Vacancies shall be filled by the authority who appointed such member for the unexpired term of any member whose term becomes vacant. (Ord.No. 394, § II, 2-23-71) Sec. 2-10. Authorization of additional municipal courts and judges by council. (a) The Euless city council shall have the right and author- ity from time to time, by appropriate resolution, to estab- lish additional municipal courts which courts, when so estab- lished, shall be courts of full stature and equal dignity with the present and existing Euless municipal court. (b) The Euless city council shall, by appropriate resolution, have the authority from time to time to also name additional judges and/or associate judges to preside over and perform the judicial functions attendant each of the municipal courts of the City of Euless. (c) Each of such municipal judges and/or associate judges shall serve at the pleasure of the Euless city council and may be removed, without cause shown, at any time and from time to time, at the pleasure of the Euless city council. Such mu- nicipal judges and any associate municipal judges shall be appointed without term to serve as herein provided at the pleasure of the Euless city council. (d) The judges and associate judges of the Euless munici- pal courts shall be compensated in an amount and manner as same may from time to time be prescribed by the Euless city council. (e) Each of such municipal judges and associate judges shall have full authority and concurrent jurisdiction to pre- side in the court or courts primarily assigned one to the other and at any time and from time to time in the absence of the other. Each of such judges and or associate judges shall be of equal stature and dignity with concurrent jurisdiction one with the other, each with full right, power and authority to perform each and every judicial function authorized by the Supp. No.8 157 § 2-10 EULESS CODE § 2-50 charter and ordinances of said city, the statutes, constitu- tion and laws of the State of Texas. Therefore, codification herein as § 2-10 was at the discretion of the editor. Sec. 2-11. Standing reward for conviction of persons damag- ing public property; payment. (a) A standing reward of one hundred dollars ($100.00) is hereby offered by the City of Euless, Texas, for the information leading to the arrest and conviction of any person who unlawfully, wilfully, maliciously, wantonly, negligently or otherwise shall injure, deface, destroy, remove or knock down any real or personal property, and street sign or traffic-control device belonging to such city within the city limits of the City of Euless. Said reward is to be paid out of the general fund of the city to the person or persons so furnishing the information leading to the arrest and conviction of persons guilty of said offense. (b) The payment of such reward shall be made by the city manager of the City of Euless upon the recommendation of the chief of police of the City of Euless, who shall be the official of the city charged with the responsibility of making the determination as to whether or not the requirements for such reward hereinbefore provided shall have been properly fulfilled. Supp. No.8 158 Chapter 43/4 CIVIL PREPAREDNESS* Sec. 43/4-1. Director; coordinator. (a) There exists the office of civil preparedness director of the City of Euless, which shall be held by the mayor in accordance with state law. The director shall be responsible for conducting a program of comprehensive emergency management within the city and for carrying out the duties and responsibilities set forth in section 43/4-2. He may delegate authority for execution of these duties to the coordinator, but ultimate responsibility for such execution shall remain with the director. (b) A civil preparedness coordinator may be appointed by and serve at the pleasure of the director. (Ord. No. 654, § 1, 1-27-81) Sec. 43/4-2. Powers and duties of director. The powers and duties of the director shall include an ongoing survey of actual or potential major hazards which threaten life and property within the city; and an ongoing program of identifying and requiring or recommending the implementation of measures which would tend to prevent the occurrence or reduce the impact of such hazards if a disaster did occur. As part of his responsibility in hazard mitigation, the director shall supervise the development of an emergency operations plan for the City of Euless, and shall recommend that plan for adoption by the city council along with any and all mutual aid plans and agreements which are deemed essential for the implementation of such emergency operations plan. The powers of the director shall include the authority to declare a state of emergency, but such action may be subject to confirmation by the city council at its next meeting. The duties of the director shall also include the causing of a survey of the availability of *Editor's note—Ord. Supp.No.8 345 § 43/4-2 