Planning and zoning commission—Created, member- ship. There is created and established for the city a planning and zoning commission, which shall be composed of seven (7) members. The members shall be resident citizens, taxpayers and qualified voters of the city, all of whom shall be ap- pointed by the governing body, to serve for terms of two (2) years. All vacancies shall be filled for the unexpired term in the same manner as provided for the original appointments. Members of the commission may be removed by the mayor, with the consent of the governing body, after public hearing and for cause assigned in writing. The members of the com- mission shall serve without compensation. (Ord. No. 32, § 1, 3-19-55) Charter reference—See Art. X, § 1. Sec. 2-2. Same—Organization. The planning and zoning commission shall elect a chairman, vice-chairman and a secretary from its membership and shall have power to employ such qualified persons as may be neces- sary for the proper conduct and undertakings of the commis- sion and to pay for their services and such other necessary expenses; provided, the cost of such services and expenses shall not exceed the amount appropriated by the governing body for the use of the commission. It shall also have the power to make rules, regulations and bylaws for its own gov- ernment, which shall conform as nearly as possible with those Supp.No. 17 151 2-2 EULESS CODE § 2-4 �\ governing the city council, and same shall be subject to approval by such council. Such bylaws shall include, among other items,provisions for: (1) Regular and special meetings,open to the public; (2) Records of its proceedings, to be open for inspection by the public; (3) Reporting to the governing body and the public, from time to time and annually; (4) For the holding of public hearings on its recommenda- tions. (Ord. No. 32, § 2,3-19-55) Sec. 2-3. Same—Powers and duties. The planning and zoning commission shall have the power and it shall be its duty to make and recommend for adoption a master plan, as a whole or in parts, for the future develop- ment and redevelopment of the municipality and its environs and shall have power and it shall be its duty to prepare a comprehensive plan for zoning the city in accordance with articles 1011a through 1011j, Vernon's Texas Civil Statutes. The commission shall perform such other duties as may be prescribed by ordinances of the city and laws of the state. (Ord.No.32, §3, 3-19-55) Charter reference—See Art. X, § 2. Sec. 2-4. Mutual law enforcement assistance—Assignment of police of this city authorized. Pursuant to the provisions of article 99b, Vernon's Texas Civil Statutes, the chief of police is authorized to assign the regularly employed law enforcement personnel of his depart- ment to assist any other county or municipality in this state, when a state of civil emergency in such county or municipality has been declared by proper authority, upon request by such proper authority, and when, in the opinion of such proper authority, a need exists in such other county or municipal- Stipp.No. 17 15'? §2-4 ADMINISTRATION §2-4 ity for the services of additional law enforcement officers to protect the health, life and property of such other county or municipality, its inhabitants, and the visitors thereto, by rea- son of riot, unlawful assembly characterized by the use of Supp.No. 17 153 §2-72 ADMINISTRATION §2-74 for two-year terms and shall serve until their successors are ap- pointed and commence active service. A majority of the members of the Euless Advisory Board of Social Concerns shall constitute a quorum for the purpose of transacting all business of the board.The chairman of the board shall vote only where there shall otherwise be a tie vote among the other members in attendance and voting on any issue before such board. The Euless Advisory Board for Social Concerns shall direct its efforts to accomplishing the following: (a) To determine those areas of social problems most vitally affecting the Euless community.In this connection the Board shall evaluate drug abuse,alcoholism,communicable diseases and any other areas of social problems confronting the City of Euless from time to time. (b) Study and evaluate existing programs being conducted in Euless by various agencies and organizations providing ser- vices in the social concern areas to Euless citizens. (c) To further cooperation and a coordination of effort by social concerns agencies in Euless. (d) To recommend to the Euless City Council the initiation and implementation of innovative programs in an effort to re- solve specific social concerns in Euless. (e) To formulate a list of objectives to be enacted by the board with the advice,aid and assistance of the Euless City Council. (f) Seek cooperation among the various governmental agencies of surrounding communities in an effort to deal directly and effectively with specific areas of social concern. (Ord. The Euless Advisory Board for Social Concerns shall make peri- odic recommendations to the Euless City Council concerning the appropriations and expenditures of public funds for the purpose of providing remedial education,counseling,treatment and other areas of service involving specific social concerns in Euless. (Ord.No.447, § 4, 7-24-73; Ord. No. 451, § 4,8-14-73;Ord. No. 462, § 4, 11-13-73; Ord.No.706,§ 1,6-22-82) Secs. 2-76-2-85. Reserved. ARTICLE