PLANNING AND ZONING COMMISSION MAY 5, 1998 MINUTES The Pre-Commission meeting of the Planning and Zoning Commission was called to order by Chairman Ronald Young at 5:30 p.m. in the Building "C" Conference Room. Four members of the Planning and Zoning Commission were in attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS. Chairman Young called the Planning and Zoning Commission meeting to order at 7:95 p.m. for the consideration of scheduled items. He stated there were four members of the Planning and Zoning Commission present. Commissioners George Zahn, Keith Eggers and Robert MCMillon were absent. APPROVAL OF MINUTES Commissioner Shuler moved to approve the minutes of the Planning and Zoning meeting for April 21, 1998, as presented. Commissioner Bright seconded the motion. Commissioners Zahn, Eggers and McMillon The motion carried unanimously. Chairman Young explained Public Hearing procedures. REGULAR AGENDA ITEM 1 PUBLIC HEARING — ZONING CHANGE - #97-47-ZC R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Bell Ranch Terrace Addition, Block 3, Lots 1-8, 9R; Block 4, Lots IR1, 5- 11, 13; Block. 5, Lots 1-26; Block 6, Lots 1-26; Block 7, Lots 6, 7, 12, 13, 18-24; Block 12, Lots 1, 8-19; Block 13, Lots 1-18; Block 14, Lots 1-15, Block 15, Lots 8 and 9; J.S. Anderson Subdivision, Block 13, Lots 2481, 24132, 2483, 24134, 2485, Bo Bass, Planning and Development Director, gave a brief overview of the proposed zoning change. He stated that the Council had previously tabled this case and requested that it be re-advertised and started again from the beginning. Someone in the audience asked why were they there. Mr. Bass answered that the City Council relies on the interest of citizens. He also stated that there are certain procedures Planning and Zoning Commission had to abide by. He stated that the Development Review Committee (DRC) still recommended approval. Chairman Young opened the Public Hearing. Barbara Polk, 716 Koen Lane, stated that she had owned 3 lots since 1973-1974. Ms. Polk asked why the lots were in a CUD, and said she did not understand the Commission's thinking on this new zoning change. She stated she was in favor of rezoning to R-1. Diane Sebastian, 411 Nita Lane stated she was in favor of Single Family zoning. Marlene Mann, 2229 Queen, Fort Worth, stated that she owned a lot in that area. Ms. Mann wanted the record to show she would not be in favor of R-1. Mr. Bass pointed out to Nis. Mann that there was no recommendation for rezoning her lot. PLANN PSG AND ZONING Ci3'tWISSiON PAGE 3 MIN-UTES OF MkY 5,1%98 Philip Leighton, 598 Raven Ct. Bedford, stated his wife owned Lot 1 Block 5. He stated he supported R-1 zoning. Ms. Poly said R-2 would work well as a buffer on perimeter lots, she retracted what she had said previously. Mr. Bass explained the City did not create PCB or CUD's; the landowners did. Mr. Bass stated 2 years ago the City Council decided to "change the face of Euless" by changing the Comprehensive Land Use Plan, which shows this area as residential. The Plan was completed over the course of a year, during which over 12,666 property owners were seat letters. Darlene Mann asked why the City initiated this rezoning, and if it was approved, how did they know it would not be commercial in the future. Commissioner Shuler stated owners would have to come before the Planning and Zoning Commission and get a zoning change. Chairman Young closed the Public Hearing. ITEM 2 RECOMMENDATION OF ZONING CHANGE ##97-47-ZC — RI (SINGLE FAMILY DETACHED DWELLING DISTRICT) Bell Ranch Terrace Addition, Block 3, Lots 1-8, 9R; Block 4, Lots 1R1, 5- 11, 13: Block 5, Lots 1-26; Block 6, Lots 1-26; Block 7, Lots 6, 7, 12, 13, 18-24: Block 12, Lots 1, 8-10; Block 13, Lots 1-18; Block 14, Lots 1-15, Block 15, Lots 8 and 9; J.S. Anderson Subdivision, Block 13, Lots 24R1, 2482, 24R3, 24R4, 2485 Commissioner Owens agreed that R-1 would be the Kest zoning. He stated for purposes of clarification that Lot 12, Block 4, was clear this lot was not in this case. Commissioner Shuler stated that she was in favor of R-1, and that it was the highest and best use, and if someone carne in with a plan for C-2, the Planning and Zoning Commission would consider it at that time. Commissioner Bright stated R-1 would be the best zoning change for the City. Chairman Young stated he thought it was not necessary to have R-1 development there, but that this zoning change would give Council the control needed to encourage consolidation of ownership