EULESS CODE § 43i4-2 existing personnel, equipment, supplies and services which could be used during an emergency, as provided for herein, as well as a continuing study of the need for amendments and improvements in the emergency operations plan. The duties and responsibilities of the civil preparedness director shall include the following: (a) The direction and control of the actual emergency operations of the Euless Civil Preparedness organiza- tion as well as the training of civil preparedness personnel. (b) The determination of all questions of authority and responsibility that may arise within the civil preparedness organization of the city. (c) The maintenance of necessary liaison with other municipal, county, district, state, regional, federal, or other civil preparedness organizations. (d) The marshaling, after declaration of an emergency as provided for above, of all necessary personnel, equipment or supplies from any department of the city to aid in the carrying out of the provisions of the emergency operations plan. (e) The issuance of all necessary proclamations as to the existence of an emergency and the immediate operational effectiveness of the City of Euless emergency operations plan. (f) The issuance of reasonable rules, regulations or directives which are necessary for the protection of life and property in the City of Euless. Such rules and regulations shall be filed in the office of the city secretary and shall receive widespread publicity unless publicity would be of aid and comfort to the enemy. (g) The supervision of the drafting and execution of mutual aid agreements, in cooperation with the representatives of the state and of other local political subdivisions of the state, and the drafting and execution, if deemed desirable, of an agreement with Supp. No.8 346 § 43/4-2 CIVIL PREPAREDNESS § 43/4-4 the county in which said city is located and with other municipalities within the county, for the county-wide coordination of civil preparedness efforts. (h) The supervision of, and final authorization for the procurement of all necessary supplies and equipment, including acceptance of private contributions which may be offered for the purpose of improving civil preparedness within the city. (i) The authorizing of agreements, after approval by the city attorney, for use of private property for public shelter and other purposes. (Ord. No. 654, §§ 2, 4, 1-27-81) Sec. 43/4-3. Disaster services council. The mayor is hereby authorized to join with the county judge of the County of Tarrant and the mayors of the other cities in said county in the formation of a disaster services council for the County of Tarrant and shall have the authority to cooperate in the preparation of a joint emergency operations plan and in the appointment of a joint civil preparedness coordinator, as well as all powers necessary to participate in a county-wide program of emergency preparedness insofar as said program may affect the City of Euless. (Ord. No. 654, § 3, 1-27-81) Sec. 43/4-4. Members of organization. The operational civil preparedness organization of the City of Euless shall consist of the officers and employees of the city so designated by the director in the emergency operations plan, as well as all organized volunteer emergency preparedness associations or groups. The func- tions and duties of this organization shall be distributed among such officers and employees in accordance with the terms of the emergency operations plan. Such plan shall set forth the form of the organization, establish and designate divisions and functions, assign tasks, duties and powers, and designate officers and employees to carry out the provisions of this chapter. Insofar as possible, the form of Supp. No. 8 347 § 43/4-4 EULESS CODE § 43/4-8 the organization, titles, and terminology shall conform to the recommendations of the state division of disaster emergency services of the State of Texas and of the federal government. (Ord. No. 654, § 5, 1-27-81) Sec. 43/4-5. Oath required of members of organization. Each employee or any individual that is assigned a function or responsibility shall solemnly swear or affirm to support and defend the Constitution of the United States, laws of the State of Texas and the Ordinances of the City of Euless. (Ord. No. 654, § 12, 1-27-81) Sec. 43/4-6. Authority of chapter to supersede other legislation, orders, etc. At all times when the orders, rules, and regulations made and promulgated pursuant to this chapter shall be in effect, they shall supersede and override all existing ordinances, orders, rules, and regulations insofar as the latter may be inconsistent therewith. (Ord. No. 654, § 7, 1-27-81) Sec. 43/4-7. Construction of chapter. This chapter shall not be construed so as to conflict with any state or federal statute or with any military or naval order, rule or regulation. (Ord. No. 654, § 8, 1-27-81) Sec. 43/4-8. Liability of city and