NOVEMBER 17, 1998
MINUTES
The Pre-Commission meeting of the Planning and Zoning Commission was called to
order by Chairman! Ronald Young at 5:30 p.m. in the Building "C" Conference Roorn. Six
members of the Planning and Zoning Commission were in attendance.
PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS -
COUNCIL CHAMBERS.
Chairman Young called the Planning and Zoning Commission meeting to order at 7:00
p.m, for the consideration of scheduled items. He stated there were six members of the
Planning and Zoning Commission present and that Commissioner Eggers was absent.

Chairman Young and the Invocation was given by Zahn.
APPROVAL OF MINUTES
Commissioner McMillon moved to approve the minutes of the Planning and Zoning
Commission meeting of November 3, 1998, with the correction of a type to change the
word "Commission" to "City„ in the phrase "and lights and everything else, and if the
"City...". This phrase was in Item 2. Commissioner Shuler seconded the motion.
The vote was as follows:

ITEM 1 PUBLIC HEARING — SPECIFIC USE PERMIT w #98-35-SUP ® 203

Public input regarding the request of Anthony Zak, North Texas Truck
Leasing, Inc., for a truck leasing facility within TX-10 (Texas Highway 10
Multi-Use District) zoning; located on A. Huitt Survey, Abstract 084, Tract
11109: 203-13 West Euless Boulevard,
Bo Bass, Director of Planning and Development gave a brief description of the case. He
stated the Development review Committee (DISC) recommended approval contingent on
the following 3 conditions:
1 j That a 6' masonry wall be constructed on the north side of the property.
2) That the SUP be limited only to North Texas Truck Leasing and specifically
the applicant Anthony Zak.
3} That the SUP be limited to the length of the lease itself.
Chairman Young explained the procedures for a Public Hearing, opened the Public
Hearing, and asked the applicant or applicant's representative to speak on behalf of the
case.
Agnes Hiersche, 1905 Kynette Drive, Euless, Texas, stated she is the owner of 203-B
West Euless Boulevard. Ms. Hiersche also stated she wants to be able to lease the
building to the applicant Mr. Zak but that she could not afford a masonry wall.
Chairman Young closed the Public Hearing.

Chairman Young asked Paul Kruckerneyer, City Engineer, if the size of the paved area
would be large enough for this size of trucks to maneuvering. Mr. Kruckemeyer
answered yes.
Chairman Young asked Mr. Bass if Kevin Mercer, Development Services Manager,
would determine whether paving was t#p to correct standards when issuing a Certificate
of Occupancy. Mr. Bass answered that the only requirements in terms of paving
surface is that the surface must be capable of supporting a "fire apparatus" and that the
only control the City has right now is where there is a fire easement.
Commissioner Mc-Millon stated that even though the building is neat and clean, it is not
lfp to the standards intended for the TX-10 zoning district.
Chairman Young asked Ms. Heirsche to come back to the podium. Chairman Young
asked how long a lease Mr. Zak is proposing. Ms. Heirsche answered Mr. Zak had put
one year in the contract.
Commissioner Shuler asked Ms. Heirsche how long ago she sold her business. Ms.
Heirsche answered she sold it in July, 1993, Commissioner Shuler asked what the
building had been used for. Ms. Heirsche answered she had rented it from 1993 to
1990 to the man who bought her business, and that he had been using it as a trucking
business, She said he later moved it to the airport, and after that she had various
leases. Commissioner Shuler stated that since the City had adopted the TX-10 criteria,
it needed to be enforced, first with the masonry wall at front and even wrapping it
around to the sides; second with landscaping up to TX-10 standards.
Ms. Heirsche asked about the trucks that park by the muffler shop,
Commissioner Owens stated that the City of Euless has moved in a different direction
and one of the high priorities is TX-10. He stated that TX-10 should be implemented to
the letter.
Commissioner Zahn stated that is burdensome to comply to TX-10 on a one year lease
if that was all that Ms. Heirsche has. He stated he was inclined to consider a denial of
the Specific Use Permit,
Chairman Young stated he was in favor of redevelopment not recycling.
Commissioner Bright stated that if an exception was made for this Specific Use Permit;
prior applicants would question why. She stated she agreed with the other
Commissioners that the TX-10 rules had to be implemented. Commissioner Bright also
stated that the building looks nice but that the wall is needed and to pelt up a wall for a
one year lease, is costly. Ms. Heirsche stated that if the Specific Use Permit was
granted to Mr. Zak, he would probably stay more than a year. Ms. Herische asked

again about the trucks by the muffler shop and why was her property different than that.
Commissioner McMillon stated to repeat that the Planning and Zoning Commission is a
recommending body, and to recommend less than the standards would send the wrong
message. He stated that in order for the Commissioners to approve this SUP, several
things would need to be done to this property to make it comply with the TX-10.
Commissioner Owens stated that as a recommending body and having a Unified
Development Code, TX-10 should be implemented with no variations.
Commissioner Zahn made the motion to recommend denial of Specific Use Permit #98-
35-SUP based on four of the thirteen Specific Use Permit Evaluation Criteria:
# 11 There is sufficient landscaping and screening to ensure harmony and
compatibility with adjacent properties.
# 7 The location, nature, and height of buildings, structures, walls, and fences are
not out of scale with the neighborhood.
# 3 The benefits that the City gains from the proposed use Outweigh the loss of or
damage to any homes, businesses, natural resources, agricultural lands,
historical or cultural landmarks or sites, wildlife habitats, parks, or natural, scenic,
or historical features of significance; and outweigh the personal and economic
cost of any disruption to the lives, business; and property of individuals affected
by the proposed use.
# 6 The issuance of the SUP does not impede the normal and orderly development
and improvement of neighboring vacant property.
Commissioner Owens seconded the motion, amending it to include that it should be in
compliance with the requirements of Section 84-112 The ''TX-10° Texas Highway 10
Multi Use District Standards. Commissioner Zahn agreed to the amendment.
The vote was as follows:
Ayes: Chairman Young, Commissioners Zahn, Shuler, Owens; Bright, McMillon
Bays: None
Absent: Commissioner Eggers
The motion carried.
