PLANNING AND ZONING COMMISSION JUNE 2, 1998 MINUTES The Pre-Commission meeting of the Planning and Zoning Commission was called to order by Chairman Ronald Young at 5:34 p.m. in the Building "C" Conference Room. Seven members of the Planning and Zoning Commission were in attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS. Chairman Young called the Planning and Zoning Commission meeting to order at 7:00 p.m, for the consideration of scheduled items. He stated there were seven members of the Planning and Zoning Commission present. APPROVAL OF MINUTES Commissioner Owens stated he wanted the minutes to be revised concerning his comment regarding the recommendation for case #PZ-98-01. He stated he wanted the motion to say it was from the Planning and Zoning Commission NOT from the city staff, and make sure it was clear the Commissioners were not backing what Staff had recommended in pre-session. PANNING&ZONING COMMISSION PAGE 2 MINUTES OF JUNE 2, 1%8 Commissioner Eggers moved to approve the minutes of the Planning and Zoning Commission meeting for May 19, 1998, with the correction to page 10 according to Commissioner Owens statement. Margaret Ballew, P.O.Box 592; Coppell, stated she wants to open a resale shop not only to make a living, but to help less fortunate people. Chairman Young closed the Public Hearing, ITEM 2 RECOMMENDATION - SPECIFIC USE PERMIT - #98-28-SUP — 207 MARTHA STREET Consider a recommendation for the request of Margaret Ballew for a Specific Use Permit to allow a resale shop in the TX-10 (Texas Highway Ten Multi-Use) zoning district located in the A.J. Huitt Survey, Abstract #684, Tract 1 H2, at 207 Martha Street The Commissioners asked Ms. Ballew if this was her first time in business, what range of clothes she would have, and if the clothes would be on consignment. They also asked if she would have large appliances in the store and outside storage. PLANNING&ZONING GOMPMISSV4 PAGE 3 MINUTES OF JUNE 2. 1998 Ms. Ballew answered she wanted her shop to be everybody's store but tasteful, with women, men and children's clothes, miscellaneous items, and even men's tools. She also stated she would purchase the clothes, and that she was not going to have large appliances or outside storage. She stated she had been in retail 18 years. Commissioner Eggers made the motion to recommend approval of case #98-28-SDP with the stipulation that it would be for Ms. Ballew only. Commissioner Shuler seconded the motion. The vote was as follows: Ayes: Commissioners Bright, Eggers, McMillon, Owens, Shuler, Young, Zahn Nays: None Absent: None The motion carried unanimously. After the motion carried, Commissioner Owens asked Staff to review the pawn shop ordinance with the applicant. ITEM 3 PUBLIC HEARING -- PLANNED DEVELOPMENT _ #98-01-PD - 1600 BLOCK OF WEST AIRPORT FREEWAY Public input regarding the request of Al Patel for a change of zoning from PD #10352 (Planned Development for Golf Driving Range and Restaurant) and C-1 (Neighborhood Business District) into a Planned Development with C-2 (Community Business District) standards and uses, allowing private drives by right, within the Terrell Jasper Survey, Abstract #861, Tracts 5A, 5A2 and 5A3 Kevin Mercer, Development Services Manager, gave a brief description of the proposed Planned Development. Chairman Young gave an explanation of Public Hearing procedures and then opened the Public Hearing. Brian Klein, 1361 W. Euless Boulevard. Suite 111, passed out copies of the Land plan that was approved by the Commission on May 19, 1998. He stated that the zoning change of this property of 21.4 acres was possible because it has a single owner; and also because substantial drainage improvements would be made which would cause flooding conditions to improve. Mr. Klein .stated that the reason for PD-C2, is that it allows development to occur as a Single Unified Development. He stated Mr. Al Patel (owner) would create a large drainage detention pond and park improvements on the south end of the property as part of the package. PLANNING&ZONING COMMISSION PAGE 4 MINUTES OF JUNE 2. 