individuals acting pursuant to provisions of this chapter. This chapter is an exercise by the city of its governmental functions for the protection of the public peace, health, and safety and neither the City of Euless, the agents and representatives of said city, nor any individual, receiver, firm, partnership, corporation, association, or trustee, nor any of the agents thereof, in good faith carrying out, complying with or attempting to comply with, any order, rule or regulation promulgated pursuant to the provisions of this chapter shall be liable for any damage sustained to persons as the result of said activity. Any person owning or controlling real estate or other premises who voluntarily and Supp. No.8 348 § 43/4-8 CIVIL PREPAREDNESS §43/4-11 with compensation grants to the City of Euless a license of privilege, or otherwise permits the city to inspect, designate and use the whole or any part or parts of such real estate or premises for the purpose of sheltering persons during an actual, impending or practice enemy attack shall, together with his successors in interest, if any, not be civilly liable for the death of, or injury to, any person on or about such real estate or premises under such license, privilege or other permission or for loss of, or damage to, the property of such person. (Ord. No. 654, § 9, 1-27-81) Sec. 43/4-9. Approval of city council required to spend public funds or make contracts. No person shall have the right to expend any public funds of the city in carrying out any civil preparedness activity authorized by this chapter without prior approval by the city council, nor shall any person have any right to bind the city by contract, agreement or otherwise without prior and specific approval of the city council. (Ord. No. 654, § 10, 1-27-81) Sec. 43/4-10. Unauthorized use of signals. Any unauthorized person who shall operate a siren or other device so as to simulate a warning signal, or the termination of a warning, shall be deemed guilty of a violation of this chapter and shall be subject to the penalties imposed by this chapter. (Ord. No. 654, § 6, 1-27-81) Sec. 43A-11. Obstruction of member of organization prohibited; penalty for violations of chapter. It shall be unlawful for any person willfully to obstruct, hinder, or delay any member of the civil preparedness organization in the enforcement of any rule or regulation issued pursuant to this chapter, or to do any act forbidden by any rule or regulation issued pursuant to the authority contained in this chapter. It shall likewise be unlawful for any person to wear, carry or display any emblem, insignia Supp. No.8 �,,,� 349 § 43/4-11 EULESS CODE § 43/4-11 or any other means of identification as a member of the civil preparedness organization of the City of Euless, unless authority to do so has been granted to such person by the proper officials. Convictions for violations of the provisions of this chapter shall be punishable by fine not to exceed two hundred dollars ($200.00). (Ord. No. 654, § 11, 1-27-81) Supp. No. 8 350 ,..-� Chapter 5 FINANCE AND TAXATION* Art. I. In General, §§ 5-1-5-20 Art. II. Hotel Occupancy Tax,§§ 5-21-5-26 ARTICLE I. IN GENERAL Sec. 5-1. Homestead ad valorem tax exemption for persons sixty-five or over—Granted. From and after January 1, 1980, and upon compliance with the requirements hereafter set forth, there shall be exempted the sum of ten thousand seven hundred and seventy dollars ($10,770.00) of the assessed value of residence homesteads of residents of the City of Euless, Texas, who are sixty-five (65) years of age or older, from all ad valorem taxes thereafter levied by such city. (Ord. No. 445, Art. I, 4-24-73; Ord. No. 522, § 1, 9-13-77; Ord. No. 645, § 1, 10-14-80) Sec. 5-2. Same—Initial application for. To be eligible for the residential homestead exemption from ad valorem taxes levied by the City of Eluess, Texas, for those persons sixty-five (65) years of age or older, the person seeking such exemption shall make application there- for on forms prescribed by the tax assessor-collector for the City of Euless, Texas, between January first and April thirtieth of each year. Eligible persons making such applica- tion within such period shall be qualified for such exemption from ad valorem taxes levied by the city for the year in which such application is made. (Ord. No. 445, Art. II, 4- 24-73; Ord. No. 585, § 1, 8-28-79) Sec. 5-3. Same—Annual application. Once a person has qualified for such exemption, as above provided, the tax assessor-collector of the City of Euless, *Cross references—Garbage collection permit, § 7-15 et seq.; occupa- tional licenses,Ch. 10; licenses for vehicles for hire and wreckers, Ch. 16. Supp. No.8 351 § 5-3 EULESS CODE § 5-5 Texas, will thereafter mail to such qualified applicant an annual application for continued exemption each year so as to enable such person to make continued application for such exemption in a timely