MINUTES
The Pre-Commission meeting of the Planning and Zoning Commission was called to order
by Chairman Ronald Young at 5:30 p.m., in the Building "A" Conference Room. Seven
members of the Planning and Zoning Commission were in attendance.
PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS -
COUNCIL CHAMBERS.
Chairman Ronald Young called the Planning and Zoning Commission meeting to order at
7:00 p.m., for the consideration of scheduled items. He stated there were seven members
of the Planning and Zoning Commission present.

PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was given by
Commissioner McMillon and the Invocation was given by Commissioner Owens.
APPROVAL OF MINUTES
Commissioner Shuler made the motion to approve the minutes with corrections for
November 4, 1997, Planning and Zoning meeting. The motion was seconded by
Commissioner Eggers.
The vote was as follows:
Ayes: Commissioners McMillon, Young, Eggers, Zahn, Bright, Owens, Shuler
Nays: None
The motion carried.
Chairman Young informed the audience that the Planning and Zoning Commission and
City Staff for the past two years had been reviewing the land uses for the City of Euless
and had adopted an updated Comprehensive Land Use Plan, Chairman Young stated the
City had initiated zoning change requests for portions of the City to be brought in
conformance with the City's Comprehensive Land Use Plan.
Bo Bass, Director of Planning and Development, gave a brief overview of how the zoning
changes would effect the existing zoning uses. He stated the current business use would
not be effected even if the ownership changed. However, if 51% of the business is
destroyed by fire then the use would stop and the new zoning requirements would take
affect.
Chairman Young informed the audience that for each zoning case there would be a Public
Hearing and asked that any participants wanting to speak to give their name and address
and a short presentation.

Mr. Jim Nichols a resident of Euless asked for the definition of Texas Ten District. Mr.
Bass read the definition of Texas Ten District from the Unified Development Code.

Commissioner Eggers stated for the future growth of the City was important to have control
of the businesses which zoning provided. He stated he was in favor of the zoning change.
Commissioner Bright stated she was in favor of the zoning change.
Commissioner McMillon stated he supported the zoning change for the same reasons
already stated,
Commissioner Shuler stated she was in favor of the zoning change.
Commissioner Owens stated he supported the zoning change. He stated it established
good guidelines for the developers,
Commissioner Eggers made the motion to recommend approval of zoning case #97-57-ZC
as presented, Commissioner Bright seconded the motion.
The vote was as follows:

Commissioner Owens stated he was in favor of the zoning change because it sets higher
standards for everyone.
Commissioner Shuler stated the property at the corner of Huffman and Vine Street was
outside the 200' notification range. Ms. Shuler stated the City should look at this property
at a future meeting.
Commissioner McMillon stated he was in favor of the zoning change.
Commissioner Bright also stated she was in favor of the zoning change.
Commissioner Egger stated he was in favor for the reasons stated in the first case.
Commissioner Zahn stated he supported the recommendation by staff and asked staff to
research the property mentioned by Commissioner Shuler and bring it back to the Board.
Bo Bass suggested placing this item on the April or May agenda for further review.
Commissioner McMillon made the motion to recommend approval of zoning case
#97-74-ZC as presented. Commissioner Zahn seconded the motion.

Bo Bass, Director of Planning and Development described the property for this item as;
Ector Arms Addition, Lot A; Sheppard Addition, Block A, Lots, 22, 23, 21R, 20R, 19, 18,
17, 16, 15, 14, 13, 12, 11, 10, 9, 8, 7, 6; Tucker Addition, Block 1, Lot 1 R. He stated the
property includes City Hall, houses along Sheppard Dr., and the Manchester Apartments.
Bo Bass stated the apartments are currently zoned properly, however, for future purposes
a C-2 zoning is more compatible for the area and was recommended for approval.
Bo Bass stated a letter of protest was received from Owens, Clary & Aiken law firm
representing Corrigan Investments, Inc. regarding their property effected by this zoning.
Bo Bass stated due to the letter, law mandates a 3f4 vote by the Commission to pass this
request.
Chairman Young opened the Public Hearing.
Mr. Neil Adams, Attorney, 1903 Central Dr., Bedford, Tx. represented Corrigan
Investments, Inc. Mr. Adams stated that several tracts were involved including the
Manchester Apartments and property to the east of the apartments, Lots 6, 7, 9, 11, 12,
13, 14, 15, 16, 17, 19 and 20. Mr. Adams stated the Corrigan family had owned this
property for approximately 50 years and had been a good neighbor to the City. He stated
in 1994. the Corrigan's invested 2.5 million dollars in upgrading this property.
Mr. Adams stated his client believed that rezoning his property would cause major legal
ramifications. He stated it would cause difficulty with potential buyers or with financing.
Mr. Adams also stated the notice to property owners did not reflect current tax roll
addresses and was defective. Mr. Adams then asked the Commission not to take action
on this item or to table the case until the notification had been properly resolved.

Commissioner Zahn stated he was in favor of the recommendation as presented. He then
asked the staff to research the possible notification problem.
Commissioner Eggers stated he was in favor of the zoning change. He stated the property
owners address list reflected several Corrigan properties with the correct addresses.
Commissioner Bright stated she was in favor of the zoning change.
Commissioner McMillion stated he was also in favor and felt they should go forward with
the request. He also reminded the audience that the Commission is a recommending body
only and that the City Council will have the final approval.
Commissioner Shuler stated concerns that the property would become run down if
rezoning would cause a hardship for Corrigan, but hoped that wouldn't happen.
Commissioner Shuler stated she was in favor of the rezoning.
Commissioner Owens stated that the apartments had been a good neighbor and hoped
that would continue. He commented he did not see the legal problem and felt they should
go forward with this item. Commissioner Owens stated he was in favor of the zoning
change.
Chairman Young also agreed there was no reason to delay this item. He then commented
that there would be a three week period between meetings which would give staff time to
resolve any notification problems,
Commissioner Zahn made the motion to recommend approval of zoning case #97-70-ZC
as presented. Commissioner Eggers seconded the motion.

Mr. Roper, 202 W. Fuller, Euless, Tx. stated concerns that he would have to move when
the zoning changed to commercial. He also asked if there would be a problem making
improvements to his home.
Bo Bass, Director of Planning and Development assured Mr. Roper that as long as the
house remained residential the use would stay the same. Bo Bass informed Mr. Raper if
he planned to add on to the house he would need to apply for a permit, meet the building
standards and get approval from Code Enforcement.
John Clinton, 200 Arbor Glen stated concerns that his neighbors could start a commercial
business. Bo Bass agreed that it could be a possibility, however, they would have to meet
commercial standards.
James Ekas, 110 S. Main stated he owned an auto repair shop and wanted to know what
type of changes would be required. Bo Bass informed Mr. Ekas that since his business
was grandfathered he would need to adhere only to the existing standards unless his use
altered.

zoned PD (Planned Development) had been custom designed for professional offices, He
stated staff was recommending the property be zoned to R-1 which would bring this
property into conformance with the land use plan.

Debbie Cole, 143 Arbor Glen asked what type of new business will be moving in. Bo Bass
stated an accounting firm which was consistent with the present use.
John Clinton, 200 Arbor Glen asked why the charge.
Chairman Young stated the City would like to bring this property into conformance with the
Comprehensive Land Development Plan to make it more compatible.