1998 Al Patel, 3840 Bellaire Circle, Fort Worth; stated he was not interested in a drive-in restaurant or a service center, but instead he wants something classy. He also stated he would put in an 8 foot concrete fence all around the entire perimeter. He explained he was looking into the feasibility of a senior citizen place, and a small medical office building with a cafeteria on the property. He stated removing trees was necessary because of drainage problems, but that he was planning to replace as many trees as possible. He stated that 60% of the property used to be in the flood zone. Commissioner Owens asked Mr. Patel what kind of fence was going to be between the apartments. Mr. Patel answered there would be a masonry fence between the apartments and a gabion retaining wall around the pond. A citizen in the audience asked Mr. Patel if the wall was going to come all the way to the utility lines. Mr. Patel answered the wall would be inside his property; about 3-5 feet away from the easement. Mr, Patel introduced an Extended Stay America Representative, Steve Heffley. Chairman Young requested that Mr. Heffley just speak in general about the proposed Planned Development. Mr. Heffley said his company would be planning a hotel for the business traveler. Chairman Young asked Mr. Heffley if he was interested in a portion of this property and in favor of the zoning. Mr. Heffley answered that he is in favor of the zoning change. Three adjacent residents expressed their opposition to multistory buildings and their concern about the kind of lighting allowed in a C-2 zoning district. Mr. Mercer stated that C-2 zoning limits the height of buildings to a single story building within 100' of single fancily, and it allows offices, hotels and retail sales. He explained that uses that have negative impacts on adjacent properties require an additional Specific Use Permit. Donna Lee, 300 Wilshire Drive, Euless, stated she was in opposition to the C-2 zoning change. ITEM 4 RECOMMENDATION — PLANNED DEVELOPMENT - #98-07-PD - 7600 BLOCK OF WEST AIRPORT FREEWAY Consider a recommendation for the request of Al Patel for a change of zoning from PD #1052 (Planned Development for Golf Driving Range and Restaurant) and C-1 (Neighborhood Business District) into a Planned Development with C-2 (Community Business District) standards and uses, allowing private drives by right, within the Terrell Jasper Survey, Abstract #861, Tracts 5A, 5A2 and 5A3 PLANNING&ZONING COMMISSION PAGE 5 MINUTES OF,TUNE 2, 1998 Commissioners Bright, Eggers, McMillon, Shuler, Owens and Chairman Young stated they are in favor of the zoning change. Commissioner Eggers asked staff if the motel in the top left corner comes in for Specific Use Permit: how will notification be handled. Kevin Mercer answered that the hotel is allowed by right. Commissioner Eggers asked if a use requires a Specific Use Permit, what would the notification area be. Mr. Mercer answered 200 feet within the lot on lot configuration. Commissioner Eggers stated that people opposed to this Planned Development are concerned about multistory buildings, but he thought the requirements of the Unified Development Code (UDC) cover this. Commissioner Owens asked for basic comments from the City Engineer on how the drainage was being accomplished. Paul Kruckemeyer, City Engineer stated staff is very happy with the project. He stated in the past year a major drainage Study was completed, and if the development was allowed, there would be no additional drainage allowed from this property. He stated that the drainage improvements on this property have been substantial. Commissioner Zahn made the motion to recommend approval of case #98-01-PD as presented, Commissioner Bright seconded the motion. Commissioner Zahn made the motion to remove from the table Land Plan #97-28. Commissioner Eggers seconded the motion. ITEM 6 CONSIDER APPROVAL - LAND PLAN a #P-97-28 - 310 N. INDUSTRIAL BOULEVARD Consider the Land Plan submitted by James Riley, representing First Baptist Church, for a church located on 20.58 acres in the J.P. Halford Survey, Abstract #711, Tracts 7A4, 7A5, 7A6, 7A7, 7A9 and 9A Chairman Young requested that the applicant give information for all three cases related to First Baptist Church. Lou Arrieta, 514 Fairway Lakes Drive, Garland, stated they are proposing an addition to the sanctuary of First Baptist Church. Commissioner Bright stated she was concerned with the request for a sidewalk variance with no sidewalks and that she thought sidewalks were needed. Commissioner McMillon stated he felt comfortable with the Land Plan, with sidewalks as required by the UDC. Commissioner Shuler stated she was in favor of the Land Plan but she was concerned about trees being saved. Commissioner Owens stated sidewalks should be in and no variance requested. Chairman Young asked the City Engineer for his comments about access, utilities, fire coverage and drainage. Paul Kruckemeyer stated