fashion. The failure of the tax as- sessor-collector of the City of Euless, Texas, to mail annual applications to qualified applicants shall not constitute a waiver by the City of Euless, Texas, of the requirement that the application for exemption be filed between January first and April thirtieth of each year. It shall be the responsibility of those persons seeking the exemption provided for to com- plete, sign and file with the tax assessor-collector of the City of Euless, Texas, the application for exemption form by no later than April thirtieth of each year to be eligible for such annual exemption. This requirement of subsequent annual notice shall terminate in the event the ownership of the prop- erty to which the exemption shall have been effected has been transferred from the applicant or,in the event the appli- cant fails to renew the exemption for any year. (Ord. No. 585, § 1, 8-28-79) Sec. 5-4. Same—Exclusions. The exemption herein created shall not apply to any ad valorem tax heretofore pledged for the payment of any debt of the City of Euless, Texas, if the cessation of such levy would impair the obligation of the contract by which such debt was created and the tax assessor-collector of the City of Euless shall have the authority to continue any such levy and collect the tax against such homestead property at the same rate as the tax so pledged until any such debt is finally discharged. (Ord. No. 445, Art. IV, 4-24-73; Ord. No. 522, § 3, 9-13-77) Note—See the editor's note to § 5_1. Sec. 5-5. Ad valorem taxation; interest and penalties. (a) All ad valorem taxes levied by the City of Euless shall be deemed and become delinquent, if not paid prior thereto, on February 1st of the year following assessment. (b) Such delinquent ad valorem taxes from the effective date hereof through June 30, 1975, shall be subject to penalty Supp. No. 8 352 § 12-2 PARKS, ETC. § 12-5 on the duration and time of use, the number of individuals authorized for such special use, requirements that certain person or persons be in attendance and in supervision during the period or periods of use and the establishment of addition- al fees or charges to compensate the City of Euless for ex- penses additionally incurred as to such special use. It shall be unlawful to be found in or to enter any park or playground or any facility therein at any time prescribed, as herein provided, unless such presence be in full compliance with a special use permit issued by the director of parks and recreation. (Ord. No. 251, Art. III, § 1, 5-25-65; Ord. No. 475, § 1, 7-20-74) Sec. 12-3. Parking vehicles. Where vehicle parking lots or areas have been set aside in a park in the city, no vehicle shall be driven over or across the curbs, sidewalks, grass or lawn within such park, but shall be parked in such parking lots or areas and not other- wise. (Ord. No. 251, Art. III, § 3, 5-25-65) Sec. 12-4. Use of roadways and paths. It shall be unlawful to drive or propel any vehicle over or through any park or playground except along or upon park drives, parkways or park boulevards, or to drive or propel along or over any park drive, parkway or park boulevard, any heavily laden vehicle or vehicle carrying merchandise, goods, material or rubbish, or any market wagon, milk wagon, dirt cart, moving van, dray or truck; and it shall be un- lawful for any person to ride or to drive any horse or other animal over or through any park or playground except along and upon the designated bridle paths and driveways in such park or playground. (Ord. No.251,Art. III, §4, 5-25-65) Sec. 12-5. Sale of merchandise. It shall be unlawful for any person to sell or offer for sale any food, drinks, confections, merchandise or services in any park or playground unless such person has a written agree- Supp.No.8 900.1 § 12-5 EULESS CODE § 12-9 ment or a permit issued by the city permitting the sale of such items in such park or playground. Application for such agreements or permits shall be made to the city manager. (Ord. No.251,Art. III, § 5, 5-25-65) Sec. 12-6. Erecting structures. It shall be unlawful to place or erect any structure, sign, bulletin board, post, pole or advertising device of any kind whatever in any park or playground, or to attach any notice, bill, poster, sign, wire, rod or cord to any tree, shrub, fence, railing, post or structure within any park or playground; provided, however, the director of parks and recreation may permit the erection of temporary decorations on occasions of public celebrations or holidays. (Ord. No. 251, Art. III, § 6, 5-25-65) Sec. 12-7. Removing,mutilating property—Generally. It shall be unlawful to remove, destroy, mutilate or deface any structure, monument, statue, vase, fountain, wall, fence, railing, vehicle, bench or other property in any park or play- ground. (Ord. Same—Trees,shrubs,fences,etc. It shall be unlawful for any person to cut, break, deface or in any way injure the