Six ,members of the Planning and Zoning Commission were in attendance. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS COUNCIL CHAMBERS, Chairman Young called the Planning and Zoning Commission meeting to order at 7:00 members of the p.m. for the consideration of scheduled items. He stated there were six k Planning and Zoning Commission present and that Commissioner McMillon was absent and missed. MEMBERS & STAFF PRESENT MEMBERS ABSENT Chairman Ron Young Robert McMillon Nancy Bright Billy Owens Jov Shuler Keith Eggers George Zahn Bo Bass, Director of Planning and Development Paul Kruckerneyer, City Engineer Donald Dacus, Project Engineer Carol Griffith, City Planner Donna Brown, Crffice Technician VISITORS PRESENT Pastor Danny Holifield, Shoppard Drive Baptist Church PLEDGE OF ALLEGIANCE AND INVOCATION: The Pledge of Allegiance was led by Commissioner Zahn and the Invocation was given by Commissioner Bright. APPROVAL OF MINUTES Commissioner Eggers moved to approve the minutes of the Planning and Zoning Commission meeting of August 18, 1998. REGULAR AGENDA ITEM 1 PUBLIC NEARING REPLAT « #98-11-RP — SHEPPARD SUBDIVISION, BLOCK A. LOT 18, 19, 20R, 21R, 22, 23 Public input regarding the request of Sheppard Drive Baptist Church, 219 Sheppard give. for a replat of Sheppard Subdivision, Block A, Lots 18; 19, 20R, 21R, 22, and 28 into Sheppard Subdivision; Block A, Lot tSR. The church is focated in a C-2 (Community Business) zoning district Bo Bass, Director of Planning and Development, gave a brief overview regarding Sheppard Drive Baptist Church. He stated that a replat was required in order to get a perms frr expansion. He also stated that the Development Review Committee (DRC) recommended approval. Chairman Ronald Young asked why was it necessary to have a public hearinig. Carol Griffith, City Planner answered because it had been zoned for single family use within the past 5 years. Chairman Young opened the Public Hearing, Pastor Danny Holifield signified he was in favor of the replat. Chairman Young closed the Public Hearing. ITEM 2 CONSIDERATION — REPLAT - #98-11-RP — SHEPPARD SUBDIVISION, BLOCK A, LOT 18, 19, 20R, 21 R, 22, 23 Consider approval regarding the request of Sheppard Drive Baptist Church, 219 Sheppard Drive, for a replat of Sheppard Subdivision, Block A, Lots !8, 19. 20R, 21R, 22, and 28 into Sheppard Subdivision, Block A, Lot 18R. The church is located in a C-2 (Community Business) zoning district. Bo Bass, Director of Planning and Development described the case: briefly and stated that CRC recommended approval, P;-AJNNNG&z131Ni--N'G COMMISMIN PAGE 3 ',,WJIUTES OF SEPTEMBER 1.19M3 Commissioner Owens stated he wanted the record to show that the Specific Use Permit for the church required fire sprinkling the building as a condition for its approval. Commissioner Shuler made the motion to approve Replat #98-11-RP., Sheppard Subdivision, Block A, Lot 18., 19, 20R: 21R, 22, 23 into Sheppard Subdivision, &oC.R A! Lot 18R. Commissioner Owens seconded the motion. Commissioner Owens stated that he wanted to congratufate the church for not only stepping up to install a sprinkler system, but for going the extra mile throughout the development process. Pastor Holifield stated they might have to make some changes in tefais of phasing, and that they might not be able to do some of the things they wanted to do; however, they were going to proceed with the plan as presented and sp6nkle the building as required. The vote was as follows'. Ayes.- Chairman Young, Com-missioners, Owens, Shuler. Eggers., Bright, Zahn Nays- None Absent-, Commissioner Mcklillon The motion carried. ITEM 3 PUBLIC HEARING - AMENDMENT TO UDC - #98-06-UDC - "OFF STREET PARKING" Public input regarding a request by the City of Euless to amend Chapter. 84 "Unified Development Code" Article V "Off Street Parking, Loading and Driveway Standards," Section 84-201 "Off Street Parking" of the Code of Ordinances of the City of Euless to modify paving standards Bo Bass, Director of Planning and Development gave a brief description of the case. He stated that the DRC recommended approval. Chairman Young opened the Public Hearing. There being no speakers, he closed the Public Hearing, ITEM 4 RECOMMENDATION - AMENDMENT TO UDC - #98-06-UDC - "OFF STREET PARKING" Consider a recommendation for the request by the City of Euless to amend Chapter 84 "Unified Development Code" Article V ;'Off Street Parking" Loading and Driveway Standards," Section 84-201 "Off Street Parking" of the Code of Ordinances of the City of Euless to modify paving standards MINUTES CF SEKENI R 1,1996 Commissioner Zahn stated he would support this amendment as long as it excludes existing R1, R1L, R1G. Commissioner Bhuler asked if 51% of the parking lot had to be redone, would it have to conform to these standards. Mr. Bass answered we do not have a standard for this yet, that this amendment.is just for brand new developments. Commissioner Owens asked if this would apply to all sections of the city including Texas 10. Mr. Bass answered yes this amendment would apply because all the zoning categories and standards refer to this article. Commissioner Eggers asked if there was an existing business on Interstate 10, and the city determined that the existing parking dirt not meet the future standards, would that be considered a new development, He also asked if these people