for a development. He also stated that he shared the Staff's concern that individual lots could be developed now by right with uses that would discourage any other development. Commissioner Bright seconded the motion. The vote was as follows: Ayes: Commissioners Young, Bright, Shuler, Owens Nays: None Absent: Commissioners Zahn, Eggers and McMillon. The motion carried unanimously. ITEM 3 PUBLIC HEARING -- ZONING CHANGE d #97-69-ZC R1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Alexander and Cullum Subdivision, Lots 17, 18, NEPT 23, NW'PT 23, SEPT 23, SWPT 23, 24, 25, A; Alexander-Cullum Addition, Block A, Lot 24R; A.J. Huitt Survey, Abstract 709, Tract 3R Bo Bass, Planning and Development Director, gave a brief description of the proposed zoning change and stated that the DRC recommended approval. Chairman young opened the Public Hearing, Ms. Polk asked if a creek originated north of Hwy. 10 and if it would cause flooding problems. Bo Bass answered that a creek flowed under Hwy. 10, but that the water flow was fairly limited. He stated that single family development has lower runoff than almost any other use, and if the concern was drainage R--1 single family was the most appropriate use. Chairman Young closed the Public Hearing. ITEM 4 RECOMMENDATION OF — ZONING CHANGE ##97-69-ZC — R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Alexander and Cullum Subdivision, Lots 17, 13, NEPT 23, NWPT 23, SEPT 23, SWPT 23, 24, 25, A; Alexander-Cullum Addition, Block A, Lot 24R; A.J. Huitt Survey, Abstract 709, Tract 3R Commissioner Owens stated that he believed it should be R-1. Commissioner Shuler stated her preference for the zoning would be R-1 instead of R-4. PLANNING AND ZONING C"MNII:!SSION PAGE 5 MINUTES OF MAY 5, 1998 Commissioner Bright stated she was in favor of the zoning change. Mr. Bass stated there was a letter of protest requesting the tabling of this case. He stated that staff did not support tabling it. Chairman Young stated the area looped lovely with trees and it would develop quite nicely as single family residential. He stated he supported the change. Commissioner Owens stated he was not in favor of tabling. Commissioner Owens made the motion to recommend approval of Zoning Change #97- 69-ZC as presented, making Exhibit B part of the motion. Commissioner Shuler seconded the motion. The vote was as follows: Ayes: Commissioners, Young, Bright, Shuler, Owens Nays: None Absent: Commissioners Zahn, Eggers, McMillon The motion carried unanimously. ITEM 5 PUBLIC HEARING —ZONING CHANGE -#98-20-ZC — C-2 (COMMUNITY BUSINESS DISTRICT) Samuel Tucker Survey, Abstract 1512, Tract 3A Bo Bass, Planning and Development Director, gave a brief description of the case and stated that it had been previously denied due to a mapping error. He stated that DRC recommended approval. Chairman Young opened the Public Hearing, Joyce Bates, 515 Bayberry Lane, Euless, stated they would move if a business was put ire. She stated that she believed if the area was changed to C-2, the City of Euless would be asking for a disaster. She stated she was totally against the rezoning. Ms. Bates then asked the Zoning Commission why the property was being considered for rezoning now. Bo Bass explained that he had recommended denial of the original case because the map exhibit showed the incorrect zoning. He stated staff recommended approval of the current case. PLANNING AND ZONING COMMISSION PAGE C MINUTES OF MAY 5,1 Lugene Bates, 515 Bayberry Lane, Euless, stated he had enjoyed living there at the northwest corner of Fuller Weiser and Bayberry. He stated the change from residential to commercial was an incorrect proposal, and that it should remain R-1. He said that his property line was 63 feet from the proposed zoning change, and that he believed the corner was owned by the State. Mr. Bass stated the City's records did not indicate that the State owned the corner. Ms. Polk asked Mr. Bass how many acres were in the area. Chairman Young stated he did not think it would make a difference how large the area was. Ms. Polk then said it was large enough for zero lot line, or R-2 duplex development. Chairman Young closed the Public Hearing. He stated he had lived in the City of Euless 25 years and that he cares about the city. He then stated this rezoning had been debated for about 2 years, and people had been invited to talk about it during that time. He said the City had no ulterior motives in making this recommendation for a zoning change. ITEM 