trees, shrubs, plants, grass, turf, foun- tains, seats, fences, structures, improvements, ornaments or monuments, or property, within nr upon any of the parks or playgrounds. (Ord. No. 251,Art. III, § 2, 5-25-65) Sec. 12-9. Teasing, injuring or killing animals. It shall be unlawful to tease, annoy, molest, catch, injure or kill, or throw any stone, object or missile of any kind at, or strike with any stick, object or weapon any animal, bird, fowl or fish in any park or playground. (Ord. No. 251, Art. III, § 8, 5-25-65) Supp. No.8 900.2 § 12-10 PARKS, ETC. § 12-13 Sec. 12-10. Swimming pool fees, hours of operation and gen- eral policy. Pool use fees, hours of operation and general policy involved in the operation of municipal swimming pools shall be es- tablished by the city council by proper entry in the council minutes upon the recommendation of the city manager and the director of parks and recreation. The city manager and the director of parks and recreation shall consult with the park and recreation board in effecting general policy for the operation of municipal swimming pools and make such recom- mendations to the city council as may from time to time be deemed necessary and appropriate. The city council may from time to time upon the recommen- dation of the city manager grant concessions for the operation of amusements, refreshment stands and related concessionaire facilities for operation in municipal parks and play- grounds. Any such concession shall be granted upon a written contract detailing the privileges, duties and responsibilities of the concessionaire and providing adequate protection for the city and its citizens. (Ord. No. 251, Art. V, 5-25-65) Sec. 12-12. Alcoholic beverages prohibited. It shall be unlawful for any person to sell, bring into, possess or consume an alcoholic beverage in any park of the city except upon special permit granted by the Euless City Council upon application, which permit, if granted, may contain terms and conditions applicable thereto. (Ord. No. 660, § 1, 4-28-81) Sec. 12-13. Penalty. Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and the person, or an employee, agent, manager or officer thereof, shall be pun- Supp. No.8 901 § 12-13 EULESS CODE § 12-30 ished as provided in section 1-6 for each offense, and each day's failure or refusal to comply with said provisions will constitute a separate offense, and in case of wilful or contin- ued violations by any person as aforesaid, or his agents, em- ployees, servants or officers, the city shall have power to revoke and repeal any license under which said person may be acting, and revoke all permits, privileges and franchises granted to said person. (Ord. No. 251, Art.VI, 5-25-65) Secs. 12-14-12-29. Reserved. ARTICLE II.LIBRARY* Sec. 12-30. Department; director. There shall be a department of city government to be known as the department of public libraries. Supp. No. 8 902 § 15-46 VEHICLES FOR HIRE § 15-46 Sec. 15-46. Same—Application. Any person desiring a permit to operate a wrecker in the city shall file with the city manager or his authorized rep- resentative a written application for such permit. Such appli- cation shall be filed in letter form and shall be verified by the oath of the applicant and shall give, among other details, the following information: (1) The name, age and residence of the applicant, if a natu- ral person. If the applicant is a partnership, the name, age and residence of all partners, general and limited. If the applicant is a corporation, its name, date and place of incorporation, the address of its principal place of business, the names and residences of all its offi- cers and directors, the names and residences of all its stockholders owning ten (10) per cent or more of the total issued capital stock, the amount of stock owned by each of them, the total amount and nature of its authorized capital stock, the amount thereof fully paid up, as well as a certified copy of its charter and by- laws, and further if the applicant is a foreign corpora- tion, a duly certified copy of its permit to do business in the state. (2) The length of time the applicant has been a resident of the city and the county. (3) The trade name, if any, under which the applicant pro- poses to operate. (4) The address of the place of business for which the applicant proposes to operate and the telephone num- ber of said place of business. (5) The make, type, model, capacity and condition of each wrecker proposed to be operated; the design and color scheme of each wrecker, and the lettering and marks to be used thereon. (6) The number of wreckers for which permits are desired. (7) A full list of any unpaid judgments of record against the applicant, which list shall include the name and Supp. No.8 1101 § 15-46 EULESS CODE § 15-47 address of each owner of a judgment, and the amount of such judgment. If the applicant is a partnership, a like list shall be furnished for the