these items were addressed. He stated they had some concerns .about the drainage but that the project engineer had agreed to make necessary changes to the site plan. He stated they had concerns about a portion of the existing fire lane remaining as it is, but that the Fire and Engineering Departments along with the church's engineer agreed that it will be tested at the time the new fire lanes are installed. At that time it will be determined whether this section of fire lane needs to be replaced. Commissioner Zahn stated Commissioner Owens had implied that the Planning and Zoning Commission could handle the sidewalks at this level without a variance; he asked Commissioner Owens to expand on his statement. PLANNING&ZONING COMMISSION PAGE 7 MINUTES OF JUNE G, 9998 Commissioner Owens stated that staff had done the right thing according to the rules under the UDC. He stated that he would like to see sidewalk variances and masonry variances be approved by the Planning and Zoning Commission and not go to City Council for approval. Commissioner Zahn asked staff if there is an application for a variance already filed on this property to the UDC regarding sidewalks. Mr. Mercer answered yes, and he explained an application for a variance can be made at any time during the process, but the Land Plan specifies that sidewalks should be shown on the Land Plan; however not all of the sidewalks are shown on this Land Plan. Therefore staffs recommendation was that the Commission structure their recommendation to be contingent upon Council approval of the variance, or should Council not approve the variance contingent upon the installation of sidewalks as required by the UDC. The Land Plan tonight does not show sidewalks in accordance with UDC requirements, Commissioner Zahn reiterated his question that if the Planning and Zoning Commission approved this land plan, would it be approved without sidewalks. He stated this Land Plan before them was not what they wanted. Commissioner McMillon asked why the Planning and Zoning Commission couldn't make a recommendation to City Council to approve the Land Plan contingent upon meeting the ordinance requirements for sidewalks. Commissioner Owens stated he had been in City Council meetings where staff was instructed by City Council that the policy of the city is to put sidewalks in new developments. Commissioner Zahn stated his concern was that a Land Plan was in front of the Commission that did not have sidewalks. He moved to recommend approval of Land Plan # P-97-28, contingent on conformance to UDC requirements for sidewalks, Commissioner Shuler seconded the motion. Commissioner Eggers asked the church's representative why didn't they want sidewalks, and the reason for the variance request. Commissioner Zahn asked as a point of order whether Land Plans go before Council. Mr. Mercer answered no. Commissioner Shuler withdrew her second. Commissioner Zahn withdrew the motion. PLANNING&ZONING COMMISSION PAGE 8 MINUTES OF JUNE 2, 3998 Gary Hill, 15038 Shoemaker Drive, Bedford, stated he is the administrator of First Baptist Church. Mr. Hill explained the reasons for requesting the sidewalk variance: 1. S.H. 157 -- This is the primary area they are concerned with. Sidewalks would cause loss of an entire row of parking. There is also a tree line right on the property line which would be lost if a sidewalk is put there. 2. Trojan Trail — Mr. Hill explained he did not see a problem of continuing sidewalks towards the apartments. 3. Airport Freeway — Mr. Hill stated that it is a known fact that the freeway will expand but he did not know whether to the north or south. He stated they were willing to wait and put the sidewalk far enough back. Commissioner Shuler asked where people would walk if no sidewalks were placed along S.H. 157. Mr. Hill answered the Highway Department is going to give First Baptist Church new entrance alignment, which will make it a straight shot across S.H. 157 to West Campus. Chairman Young asked Mr. Kruckemeyer if there would be any open drainage when S.H. 157 is completed. Mr. Kruckemeyer answered no. Commissioner Owens asked if the sidewalk on S.H. 157 could be placed on the west side of the trees. Mr. Kruckemeyer answered absolutely yes, and said that along S.H.. 183 sidewalks would be required to be on public right-of-way. Commissioner Owens asked if there was a way of working out the sidewalks if a whole row of parking would be lost. Mr. Kruckemeyer explained that there would be room for a sidewalk. Commissioner