would be allowed to use asphalt or would it helve to be concrete, Commissioner Zahn asked if for example Whataburger was a new development since they razed the building. Mr. Bass answered that it was. He also stated that if a structure was substantially razed and the property was redeveloped, that was considered a new development. Commissioner Zahn asked if someone had an existing business and the city determined that the parking lot did not meet the future standards. would that be considered a new development or an existing development with a bad parking lot, Mr. Bass answered he did not think the city would have that kind of situation, because right now the city did not have a standard to use to tell someone to replace their asphalt. Commissioner Eggers also asked about the ',ierna's Kitchen parking lot as an example. Mr, Bass answered this amendment would not affect that. Chairman Young stated the Planning and Zoning Commission had to consider getting in the record that the ordinance should be corrected in the first "Whereas" to read.; "desires to modify"; and also at the end of the second "Whereas"to read "its citizens". Commissioner Owens asked Paul K.ruckemeyer, City Engineer, if the ordinance was adopted and gent before City Council, would this ordinance come before; the Planning and Zoning Commission again and be changed in a few months. Mr. Kruckemeyer stated the ordinance was written as a tool for the city to make sure any new development met a higher standard. Furthermore, he commented that the City was revamping Article X of the UDC, and this ordinance would be addressed again. however; it would be within the new Article X probably verbatim. He stated the ordinance being considered was for new construction only, and he did not expected it to change. Commissioner Zahn asked if new residential developments Would require off street parking. He asked if the R-1 standards specify requirements for a driveway to a house, FILMNING&ZONING COMM2SSiON P XG E- MNUTFS,Of SEPTEMBER 1,IM Mr, Bass answered the materials are not specified and that Article V, has some requirements for driveway standards and drive approach standards, Commiss."oner Zahn also asked what was the significant difference as to what is required now as far as the thickness of a driveway going into a house, as opposed to having a developer bring each driveway in the city up to fire lane standards. He also wanted to know if the city was asking for something not needed by telling someone that if he was going to have a concrete driveway, instead of being four inches it should be six inches. Mr.. Bass stated the amendment was fire lane standard and meant to be for heavy equipment on the surfaces. Commissioner Zahn stated he was concerned about reqUiring homeowners to meet fire lane standards in front of their horne• . He stated he would like for the amendment to exclude R-1, R-1 L., and R-1 C zoning categories so that residential remodels and new construction would not be affected by this ordinance. Mr. Kruckerneyer stated this ordinance was not intended for residential use be-cause it was not practical beside the fact that lime stabilization equipment could not be used on a 10' x 11' section Of ground, Commissioner Zahn asked if lime stabilization was a fir-0 lane requirement. Mr. Kruckerneyer replied that it was required, Commissioner Shuler asked if R-1, RA I-, and R-10 was removed from this ordinance would that eliminate a possible problem for homeowners or new construction in a residential subdivision, Mr. Bass stated if the Commission would like to specify that,for their own comfort, that would exclude those categories for new and existing developments. Commissioner Zahn made the motion to send forward the recommendation to C4 Council to approve #98-06-UDC. "Off Street Parking " to exclude R-1, R-I L, and R--1C zoning districts. Commissioner Owens seconded the motion. Commissioner Owens stated that he would like to make a statement that this was a major change. Commissioner Owens stated that he wanted the City Council to understand that the Planning and Zoning Commission was not in favor of the ordinance the way it was presented and definitely would like to exclude R-1, R-1 L, and RAC from the amended paving standards, The Commissioners discussed this comment and all agreed. Commissioner Eggers asked what type of pavement was at the Texas Star Golf Course, Mr. Kruckemeyer replied that it was asphalt in the rear parking area. Commissioner Eggers asked what would it have done, to the City if we required concrete. Mr, Kruckerneyer stated it would have cost the City more money. Commissioner Zahn made the statement that he was concerned that the requirement would be negotiated through a Specific Use Permit or Planned Development instead of standing firm with this ordinance, The Commissioners agreed with this comment from Commissioner Zahn. He stated that Planned Developments can be used to negotiate changes to *he use. !to stated he would try his hest to explain to Cite Council the concerns the Planning and Zoning Commission has for amendments to the Unified Development Code. ITEM 5 REPORTS Commissioner Owens asked if case #98-02-SP would be affected by the ordinance that was just recommended in the prevrious agenda item. Mr, Bass stated that it would :pct be affected. ITEM 6 DIRECTOR'S REPORT There was no Director's Report.
