Five members of the Planning and Zoning Commission were in attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS -COUNCIL CHAMBERS. Chairman Ronald Young called the Planning and Zoning Commission meeting to order at 7:00 p.m, for the consideration of scheduled items. He stated there were five members of the Planning and Zoning Commission present. APPROVAL OF MINUTES Commissioner Zahn made the motion to approve the minutes for the December 16, 1997. Planning and Zoning meeting as presented. The motion was seconded by Commissioner Eggers. The vote was as follows: Ayes: Commissioners Zahn, Eggers, Shuler, Owens, Young Nays, None Absent: Commissioners Bright, McMillion The motion carried. Chairman Young informed the audience that nine public hearings were scheduled and explained the public hearing procedures. Chairman Young stated the Planning and Zoning Commission and City Staff had been reviewing the land uses for the City of Euless and the City had initiated the zoning change requests. REGULAR AGENDA ITEM 1 PUBLIC HEARING W ZONING CHANGE - #9$-01-ZC - C-2 - COMMUNITY BUSINESS DISTRICT Harwood Plaza Addition, Block 1 , Lot 4 R2 Kevin Mercer, Development Services Manager, described the property for this item as; Harwood Plaza Addition, Block 1, Lot 4R2. Kevin Mercer stated the property was currently zoned Planned Development "PD" and Community Business District "C-2' with retail/warehousing and outdoor storage uses. The proposed zoning would be Community Business District "C-2". He stated the Development Review Committee recommended approval Chairman Young opened the Public Hearing. There being no proponents/opponents Chairman Young closed the Public Hearing. ITEM 2 RECOMMENDATION OF - ZONING CHANGE #99-01-ZC - C-2 COMMUNITY BUSINESS DISTRICT Harwood Plaza Addition, Block 1, Lot 4R2 Commissioner Zahn made the motion to recommend approval of zoning case #98-91- ZC as presented. None Absent: Commissioners Bright, McMillion The motion carried, ITEM 3 PUBLIC HEARING a ZONING CHANGE - #98-02-ZC C-2 COMMUNITY BUSINESS DISTRICT Midway Parr Addition, Block 18, Lots 1-9 Kevin Mercer, Development Services Manager, described the property for this item as; Midway Park Addition, Block 18, Lots 1-9. Kevin Mercer stated the property was currently zoned Single Fancily Detached Residential District "R-1" and the proposed zoning would be Community Business District "C-2". The Development Review Committee recommended approval. Chairman Young opened the Public Hearing. Barbara Lucas, 1015 Collin Dr., spoke in opposition to the request, Ms. Lucas stated she had been a resident of Euless for forty years and did not want to move. She stated many retired people live in the neighborhood and can not afford to move or make payments on new homes. Ima Ruth Jacoby, 1009 Collin Dr., spoke in opposition to the request. Ms. Jacoby stated she was very attached to the area and did not want to relocate. She asked the Planning and Zoning Commission to reconsider this proposal. Cheryl Armon, 1010 Collin Dr., spoke in opposition to the request. Ms. Armon was concerned how the proposal would effect her taxes and future. Ricky DeChiar, 1011 Collin Dr., spoke in opposition to the request. Mr. DeChiar stated he looked at several surrounding cities before settling with his family in the City of Euless. He stated that he was very upset with the zoning change proposal and requested the Commission look at other options. Thomas Prezeszac, 1014 Collin Dr., spoke in apposition to the request. Mr. Prezeszac stated he had invested time and money on property improvements and was not in favor of this change. Allen Morse, 104 Falls Dr., spoke in opposition to the request. He stated his home was almost paid off and if the property was rezoned no one would be interested in buying it. PLANNING AND ZONING COMMISSION PAGE 4 MINUTES OF JANUARY 6, 1998 Dee Qualls, 113 Falls Dr., spoke in opposition to the request. Mr. Qualls stated he had lived in Euless since 1958 and was concerned that a beer joint or cat house would end up in this area if the zoning was to changed. Chairman Young closed the Public Hearing. Kevin Mercer, Development Service Manager addressed the residents concerns and explained how the