6 RECOMMENDATION OF ZONING CHANGE #98-20-ZC — C-2 (COMMUNITY BUSINESS DISTRICT) Samuel Tucker Survey, Abstract 1512, Tract 3A Commissioner Bright stated she had lived in Euless 23 years and thought this change was the highest and best use since the land is right next to 360. She stated that the City would be wrong to allow single family on the east side of Fuller Wiser because of airport issues. Bo Bass, Planning and Development Director, reminded everyone this property was currently zoned R-1 single family, and that City Council, because of the proposed new west runway, had prohibited new single family development east of Fuller Miser Road. He stated it did not make sense for the City to have land zoned single family when no one would be allowed to build it. He also stated that probably that section of Fuller Miser Road would never be improved until that tract and the tract south of it developed, at which time a four lane divided road with a landscaped median could be created. He suggested to the audience that they keep in contact with Staff and especially when they saw orange surveyors' flags to call Staff to find out what development was occurring. Commissioner Shuler said it would have been ideal to have that tract developed into homes, but she did not think it could happen now. She stated she thought Council had decided not to allow single family for the protection of the citizens who would not realize what they were getting into by building homes there. She said that with 360 there this lot would most likely be commercial, and she thought it was the best and only use for this land. PLANNONG AND ZONING CCh':WSSION PAGE 7 M�"d ;TE OF MAY 5,1948 Commissioner Owens stated he was in favor of the Zoning change because it was not a good idea to have children near Highway 360. Commissioner Bright moved to recommend approval of,Zoning Change#98-20-ZC to C-2 for Samuel Tucker Survey, Abstract 1512, Tract 3A. Commissioner Shuler seconded the motion. The vote was as follows; Ayes: Commissioners Shuler, Bright, Young Nays: None Abstention: Commissioner Owens Absent: Commissioners Zahn, Eggers, McMillon The motion carried. ITEM 7 PUBLIC HEARING —AMENDMENT TO UNIFIED DEVELOPMENT CODE #98-04-UDC Public input regarding amendment of Chapter 84 "Unified Development Code" of the Code of Ordinances Article V "Ofd Street Parking, Loading, and Driveway Standards" by the addition of Section 84-241 (i) "Lighting" Bo Bass, Planning and Development Director, introduced an amendment to the Unified Development Code, Chapter 84 of the Cade of Ordinances. He explained that the City of Euless did not currently have any standards to control lighting on new developments, He stated that DISC recommended approval. Carol Griffith, City Planner, gave a brief description of the ordinance and its possible effect on new and existing developments. Chairman Young opened the Public Hearing. There being no speakers, he closed the Public Hearing. ITEM 8 RECOMMENDATION OF - AMENDMENT TO UNIFIED DEVELOPMENT CODE - #98-04-UDC Consider amendment of Chapter 84 "Unified Development Code" of the Code of Ordinances Article V `Off-Street Parking, Loading, and Driveway Standards" by the addition of Section 84-201 (i) "Lighting„ PLANNING AND ZONING'COMMISSION- PAGE 8 MIN-I TES of MAY 5,1998 Commissioner Owens stated that he was in favor of the proposed amendment because of the safety of citizens and the idea that it would help showcase places in Euless. Commissioner Shuler stated she was a proponent of more lighting through this addition to City rules. She asked if required lighting for church parking lots could be moved to the medium level requirement instead of the low level. Ms. Griffith stated that Staff had considered this, but decided that since the Illuminating Engineering Society of North America placed churches in the lower category, our ordinance should also. Commissioner Bright stated this amendment was a wonderful addition to the UDC and thanked the City Planner for her hard work. Chairman Young stated he was in favor of the amendment because it gage the Council another level of control to create quality development in the city. Commissioner Shuler moved to recommend approval of case #9$-04-UDC, Ordinance #1326, an amendment to the Unified Development Code. Commissioner Bright seconded the motion. The vote was as follows: Ayes: Commissioners Young, Shuler, Bright, Owens Nays: none Absent: Commissioners Zahn, Eggers, McMillon The motion carried unanimously.