IV.TREE BOARD* Sec. 2-86. Definitions. The following definitions shall apply in the interpretation and enforcement of this article: Park trees: "Park trees" is herein defined as trees, shrubs, , 1 bushes and all other woody vegetation in public parks having individual names, and all areas owned by the city, or to which the public has free access as a park. Street trees: "Street trees" is herein defined as trees, shrubs, bushes and all other woody vegetation on land lying between the curb, pavement line and the property lines on either side of all streets, avenues or ways within the city. (Ord. No. 876, § 1, 2-25-86) Sec. 2-87. Creation and establishment of a Euless Tree Board. There is hereby created and established a Euless Tree Board for the City of Euless, Texas, which shall consist of the members of the park and recreation board of the City of Euless. (Ord. Cross reference—Parks,recreational and cultural facilities,Ch. 12. Supp.No. 17 166 §2-88 ADMINISTRATION §2-91 Sec. 2-88. Compensation. Members of the Euless Tree Board shall serve without compen- sation. (Ord. No. 876, § 3, 2-25-86) Sec. 2-89. Duties and responsibilities. (a) It shall be the responsibility of the board to study, investi- gate, counsel and develop and/or update annually a written plan for the care, preservation, trimming, planting, replanting, re- moval or disposition of trees and shrubs in public ways, streets and alleys. Such a plan will be presented annually to the city council and, upon acceptance and approval of the city council, shall constitute the official comprehensive city tree plan for the city. (b) The Euless Tree Board,or its agent,shall be responsible for the planting, pruning and removal of all trees located within the street rights-of-way, easements, alleys and parks of the city. The owner of land abutting on any street may, when acting within the provisions of this article,prune, spray, plant or remove trees in that part of the street abutting his land. Permission of the Euless Tree Board shall only be required when the owner of the abutting property intends to deviate from the rules and regula- tions contained in this article. (c) The board,when requested by the city council, shall consid- er, investigate, make findings, report and recommend upon any special matter of question coming within the scope of its work. (Ord. No. 876, § 4, 2-25-86) Sec. 2-90. Operation. The board shall choose its own officers,make its own rules and regulations, and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. (Ord. No. 876, § 5, 2-25-86) Sec. 2-91. Street tree species to be planted. No. 876, § 6, 2-25-86) Sec. 2-92. Spacing. The spacing of street trees will be in accordance with the three (3)species size classes listed in Section 2-91 of this article, and no trees may be planted closer together than the following(without approval of the Euless Tree Board): small trees, twenty(20)feet; medium trees, thirty (30) feet; and large trees, forty (40) feet. (Ord. No. 876, § 7, 2-25-86) Sec. 2-93. Distance from curb and sidewalk. The distance trees may be planted from curbs or curblines and sidewalks will be in accordance with the three (3) species size classes listed in Section 2-91, and no trees may be planted closer to any curb or sidewalk than the following: small trees, two (2) feet; medium trees, three (3)feet; and large trees, four(4)feet in accordance with existing city ordinances. (Ord. No. 876, § 8, 2-25-86) Sec. 2-94. Distance from street corners and fireplugs. No street tree shall be planted closer than twenty (20)feet of any street corner, measured from the point of nearest intersect- Supp.No. 17 168 tTh / §2-94 ADMINISTRATION §2-98 v ing curbs or curblines. No street tree shall be placed closer than ten(10)feet of any fireplug. (Ord. No. 876, § 9, 2-25-86) Sec. 2-95. Utilities. No street trees other than those species listed as small trees in Section 2-91 may be planted under or within ten(10)lateral feet of any overhead utility wire,or over or within five(5)lateral feet of any underground water line, sewer line, transmission line or other utility. (Ord. No. 876, § 10, 2-25-86) Sec. 2-96. Public tree care. The city shall have the right to plant,trim,spray,preserve and remove trees, plants and shrubs within the lines of all streets, alleys, avenues, lanes, squares and public grounds, as may be necessary to ensure safety when servicing city utilities or to preserve the symmetry and beauty of such public grounds. The Euless Tree Board may remove or cause or order to be removed, any tree or part thereof which is located on public property or municipal utility easement which, by reason of its nature, is injurious to sewers, electric power lines, gas lines, water lines or other public improvements, or is affected with any injurious fun- gus, insect or other pest. (Ord. No. 876, § 11, 2-25-86) Sec. 2-97. Trimming and corner clearance. Every owner of any tree overhanging any street or right-of-way within the city shall trim the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of eight (8) feet above the surface of the street or right-of- way. The city shall have the right to trim any tree or shrub on private property when it interferes with visibility of any traffic control device or sign. Such trimming is to be confined to the area immediately above the right-of-way. (Ord. No. 876, § 12, 2-25-86) Sec. 2-98. Interference with Euless