zoning changes would effect the existing zoning uses, ITEM 4 RECOMMENDATION OF - ZONING CHANGE #98-02-ZC - C-2 COMMUNITY BUSINESS DISTRICT Midway Park Addition, Block 18, Lots 1-9 There was discussion among the Commissioners. They each agreed with the property owner's and felt the zoning change was not appropriate at this time. Commissioner Owens made the motion to recommend denial of zoning case #98-029 ZC. Commissioner Zahn seconded the motion. The vote was as follows: Ayes: Commissioners Zahn, Eggers, Shuler, Owens, Young Nays: None Absent: Commissioners Bright. McMillian The motion carried. ITEM 5 PUBLIC HEARING - ZONING CHANGE - ##98-03-ZC - C-1 - NEIGHBORHOOD BUSINESS DISTRICT Solomon Huitt Survey, Abstract 705, Tracts 6C1 and 6C2 Kevin Mercer, Development Services Manager, described the property for this item as; Solomon Huitt Survey, Abstract 705, Tracts 601 and 6C2. Kevin Mercer stated the property was currently zoned Planned Development "PD" and Single Family Detached Residential District "R-1': with reduced lot size and Limited Industrial District "L-In for mini-warehouses. The proposed zoning would be Neighborhood Business District "C- V. The Development Review Committee recommended approval. Chairman Young opened the Public Hearing, Marty Huffman of Bear Creek stated his property backs up to the affected property and was concerned with the plan for the area in the future. Kevin Mercer stated a developer had inquired about the property, however; no formal submittal had been received. Kevin Mercer stated the property was currently zoned Neighborhood Business District "C-1" and the proposed zoning would be Single Family Detached Residential District "R-1". The Development Review Committee recommended approval. Chairman Young opened the Public Hearing. Bob Tralaim, 1313 Roundtree, stated he received a letter and did not understand what was being proposed. Chairman Young stated no developments had been proposed only a zoning change. ITEM 9 PUBLIC HEARING - ZONING CHANGE - #98-05-ZC - Ra5 Q MULTI- FAMILY DISTRICT 24 UNITSIACRE Ray Shelton Subdivision, Lot 9A Kevin Mercer, Development Services Manager, described the property for this item as; Ray Shelton Subdivision, Lot 9A. Kevin Mercer stated the property was currently zoned Single Family Detached residential District "R-1" and the proposed zoning would be Multi-Family Residential District "R-5". The Development review Committee recommended approval, Mr. Mercer stated a written protest was received which will require a 3/4 vote for approval of this case. Chairman Young opened the Public Hearing, Fancy Elliott, 304 E. Ash Ln, spoke in opposition of the request. Ms. Elliott stated her family had lived in Euless over 18 years and planned to expand, Ms. Elliott stated she took great pride in their homestead and did not want to see it change. Jack Emmons, 400 E. Ash Ln, spoke in opposition of the request. Mr. Emmons stated he did not want apartments to be built in the area and was against the proposal. Chairman Young closed the Public Hearing, ITEM 10 RECOMMENDATION OF - ZONING CHANGE #98-05-ZC - R-5 - MULTI- FAMILY DISTRICT 24 UNITS/ACRE Ray Shelton Subdivision, Lot 9A Commissioner Shuler made the motion to recommend denial of zoning case #98-05- W. Commissioner Owens seconded the motion. The vote was as follows: Ayes: Commissioners Cahn, Eggers, Shuler, Owens, Young Nays: None Absent: Commissioners Bright, McMiilion The motion carried. Kevin Mercer stated the property was currently zoned Planned Development "PD" and Multiple-Family High Density Dwelling District "R-5" with variable densities for townhouses. Kevin Mercer stated the property was currently zoned Multi-Family Residential District "R-3' and the proposed zoning would be Single Family Detached Residential District "R-l". ITEM 17 PUBLIC HEARING a ZONING CHANGE - #9$-99-ZC - R-1 - SINGLE FAMILY DWELLING DISTRICT Bear Creek Villas I Addition, Block A, Lot 1; Woodcreek Addition, Bloch G, Lot 1 Kevin Mercer, Development Services Manager, described the property for this item as, Bear Creek Villas I Addition, Block A; Lot 1; Woodcreek Addition, Block G, Lot 1, Kevin Mercer stated the property was currently zoned Community Unit Development "CUD", Single-Family Attached Dwelling "R 1A" & Multi-Family 24+ UfAc. and Multiple-Family Low Density Dwelling "R-4". The proposed zoning would be Single Family Detached Residential District "R-1". The Development Review Committee recommended approval. Chairman Young opened the Public Hearing. Art Anderson, Winstead, Sechrest & Minich Attorneys, 5400 Renaissance Tower, Dallas, Tx., represented the owner of Tract 2 and stated they were opposed to the proposal. Mr. Anderson presented a hand--out to the Commission describing their opposition. Mr. Anderson stated the land uses surrounding the subject property involve almost exclusively multi-family development. He stated the single family detached residential zoning between the land zoned for apartment uses was not legally appropriate for this tract. Mr. Anderson stated the proposed action would be spot zoning and would economically devastate the landowner who bought this property in reliance upon the CUD zoning. Chairman Young closed the Public Hearing. ITEM! 18 RECOMMENDATION OF - ZONING CHANGE #98-139-ZC - Rb1 SINGLE FAMILY DWELLING DISTRICT Bear Creek Villas I Addition,. Block A, Lot 1; Woodcreek Addition, Block G, Lot 1 Commissioner ,Zahn stated he disagreed with the concept of the property being surrounded by multi-family and would like to go forward with the zoning change. Commissioner Eggers asked Mr. Anderson if they had development plans. Mr. Anderson stated not at this time. Commissioner Egger stated he was in favor of the recommendation and would like to move forward with the proposal. Commissioner Shuler agreed. PLANNING AND ZONING COMMISSION 'AGE 0 NAIN!TES OF JANUARY 6. 1998 Commissioner Owens stated Mr. Anderson had valid points and he would like the spot zoning issue be further investigated by the City Attorney, Commissioner Zahn recommended the City Attorney review the case hand-out prior to City Council. Commissioner Zahn made the motion to recommend approval of zoning case # 98-09- ZC and requested the City Attorney review the case hand-out prior to City Council. Commissioner Eggers seconded the motion. The vote was as follows: Ayes: Commissioners ,Zahn, Eggers, Shuler, Owens, Young Nays: None Absent: Commissioners Bright, McMillion The motion carried. ITEM 19. RECOMMENDATION TO ADOPT HIGHWAY 121 COMMERCIAL CORRIDOR DISTRICT PLAN Consider the request of the City of Euless to adopt Highway 121 Commercial Corridor District Plan Kevin Mercer, Development Services Manager, stated this item was in consideration of the Highway 121 Commercial Corridor District Plan and did not include the district standards. Mr. Mercer stated the District Standards and {ordinance would be considered by the Planning and Zoning Commission on February 17, 1998 and then to City Council for final approval on March 12, 1998, Mr. Mercer stated the Planning and Zoning Commission would be recommending the approval and establishing the 121 district limits between the three different Zones "A" "B" and "C". Chairman Young stated this item was not a Public Hearing, however, many of the citizens had signed up to speak on this item and the Commission would receive citizen input. Mr. Wiley Hokett , P.D. Box 81, Petty, Tx,, property owner, requested this item be tabled because none of the owners were notified of the meeting. Mr. Wiley Hokett informed the Commissioners that Bo Bass, Planning and Development Director, told him when and if this item ever came rap that he would be one of the first to know. Chairman Young stated since this item was not a Public Hearing notification to properly owners was not required. Kevin Mercer, Development Services Manager stated when the Ordinance was considered, the Public Hearing would require the property owners to be notified. PLANNING AND ZONING COMMISSION PAGE-: i 1 MINUTES OF JANUARY 8. 