Owens moved to approve Land Plan #P-97-28 with the addition of sidewalks per UDC requirements, to be worked out by City Engineer prior to engineering plans. Commissioner Shuler seconded the motion. The vote was as follows: Ayes: Commissioners Bright, Eggers, McMillon, Owens, Shuler, Young, Zahn Nays: None Absent: None The motion carried unanimously. INDUSTRIAL BOULEVARD Continue the Public Hearing which was opened on March 3, 1998, regarding the request of James Riley, representing First Baptist Church, for a Specific Use Permit to allow a church within the C-2 (Community Business District) zoning district located in the J.P. Halford Survey, Abstract#711, Tracts 7A4, 7A5, 7A6, 7A7, 7A9 and 9A PLANNING&ZONING COMMISSION PAGE 9 MINUTES OF JUNE 2; 1998 Kevin Mercer, Development Services Manager, stated this was a continuation of a Public Hearing opened on March 3, 1998 for the Specific Use Permit #97-78-SUP, and gave a brief description of the case. Chairman Young stated this Public Hearing was opened and tabled. Commissioner Zahn made moved to re-open the Public Hearing. Commissioner Eggers seconded the motion. The vote was as follows: Ayes: Commissioners Bright, Eggers, MCMillon, Owens, Shuler, Young, Zahn Nays: None Absent: None The motion carried unanimously. Chairman Young stated the Public Hearing was re-opened. Halford Survey, Abstract #711, Tracts 7A4, 7A5, 7A6, 7A7, 7A9 and 9A Commissioner Zahn moved to remove from the table Specific Use Permit #97-78-SUP. Commissioner Eggers seconded the motion. Halford Survey, Abstract#711, Tracts 7A4, 7A5, 7A6, 7A7, 7A9 and 9A Commissioner Owens stated the UDC offers a broad range of masonry options, He asked Mr. Arrietta if the panels were concrete. Mr. Arrietta answered that they are concrete panels which are structurally sound. Commissioner Owens asked what the duration of EFTS is. Mr. Arrietta answered that concrete has a life span of approximately 99 years. Commissioner Bright stated she was concerned with what was on top of the concrete for the finish; she asked if it was paint. Mr. Arrietta answered the concrete would be painted, with a smooth texture. Commissioner Bright stated if this exception was allowed, everybody else would do the same thing. Chairman Young apologized for letting the Commissioners get off track during the SUP process, Commissioner Eggers stated that there have been numerous Specific Use Permits brought before the Planning and Zoning Commission from different churches around the City of Euless, and in the past a precedent was set to limit SDP's. He stated he did not think this SUP was one that needed a limit. Chairman Young stated that the last Specific Use Permit the Commissioners reviewed for a free standing church did not have a time limit set. Commissioner Eggers made the motion to recommend approval of #97-78-SUP. Commissioner Bright seconded the motion. Commissioner Owens asked if the Commission decided this material is okay, would a waiver from City Council be needed. Mr. Mercer stated that the UDC requires that City Council approve exceptions to masonry requirements. Abstract #711, Tracts 7A4, 7A5, 7A6, 7A7, 7A9 and 9A Commissioner Zahn asked why a masonry exception is necessary. Mr. Mercer answered all properties within C-2 are required to have 100% masonry which is listed as brick, stone, split face or fluted CMU block or stucco. EIFS (exterior insulation finish system), commonly referred to as "EFTS" is an Elastomeric finish that is 100% acrylic and it does not have any masonry in it, Mr. Mercer stated it has no cement in it. He stated you are basically covering up a tilt wall panel. Tilt wall panels with an exposed aggregate meet the masonry requirement, but when you cover it up with a synthetic material, it no longer is masonry, causing the need for the exception. Commissioner Zahn asked if the requirement is for appearance. Mr. Mercer answered masonry is required because it requires very little maintenance, and therefore it will not deteriorate and depreciate property values. Mr. Hill answered that the purpose was to give the church an "old .Jerusalem" appearance in texture and color scheme. Commissioner Bright asked if there would be a high maintenance cost. Mr. Hill answered not according to the builder. Commissioner Zahn made the motion to recommend approval of #97-77-SP with installation of sidewalks as required by UDC, and contingent upon the Council's approval of a special exception to the masonry requirements. Commissioner Shuler seconded the motion.