Tree Board. It shall be unlawful for any person to prevent, delay or inter- fere with the Euless Tree Board or its authorized agents while Supp.No. 17 169 §2-98 EULESS CODE §2-99 / •••\ engaging in and about the planting, cultivating, mulching,prun- ing, spraying or removing of any street trees and park trees as authorized in this article. (Ord. No. 876, § 13, 2-25-86) Sec. 2-99. Review by city council. The city council shall have the right to review the conduct, acts and decisions of the Euless Tree Board. Any person may appeal from any ruling or order of the Euless Tree Board to the city council who may hear the matter and make final decision. (Ord. No. 876, § 14, 2-25-86) Supp. No. 17 [The next page is 183] � 170 § 14-73 TRAFFIC § 14-75 stopped on the highway for the purpose of receiving or dis- charging any schoolchildren shall stop the vehicle immediately before passing the school bus and not proceed past such school bus until the loading or unloading process is completed and the bus has resumed motion or withdrawn its stop signal devices. (b) All vehicles used for the transportation of pupils to and/or from any school or college shall have a sign on the front and rear and on each side of said vehicle, showing the words "School Bus" and said words shall be plainly readable in letters not less than eight (8) inches in height and the words "School Bus" shall be removed or covered when the vehicle is not in use as a school bus. (Ord. No. 116, § 74, 8-11-59) Sec. 14-74. No-passing zones. The city council may determine by resolution those portions of any highway in the city where overtaking and passing or driving on the left side of the roadway would be especially hazardous and may be appropriate signs or markings on the roadway indicate the beginning and end of such zones, and when such signs or markings are in place and clearly visible to any ordinarily observant person, every driver of a vehicle shall obey the directions thereof. (Ord. No. 116, § 29, 8-11- 59) Sec. 14-75. When overtaking on the right is permitted. (a) The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following condi- tions: (1) When the vehicle overtaken is making or about to make a left turn; (2) Upon a street or highway with unobstructed pavement not occupied by parked vehicles of sufficient width for two (2) or more lanes of moving vehicles in each direc- tion; Supp.No. 17 1025 § 14-75 EULESS CODE § 14-77 /••••••.\ (3) Upon a one-way, or upon any roadway on which traffic is restricted to one direction of movement, whether the roadway is free from obstruction and of sufficient width for two (2) or more lanes of moving vehicles. (b) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by driving off the pavement or main-traveled portion of the roadway. (Ord. No. 116, § 26, 8-11-59) Sec. 14-76. One-way roadways and rotary traffic islands— Driving thereon. (a) The city council may designate any highway or any separate roadway under its jurisdiction for one-way traffio and shall erect appropriate signs giving notice thereof. (b) Upon a roadway designated and signposted for one-way traffic, the driver of a vehicle shall drive only in the direction designated. (c) The driver of a vehicle passing around a rotary traffic island shall drive only to the right of such island. (Ord. No. 116, § 30, 8-11-59) Sec. 14-7 7. Same—One-way streets designated. Upon the basis of an engineering and traffic investigation made as authorized by law and under the authority contained in article 6701d, Vernon's Texas Civil Statutes, the following streets and roadways located within the city are hereby deter- mined and declared to be designated for one-way vehicular traffic for motor vehicles traveling upon the named streets and highways, or parts thereof, as follows: (a) South Access Road, from station 856+57 (Byers Drive) shall be one-way in an easterly direction 0.312 mile to station 873+05 (Cullum Drive). (b) North Access Road, from station 873+05 (Cullum Drive) shall be one-way in a westerly direction 0.312 mile to station 856+57 (Byers Drive). Supp.No. 17 1026 /^� § 14-77 TRAFFIC § 14-77 (c) Pipeline Road, from its intersection with Westpark Way shall be one way in a westerly direction 0.239 mile to its intersection with State Highway 10. (Ord. No. 355, § 1, 7-8-69; Ord. No. 875, § 1, 2-11-86) Supp.No. 17 1026.1 § 16-21 WATER AND SEWERS § 16-22 Sec. 16-21. Connection fee. (a) Water. (b) Sewer. Sewer connection fees shall be paid solely for the privilege of connection to the system. The cost of installing such connection shall be borne by the user. The fee shall be two hun- \--- dred dollars ($200.00). (Ord. No. 795, §§ 3.3(3.3.6), 3.4(3.4.1), 6-12-84; Ord. No. 867, § 1, 11-26-85) Sec. 16-22. Water deposits. All applicants for water service will be required to make a meter deposit (payment security deposit) for each water service connection; such deposit to remain with the city throughout the term of the service contract. (a) Deposit for residential customers who have not been dis- connected for nonpayment shall be thirty dollars ($30.00). Each family living unit shall be considered to be a sepa- rate water and/or sewer customer. The deposit shall be thirty dollars($30.00)per unit. (b) Deposits for commercial customers shall not be less than fifty dollars ($50.00) and shall be calculated to equal the multiple of five dollars($5.00) nearest the