1998 Mr, Wiley Hokett asked if the land owners would be involved in the planning and if so when would they be notified? Kevin Mercer stated he would receive notification for the Public Hearing and at that time could present any concerns he may have. Mr. Mercer also stated the property owners would be supplied with a copy of the proposed ordinance. Kevin Mercer stated Zone "A" limits the height to single story buildings with a maximum height of 35 feet. Zone "B' allows for higher buildings. A representative for Zola Wilkins of 915 Glade Road spoke in opposition of the proposal. He stated that Mr. Wilkins wanted to build a mid rise hotel on the south side of Glade and the height restrictions being proposed would Create problems for them. Lois Srianekkul, 3005 Hwy 121, spoke in opposition to the proposal. Ms. Srianekkul stated she didn't understand why there would be a problem with two story buildings along Hwy. 121. She stated she Haight sell her property to someone that would like to build a hotel or office building and a single story building would not be sufficient. Kevin Mercer stated the intent of Zane "A" was to create a retail district with primarily single story buildings with a maximum height of 35' which would allow the development within Zone "B" to have visibility to Highway 121. He said this would allow both properties in each zone to be highly developed. Commissioner Edgers stated he had some of the same concerns as Lois Srianekkul with limiting ,done "A" to strictly single story buildings. However, he also understood the City's proposal of not wanting high rise buildings lining Highway 121. Commissioner Eggers stated he thought the City and the land owners could find a compromise regarding the height regulations. Mr. Art Anderson, Winstead, Sechrest and Minick, Attorneys at Law, 5400 Renaissance Tower, Dallas, Tx., represented three partnerships which owns affected property. Mr. Anderson stated he had a copy of the Highway 121 Corridor District Plan and considered, it to be a Comprehensive plan amendment. He stated the plan would cause his clients property to be undeveloped and asked that it be postponed. He stated he wanted to go over the plan "word-for-ward" during this meeting if any action was going to be considered. Commissioner Zahn stated he didn't want to table the item but wanted to send it back to the City Staff and have them get with the property owners and bring the plan back after they met. Commissioner Zahn stated he had the same concerns as Mr. Anderson and felt he hadn't had the opportunity for a great deal of input. He said he thought they were recommending approval on a concept plan, however, after reading the plan found it involved the adoption of an amendment. Commissioner Zahn then stated he was unclear of what was being requested to send forward to City Council. Commissioner Zahn stated he felt uncomfortable making any decisions at this time and wanted to know wheat reasoning was used to determined the type of screening selected for the PLANNING AND ZONIN�.7 COMMISSION PAGE 12 MINUTES OF JANUARY 6, 1998 east side of Highway 121. He felt a meeting should be held between the Planning and Zoning Commission, City Council, City Staff , the Plan Consultant and the Property Owners before considering the adoption of this plan. Commissioner Eggers stated he had the same concerns and believed they were endorsing a concept plan without the permitted uses. Commissioner Shuler stated she also was confused about what they were recommending. Chairman Young agreed we should refer this back to staff and get with the property owners. Commissioner Zahn made the motion to send the Highway 121 Corridor district Plan back to the City Staff for further review and provide the information to the property owners and seek their input and bring the input back to the Commission. Commissioner Zahn withdrew his motion. Commissioner Owens made the motion to refer the Highway 121 Corridor District Plan back to the City Staff and to get with the property owners and bring it back to the Commission in 4 weeks or whenever deemed appropriate. Commissioner Zahn seconded the motion with an amendment to define the representations for each zone, and make a part of the motion to contact all property owners for input. The vote was as follows: Ayes: Commissioners Owens, Zahn, Shuler, Eggers, Young Nays: None Absent: Commissioners Bright, McMillion Commissioner Owens stated he wanted the minutes to reflect that the Commissioners were not criticizing what the staff had proposed but only questioning the contents and timing of the proposed document.
