proposed project and was in favor of the zoning change.
Bruce Bonham stated he was an owner of one lot in the vicinity of the project and had
questions regarding the property surrounding the lake. He stated concerns with the property
and the lake. Bart Jetton stated the area around the lake would be common area for the
homeowners association. He stated they would not be selling the ground underneath the
wafter.
Commissioner Owens made the motion to recommend approval of zoning change #97-40-
ZC. The motion was seconded by Commissioner Eggers.
The vote was as follows:

be rezoned. He stated the property would be Puente Del Oeste, Lot 3. He stated the
current zoning was C-2 (Community Business District) into R_5 (Multi-Family 24 units per
acre. He stated the DRC recommended approval.
Chairman Young reiterated the City of Euless was the applicant.
Chairman Young opened the Public Hearing and asked for proponentslopponents.
There being no proponents/opponents, Chairman Young closed the Public Hearing,

Commissioner Eggers made the motion to approve the recommendation of zoning case#97-
58-ZC. Commissioner Zahn seconded the motion.

ITEM S, PUBLIC HEARING _ ZONING CASE - #97-59 ZC a C-2 (COMMUNITY
BUSINESS DISTRICT)

Bo Bass, Director of Planning and Development, gave a brief description of the property
being the Rogers Elijah Survey, Abstract 1299, Tracts 1 B2, 1 B, 181, He stated the staff had
made a mistake requesting this zoning change because it was currently C-2 zoning. He
stated the request by staff would be to deny the request due to a mapping error.
Chairman Young opened the Public Hearing. There being no proponents/opponents,
Chairman Young closed the Public Hearing.

Commissioner Zahn made the motion to deny the request of zoning case 97-59-ZC.
Commissioner Eggers seconded the motion.

ITEM 8. PUBLIC HEARING - ZONING CASE #97-60-ZC - R-1 (SINGLE FAMILY
DETACHED DWELLING DISTRICT)
Rogers Elijah Survey, Abst, 1299, Tracts 182, 1 B; Oakwood Terrace West Lots
Al, A2, A3; Street Right-Of-Way
Bo Bass, Director of Planning and Development, gave a brief description of the property to
be rezoned. He stated the property was the Rovers Elijah Survey, Abst. 1299, Tracts 1 B2,
1 B; Oakwood Terrace West Lots Al, A2, A3; Street Right-Of-Way. He stated the staff felt
the recommendation would be to table the rezoning request due to recent studies of the gas
lines in the area. Mr. Bass felt R-1 zoning was not the best choice for the area. He stated
staff would renotify property owners in 69 days if the Commissioners chose to table the item.
Chairman Young opened the Public Hearing and asked for proponents/opponents.
A representative of the South Euless Baptist Church stated their facility was adjacent to Tract
3 and was interested in purchasing the land to do an expansion to their facility. She stated
they would like for the Commissioners to consider the expansion when they consider the
rezoning.
Several citizens stated they would like for the item to be tabled for further consideration,
Chairman Young closed the Public Hearing.
ITEM 9. RECOMMENDATION OF -ZONING CASE #97-60-ZC - R-1 (SINGLE FAMILY
DETACHED DWELLING DISTRICT)

Bo Bass; Director of Planning and Development gave a brief overview of the 200 feet radii
for property owner notifications. He stated the graphics would indicate from the Tarrant
Appraisal District who would have been notified.
Commissioner Zahn, Commissioner Eggers, Commissioner Bright and Commissioner
McMillan discussed the zoning of R-1 and agreed that R-1 should be the zoning but they
would consider a table for this item. Commissioner Owens stated he would like to see the
R-1 zoning go forward and was not in favor of the table. Chairman Young stated he was not
in favor of the table.
Commissioner Owens made the motion to approve the recommendation of zoning case##97-
60-ZC. Commissioner Zahn seconded the motion.
The vote was as follows:
Ayes: Commissioners Zahn, Eggers, Bright, Young, Owens, McMillon
Nays: None
Absent: Commissioner Shuler
Kevin Mercer, Development Services Manager stated the church expansion would not be
effected by the zoning change in the future. He stated churches are permitted in any zoning
area with a specific use permit.
ITEM 10. PUBLIC HEARING - ZONING CASE #97-61-ZC - R-1 (SINGLE FAMILY
DETACHED DWELLING DISTRICT)
Oakwood Terrace, Block 10, Lots WPT-A, EPT-A
Bo Bass, Director of Planning and Development, described the property as Oakwood
Terrace, Block 10, Lots WPT-A, EPT-A. He stated the property was currently zoned C-2 and
was being considered for R-1 (Single Family Detached District). He stated the City of Euless
was requesting the change of zoning and DRC recommended approval.
Chairman Young opened the Public Hearing and asked for proponents/opponents.
Bill Wade, owner of the property, stated they did not want the rezoning to take place. Mrs.
Wade stated they understood the grandfather clause but was concerned with what would
happen to the business if the building was vacated. Bo Bass commented that the current
type of business would remain the permitted use and if leased it would need to be a similar
use.

Several citizens spoke in favor of the R-1 change in zoning. They mentioned the load noise
from the buses late at night.
Chairman Young closed the Public Hearing.

McMillan stated they were in favor of the zoning change. Commissioner Owens stated he
was in favor and wanted to know it the staff had proof of who received the property owner
notifications. Barbara Chambers, Planning Coordinator, stated there was a property owner
list taken from the Tarrant Appraisal District's records that the mailing labels were printed
from. Chairman Young staters he was also in favor of the zoning change.