estimated aver- age monthly billing for the particular type of customer Supp.No. 17 1163 § 16-22 EULESS CODE § 16-23 involved. Calculation shall be based on water, sewer and garbage monthly billing. (c) Deposits shall be refunded,or, in the event a balance is due, applied against the final bill for services required upon termination of the contract. The city will not pay interest on meter deposit funds. (Ord. No. 795, §§ 3.2(3.2.1), 3.3(3.3.1), 6-12-84) Sec. 16-23. Schedule of monthly rates. The schedule of monthly rates for water, sewer, abnormal sew- age surcharge, and industrial cost recovery charge shall be ac- cording to the following: Water Services for All Users (a) Within corporate limits, $3.50 plus $1.25 per thousand gallons thereafter. (b) Outside corporate limits, $10.00 per $1.25 per thousand gallons thereafter. Sewer Service—Residential The sewer service charge for residential customers shall be based on ninety (90) per cent of metered water. Sewer service charges on ninety (90) per cent metered water shall not exceed twelve thousand (12,000) gallons per billing period per living unit.The monthly minimum per dwelling unit shall be as follows: (a) Within the corporate limits,three dollars and twenty cents ($3.20) plus one dollar and five cents ($1.05) per one thou- sand (1,000) gallons of ninety (90) per cent of metered water. (b) Outside the corporate limits, eight dollars($8.00)plus one dollar and five cents ($1.05) per one thousand (1,000) gal- lons of ninety (90) per cent of metered water. Sewer Service—Commercial and Industrial Commercial and industrial sewer charges shall be based on one hundred (100) per cent of metered water. The rates are: monthly minimum within city limits—three dollars and twenty cents($3.20) sum). No. 17 1164 § 16-23 WATER AND SEWERS § 16-25 plus one dollar and five cents ($1.05) per one thousand (1,000) gallons;monthly minimum outside city limits—eight dollars($8.00) plus one dollar and five cents ($1.05) per one thousand (1,000) gallons of metered water. The following provisions apply to all commercial and industrial customers: (a) Customers that show proof that a significant portion of metered water does not enter the sanitary sewer shall not be billed for that portion that does not enter sanitary sewer. (b) Monitored group class customers shall be billed according to Section 16-25. (c) Industrial cost recovery group customers shall be billed according to Section 16-25 plus the additional charges in Section 16-26 as required. The above rates are based on the cost of treated water pur- chased by the city from the Trinity River Authority of Texas equal to eighty-seven cents ($0.87) per thousand gallons (cost of water purchased during 1984-85 fiscal year). As the cost of treated water purchased by the city from the Trinity River Authority of Texas increases from time to time, the charge per thousand gal- lons usage shall be increased by a like amount effective concur- rent with such increased charge to the city.The minimum charge and/or usage charge may be further adjusted by the city council from time to time. (Ord. No. 795, § 3.4(3.4.2)—(3.4.4), 6-12-84; Ord. No. 867, § 2, 11-26-85) Sec. 16-24. Reconnection of service. Where services have been disconnected for nonpayment, there shall be a five dollar ($5.00) charge for reconnection and five dollar($5.00)additional deposit, and full payment of outstanding bill before reconnection of service. (Ord. No. 795, § 3.3(3.3.5), 6-12-84) Sec. 16-25. Monitored group class. (a) The superintendent shall establish a monitored group class,con- sisting of those customers whose wastewater strength is, in his Supp. No. 17 1165 § 16-25 EULESS CODE § 16-26 judgement, abnormally high or low, and charges to customers in this class shall be computed in accord with the following five-part rate schedule: Customer monthly service charge $3.20 Volume charge 1.05 per 1,000 gallons BOD. Strength charge 0.0392 per pound of BOD. Suspended solids strength charge . . . . 0.0139 per pound of sus- pended solids. Monitoring charge 100%of total cost to city. (b) The monitoring charge shall consist of all cost for person- nel, material and equipment used to collect and analyze samples from the customer's wastewater to determine the strength of the wastewater produced. The monitored customer's wastewater shall be tested a minimum of once per year, but may be tested on a more frequent basis if deemed necessary by the superintendent or if the mentioned customer requests more frequent testing. (c) This schedule shall replace all other charges previously made for industrial waste strength. (Ord. No. 795, § 3.5(3.5.1), 6-12-84) Sec. 16-26. Industrial cost recovery. (a) Construction. costs. In providing a waste treatment system which includes the treatment of industrial wastes, either inde- pendently or in conjunction with other wastes, the Euless Water Department shall have the authority to collect from such indus- trial users all or any part of the construction costs of such waste treatment system reasonably attributed to such industrial wastes. The apportionment of such costs shall be equitable as among industrial users, and such costs may be collected by assessment, connection fee,periodic charges,or in other manners or combina- tions thereof as in the judgment of the director of public works is equitable and will assure such industrial cost recovery.