partnership and for each individual partner, general or limited. If the appli- cant is a corporation, a like list shall be furnished by the corporation. (8) A full list of convictions of the applicant for violation of any and all federal, state and municipal laws other than traffic statutes. If the applicant is a partnership, a like list shall be furnished for each individual part- ner, general or limited. If the applicant is a corpora- tion, then a like list shall be furnished for each of its officers and directors, as well as for each stockholder owning ten (10) per cent or more of the total issued capital stock. (9) A full list of any and all liens, mortgages and other encumbrances on the wreckers owned by the operator for which permits are requested. Such list shall include the amount secured by each lien and mortgage or other encumbrance, the amount then due thereon, the character of such lien, mortgage or other encumbrance, and the name and address of the holder of such lien,mortgage or other encumbrance. (10) Full information pertaining to the extent, quality and character of the wrecker service the applicant proposes to render. (11) A full and complete statement of the experience, if any, the applicant has had in rendering such wrecker service in the city or elsewhere. If the applicant is a partnership, a like statement for the partnership and each partner, general and limited. If the applicant is a corporation, a like statement for the corporation and each of its officers and directors. (Ord. No. 412, Art. I, § 3, 10-26-71) Sec. 15-47. Reserved. No. 412,Art.I,§4, adopted Oct. 26, 1971. Supp. No.8 1102 § 15-48 VEHICLES FOR HIRE § 15-49 Sec. 15-48. Same—Issuance; vehicle requirements. The city manager shall issue wrecker permits to all appli- cants complying with the provisions of this article after the applications have been completed and filed in his office, the permit fees paid, and after the chief of police or his duly authorized representative has inspected each such wrecker and determined that the wrecker complies with the following minimum requirements; and that the operator has filed the certificates required by this article: (1) Each wrecker shall be not less than one-half (1/2) ton in size. (2) Each wrecker shall be equipped with a power or hand- operated winch, winch line and boom, with a factory- rated capacity of not less than five thousand (5,000) pounds single line capacity. (3) Each wrecker shall carry as standard equipment: A tow bar, safety chains, fire extinguisher, wrecking bar, �--� broom,axe, shovel,flags and flares. (4) Each wrecker shall have inscribed on each side thereof in letters not less than three (3) inches in height the name and address of the operator. (5) Each operator shall furnish to the city a certificate from the tax assessor-collector showing that no delin- quent taxes are due the city by said wrecker operator. (6) Each operator shall furnish a certificate of insurance showing valid policies in force on each wrecker vehicle in amounts of at least those required by state statutes. (Ord. No.412, Art. I, § 6, 10-26-71) Sec. 15-49. Same—Revocation. (a) The city manager, after an administrative hearing, may revoke the permit issued on any or all wreckers belong- ing to an operator on any of the following grounds: Supp. No.8 1103 § 15-49 EULESS CODE § 15-50 (1) If a permit was procured by fraudulent conduct or false statement of a material fact or a fact concerning the applicant not disclosed at the time the application was made. (2) If the applicant or any of his agents, servants or em- ployees proceeds to the scene of an accident in violation of the provisions of this article. (3) If the applicant or any of his agents, servants or em- ployees solicits any business in violation of the provi- sions of this article. (b) Such revocation of the permit shall terminate all au- thority and permission heretofore granted. Any person whose permit has been revoked shall not be eligible to again apply for a license or permit for a period of up to one year from the date of the revocation. (c) Any person whose license or permit has been revoked by the city manager may file an appeal therefrom to the city ^� council within twenty (20) days from the date of revocation. The city council shall have authority upon the hearing of the appeal to reverse, vacate or modify the order of revocation. (Ord. No. 412, Art. I, § 7, 10-26-71) Sec. 15-50. Wrecker pull form. The city manager shall cause to be prepared a form to be used for each wrecker pull in the city. Said form shall provide for the following information: (1) The name of the owner or the name of his authorized representative of any disabled vehicle desiring the towing or removing of said disabled vehicle. (2) The place to which the owner or his authorized rep- resentative shall desire said vehicle to be taken. Supp. No. 8 1104 § 10 APPENDIX B—SUBDIVISIONS § 12 will be considered by the