Business District) and was being considered for R-1 (.single Family Detached District). He
stated the City of Euless was requesting the change of zoning and DRC recommended
approval.
Bill Barrow, 1908 Oak Forest, stated he was the owner of property fronting West Euless Blvd,
and parcel #3 on Exhibit "B". He stated he would like to see parcel #3 rezoned to TIC-10
instead of R-1 because he had researched future rezoning cases and found the next

Commissioner Zahn stated he felt Mr. Barrow's suggestion may be something they should
consider discussing. He stated he would be in favor of the TX-10 zoning for the current C-2
zoning district_
Commissioner Eggers stated that half of parcel#3 was in the 100 year floodplain and would
probably never be built on. He stated that the current R-5 district was the City park and R-1
zoning would be the best use. He stated he would be in favor of TX-10 and R-1 zoning
change.
Commissioner Bright stated she would be in favor of the TX-10 and the R-1 zoning.
Commissioner McMillon stated he would be in favor of the TX-10 zoning on the current C-2
and R-1 zoning on the current R-5 zoning.
Commissioner Owens stated concerns with the landlock that may occur if it were R-1 zoning
on the C-2 tract. He stated he wanted the property owner to understand restrictions for the
TX-10 zoning district.
Chairman Young stated he would be in favor of TX-10 only on half of the tract of land that
was C-2 and the R-1 zoning on the current R-5.
Commissioner Eggers explained to the citizens the 100 year flood plain and where it was
located on the tract of land that was zoned C-2.
There was discussion among the Commissioners as to where the current FEMA line would
be. They discussed making the floodplain line the dividing line for TX-10 and R-1 zoning
districts and using the drainage ditch as the buffer to R-1 zoning district.
Commissioner Zahn made the motion to approve the recommendation for tots 1 and 2
current zoning R-5 to be change to R-1 and send forward to City Council on Lot 3 the
northern portion outside the 100 year floodplain to be TX-10 and the remainder of the tract

,Jamie Trinkle, stated he was the owner of Oakwood Crest Apartments and would like to
recommend to City Council that R-5 zoning remain on the property, He stated the R-5
zoning world be the buffer between the businesses on Hwy. 10 and the Rat residential area
to the south. He stated the change would not allow hire to rebuild if there was more than 51
percent destruction. He stated who would build a home next to shopping center. He stated
he had been there 25 years and had taken good care of the property. He gave a brief
overview of the remodeling that had taken place within the 25 years. He stated Richard Ross,
Code Enforcement for Minimum Housing, had commented how well the premises were kept
up which made his job easier,

changing and the new owner not keeping up the property. He stated the owner could always
came in and request the R-5 zoning change if he should need refinancing or rebuilding in
case of destruction.

There were citizens that expressed their opposition to the C-2 zoning. Mr. Shotwell stated

discussion pertaining to the differences between C-1 and C-2 zoning districts and what would
be permitted.

Keith Pinkerton, 712 S. Main Street, stated he was concerned with their plumbing company
and wanted to continue his business with a conforming use and stated he was not in favor
of the zoning change.
John Pierce, 402 E. Huitt, stated he recently purchased property at 700 S. Main St. He
stated it was C-1 and had spent several thousand dollars to renovate the building and was
trying to get a Certificate of Occupancy. He stated he spent C-1 dollars and not R-1 dollars.
He stated he understood the grandfathering clause but he was firmly opposed to the R-1
zoning change.
Leon Hodges, 5909 McLain, Dallas, stated he purchased the property in 1968 and owned
15 acres on the east side of Main Street. He stated the C-1 was about 3 1/2 acres. PD
about 1 1/2 acres and the C-1 about 10 acres. He stated the Spring Valley Apartment
complex was managed by his two daughters and was committed to.the property and did not
want to see the zoning change tape place which would landlock his property. He asked the
Commissioners to consider his thoughts and try to help him with the future plans he had in
store with the City of Euless. Commissioner Owens asked Mr. dodges if he owned the
property for Whitener Road. Mr. Hodges stated he had put up money for Whitener Road
which had never been built. He stated he deposited escrow money in 1971 for the Whitener
Road project.
Several citizens spoke in opposition to the zoning change. Business owners spoke in
opposition to the change in zoning due to their businesses not being in compliance.

Chairman Young reiterated that Mr. Hodges was currently operating a legally existing non-
conforming use in the C-1 and could not rebuild or expand under his current zoning. He
stated the same problems would exist if the change of zoning was approved for
recommendation to City Council,
Commissioner McMillon stated the case was a very complex zoning case because of all the
variables and sympathized with many of the comments made.
Commissioner Eggers stated it was a hedge podge of zoning and the intention was to clean
it up, but he would be willing to listen to other comments.
Commissioner Zahn stated he was in favor to follow through with the recommendation as R-
1. He stated the Pd (industrial Use) should not be in a residential area.
Commissioner Owens stated he was in favor of the zoning change to R-1 because it was the
highest and best use for the zoning change.
Commissioner McMillon stated concerns with Mr. Hodges not being able to develop Lots 16
and 21. He stated he could support the R-1 zoning change.
Commissioner Bright stated there were goad arguments but she would support the R-1
zoning change.
Chairman Young stated the zoning change was a very long terra look as to how the City
would like for the Comprehensive Land Use Plan and the Zoning Map to be consistent.