city upon the individual merits of each project prior to construction. (Ord. No. 147, § III(B)(3), 6-5-61; Ord. No. 595, § 1, 9-25-79) Sec. 11. Same—Sidewalks. Sidewalks are required and shall be not less than three (3) feet in width, parallel to and not more than one foot outside of the property line, and shall be situated wholly within the dedicated street. Sidewalks abutting business property shall have a minimum width of ten (10) feet. Parkways shall be excavated or filled to a grade parallel with and have not more than a one-quarter-inch slope to the foot from the back of the curb to the property line. Landing walks of a width not less than eighteen (18) inches may be installed abutting the rear of the curb. Sidewalk requirements are to be included in a subdivision preliminary. Final plans on such walks shall be submitted along with the final plat of the development, and detailed construction plans shall be filed for approval of the city planning commission and city engineer at the time of submission of the final plat. (Ord. No. 147, § III(B)(3), 6-5-61; Ord. No. 595, § 2, 9-25-79) Sec. 12. Same—Alleys and easements. The city will require in new subdivisions at least ten-foot wide easements in lieu of alleys except in conditions as set out in section 40. If a subdivider desires to include alleys in a subdivision, they shall be not less than twenty (20) feet in width and constructed of concrete by the subdivider at his own expense, except that R-1 and R-2 zoning districts and property developed in PD and CUD zoning districts for one- and two-family dwelling units may include alleys with a dedicated right-of-way width of not less than fifteen (15) feet and a pavement width of not less than twelve (12) feet, if same be approved at time of platting of such subdivision by the Euless City Council. Any construction plans for this type of improvement shall be submitted to the planning commission at the time of submission of the final plat. (Ord. No. 147, § III(B)(4), 6-5-61; Ord. No. 657, § 1, 4-14-81) Supp. No.8 1321 § 13 EULESS CODE § 14 Sec. 13. Same—Storm sewers. (a) Preliminary plans and layouts prepared by and bearing the seal and signature of a registered professional engi- neer in the state for any drainage structures and improve- ments shall be submitted by the subdivider or developer to the city planning commission for study by the city engineer along with the submission of the preliminary plat of the sub- division. These plans shall show drainage areas contributing to all facilities and design criteria and calculations for all facilities showing preliminary sizing. (b) Where, in the opinion of the city engineer, storm sew- ers are required to adequately accommodate drainage runoff, the subdivider or developer shall be required to install, at his own expense, all such storm sewer lines and drainage struc- tures which require the equivalent of a forty-eight (48) inch diameter pipe or smaller. Such construction shall be per- formed in accordance with the city standards and specifica- tions governing same. The developer shall assume all costs including all engineering costs covering design, layouts and construction supervision. (c) Where, in the opinion of the city engineer, storm sewers or drainage facilities are required which are in excess of a forty-eight-inch diameter pipe, or its equivalent, the subdivider or developer shall construct a concrete lined open channel designed in accordance with criteria outlined in Section 103(c),Article III, Storm Water Design Standards,of this ordinance. (Ord. No. 147, § III(B)(2), 6-5-61; Ord. No. 249, § I(B)(2), 4-27-65; Ord. No. 618, § 1, 3-25-80) Sec. 14. Preliminary plat—Submitting, scale. Five (5) copies or prints, of the preliminary plat and engi- neering plans of all proposed subdivisions, and twenty (20) copies of the plat and location sheet, shall be submitted to the city planning commission for approval before the prepara- tion of the final plat for record. The preliminary plat shall be filed in the office of the city planning commission at least five (5) days prior to the regular meeting of such body at Supp. No. 8 1322 § 14 APPENDIX B—SUBDIVISIONS § 15 which approval is requested. This plat shall be drawn to a scale of one inch equals one hundred (100) feet. (Ord. No. 147, § III(C) (1), 6-5-61) Sec. 15. Same—Information. The plat shall show or be accompanied by the following information: (1) Proposed subdivision name or identifying title, the names of adjacent subdivisions and the name of the city, county and state, in which the subdivision is located. The proposed subdivision name must not be so similar to that of an existing subdivision as to cause confusion. (2) Name and address of record owner, subdivider, engi- neer, surveyor, land planner or any other designer re- sponsible for the survey and design. (3) Location of boundary or property lines; width and loca- tion of platted streets, alleys and easements within or adjacent to the property being subdivided; present physical features on the land including natural and ar- tificial watercourses, ditches, ravines, culverts, bridges, present structures and any other features directly pertinent to the land being subdivided, location of any existing utilities and pipelines, showing pipe sizes and capacities of storm sewers and drainage structures; outline of any existing wooded areas or location of indi- vidual large trees. (4) A topographical map shall be superimposed on all pre- liminary plats filed with the city. Contour intervals of such map shall not be greater than two (2) feet with all elevations shown thereon tied to the city datum plane or such datum plane of any public authority that may have established a datum plane in the city or its extraterritorial jurisdiction. The plat shall contain the number of acres of the proposed subdivision. (5) The street system design, showing location and width of the proposed streets, easements, alleys, building lots Supp. No.8 1323 § 15 EULESS CODE § 15 and other features with their relationship to the streets, alleys and easements in adjacent subdivisions for a distance of five hundred (500) feet beyond the limits of the proposed subdivision. If there are no ad- jacent subdivisions thereto, a vicinity or location map, drawn at a smaller scale, shall be submitted along with the preliminary plat. This map is to show the boundaries and ownership of adjacent properties, the location and distance to the nearest subdivisions and the manner in which the streets, alleys, easements and highways of the proposed subdivision may eventually connect with those of the nearest existing subdivisions. (6) Classification and designation of the intended uses of land within the subdivision proposed, setting out res- idential, retail business, industrial, off-street parking and all other parcels of land intended to be dedicated to public use, such as schools, parks, playgrounds and any other special uses or semipublic uses required. (7) Date, north point and scale of the drawing or subdivi- sion layout. (8) Preliminary plans for street improvements, on-site or off-site drainage improvements, alley improvements, if any, sidewalks, and any other improvements to be made. This plat shall be drawn to a scale of one inch equals one hundred (100) feet. (Ord. No. 147, § III(C) (1), 6-5-61) Sec. 15. Same—Information. The plat shall show or be accompanied by the following information: (1) Proposed subdivision name or identifying title, the names of adjacent subdivisions and the name of the city, county and state, in which the subdivision is located. The proposed subdivision name must not be so similar to that of an existing subdivision as to cause confusion. (2) Name and address of record owner, subdivider, engi- neer, surveyor, land planner or any other designer re- sponsible for the survey and design. • (3) Location of boundary or property lines; width and loca- tion of platted streets, alleys and easements within or adjacent to the property being subdivided; present physical features on the land including natural and ar- tificial watercourses, ditches, ravines, culverts, bridges, present structures and any other features directly pertinent to the land being subdivided, location of any existing utilities and pipelines, showing pipe sizes and capacities of storm sewers and drainage structures; outline of any existing wooded areas or location of indi- vidual large trees. (4) A topographical map shall be superimposed on all pre- liminary plats filed with the city. Contour intervals of such map shall not be greater than two (2) feet with all elevations shown thereon tied to the city datum plane or such datum plane of any public authority that may have established a datum plane in the city or its extraterritorial jurisdiction. The plat shall contain the number of acres of the proposed subdivision. If there are no ad- jacent subdivisions thereto, a vicinity or location map, drawn at a smaller scale, shall be submitted along with the preliminary plat. This map is to show the boundaries and ownership of adjacent properties, the location and distance to the nearest subdivisions and the manner in which the streets, alleys, easements and highways of the proposed subdivision may eventually connect with those of the nearest existing subdivisions. (6) Classification and designation of the intended uses of land within the subdivision proposed, setting out res- idential, retail business, industrial, off-street parking and all other parcels of land intended to be dedicated to public use, such as schools, parks, playgrounds and any other special uses or semipublic uses required. (7) Date, north point and scale of the drawing or subdivi- sion layout. (8) Preliminary plans for street improvements, on-site or off-site drainage improvements, alley improvements, if any, sidewalks, and any other improvements to be made.
