IN GENERAL Sec. 2-1. Planning and zoning commission—Created,mem- bership. There is created and established for the city a planning and zoning commission, which shall be composed of seven (7) mem- bers.The members shall be resident citizens,taxpayers and qual- ified voters of the city, all of whom shall be appointed by the governing body, to serve for terms of two(2)years. All vacancies shall be filled for the unexpired term in the same manner as provided for the original appointments. Members of the commis- sion may be removed by the mayor, with the consent of the governing body, after public hearing and for cause assigned in writing. The members of the commission shall serve without compensation. (Ord. No. 32, § 1, 3-19-55) Charter reference—See Art.X, § 1. Sec. 2-2. Same—Organization. The planning and zoning commission shall elect a chairman, vice-chairman and a secretary from its membership and shall have power to employ such qualified persons as may be necessary for the proper conduct and undertakings of the commission and to pay for their services and such other necessary expenses; pro- vided, the cost of such services and expenses shall not exceed the amount appropriated by the governing body for the use of the commission. It shall also have the power to make rules, regula- tions and bylaws for its own government, which shall conform as nearly as possible with those governing the city council, and Supp.No.24 153 §2-2 EULESS CODE §2-4 same shall be subject to approval by such council. Such bylaws shall include, among other items, provisions for: (1) Regular and special meetings, open to the public; (2) Records of its proceedings,to be open for inspection by the public; (3) Reporting to the governing body and the public,from time to time and annually; (4) For the holding of public hearings on its recommendations. (Ord. No. 32, § 2, 3-19-55) Sec. 2-3. Same—Powers and duties. The planning and zoning commission shall have the power and it shall be its duty to make and recommend for adoption a master plan, as a whole or in parts, for the future development and redevelopment of the municipality and its environs and shall have power and it shall be its duty to prepare a comprehensive plan for zoning the city in accordance with article 1011a through 1011j, Vernon's Texas Civil Statues. The commission shall per- form such other duties as may be prescribed by ordinances of the city and laws of the state. (Ord. No. 32, § 3, 3-19-55) Charter reference—See Art.X,§2. Sec. 2-4. Mutual law enforcement assistance—Assignment of police of this city authorized. Pursuant to the provisions of article 99b,Vernon's Texas Civil Statutes, the chief of police is authorized to assign the regularly employed law enforcement personnel of his department to assist any other county or municipality in this state, when a state of civil emergency in such county or municipality has been declared by proper authority, upon request by such proper authority, and when, in the opinion of such proper authority, a need exists in such other county or municipality for the services of additional law enforcement officers to protect the health, life and property of such other county or municipality, its inhabitants, and the visitors thereto, by reason of riot, unlawful assembly character- ized by the use of Supp.No.24 154 §2-119 ADMINISTRATION §2-172 Sec. 2-119. No creation of cause of action. Nothing contained in this plan shall be construed as creating a right or cause of action against a plan member nor giving a right to a third party to institute or maintain a suit which would not otherwise exist under law as a legal claim against a plan mem- ber. Permit—Required;fees. (a) No person shall move any building or other structure within or through the limits of the city upon the streets, alleys, avenues or public grounds,without first having secured a permit from the city secretary authorizing the same; provided, no such permit shall issue for the moving of a structure or building into the city for reconstruction therein unless the owner thereof or his agent first secures a building permit for such construction. (b) The applicant, hereinafter called "mover," shall pay for said permit a fee or fees as set forth in Chapter 11 of this Code for each day or fraction thereof that the structure or building is in or on the streets, alleys, avenues or public grounds. (Ord. No. 59, § I, 1-12-57; Ord. No. 1005, § 4, 6-27-89) Sec. 4-21. Same—Bond;arrangement with utility companies. Before such permit is granted by the city secretary,the party apply- ing therefor shall give a surety bond payable to the city,in the sum of one thousand dollars($1,000.00),executed by a surety company au- thorized to do business in the state,to be approved by the city secre- tary and city attorney,conditioned among other things that said party will save,indemnify and keep harmless the city against all liabilities, Supp.No.24 284 § 4-21 BUILDINGS AND STRUCTURES §4-25 judgments, costs and expenses which may in any way accrue against the city in consequence of the granting of the permit. The city secretary may refuse to issue a removal permit in a case where such work will necessitate the removal or cutting of any wires belonging to a public utility company, or to the city, until such time as the party making application for such permit shall have made satisfactory arrangements with the, parties owning or controlling such wires, whether by written agreement or by depositing with said company a sufficient amount of money to cover the cost of such work, for cutting and replacing the wires so moved or cut, to the satisfaction of the parties owning or controlling same. (Ord. No. 59, § II, 1-12-57) Sec. 4-22. Same—Contents. A permit issued by the city secretary to a house mover shall state specifically all the conditions to be complied with in moving, shall designate the route to be taken and shall limit the time for removal. (Ord. No. 59, § III, 1-12-57) Sec. 4-23. Same—Denial for dangerous structures. If the chief of police deems it unsafe or dangerous to the public to move any building or other structure over public roads or grounds, on account of the condition of said building or structure, no permit shall be issued for said moving. (Ord. No. 59, § V, 1-12-57) Sec. 4-24. Use of designated route. In no case shall the streets, alleys, avenues or public grounds be used for the purpose of moving a building or structure except on a route designated by the chief of police. (Ord. No. 59, § III, 1-12-57) Sec. 4-25. Continuous operation; precautions at night. The removal of a building or other structure under a permit, when commenced, shall be continuous during all the hours of the day, and day by day, and at night if required by the chief Supp.No.24 285 § 4-25 EULESS CODE § 4-29 of police, until completed, and shall be carried on with the least possible obstruction to the thoroughfares occupied. No building shall be allowed to remain overnight upon any street crossing or intersection, or in such position as to prevent easy access to any fire hydrant. Lighted lanterns shall be kept in conspicuous places at each end and in the center of said build- ing on all sides during the night. (Ord. No. 59, § IV, 1-12-57) Sec. 4-26. Report of position of structure at night. Every mover shall report to the chief of police each night, the exact location the structure is to stand on the streets for the night. Failure to report this shall be considered a misde- meanor. (Ord. No. 59, § VII, 1-12-57) Sec. 4-27. Clearing obstructions on completion. Upon the expiration of the time named in the permit, or sooner if the use of the streets, alleys, avenues or public grounds is no longer necessary, the mover shall clear same of all obstructions. (Ord. No. 59, § II, 1-12-57) Sec. 4-28. Care in carrying out operation. All movers shall proceed in a careful manner with the re- moval of a building or other structure over a public street, alley, avenue or public grounds and shall not in any manner interfere with the private property of individuals. The chief of police shall have the power to revoke any permit whenever in his judgment any mover is proceeding in a reckless and careless manner in the removal of a building. (Ord. No. 59, § VIII, 1-12-57) Sec. 4-29. Repair of streets,etc. Every person receiving a permit from the city secretary to move a building or other structure shall, within one day after said building or other structure reaches its destination, report that fact to the chief of police, who shall thereupon in- spect the streets, alleys, avenues or public grounds over which said structure has been moved and ascertain the condition Supp.No.24 286 § 4-29 BUILDINGS AND STRUCTURES §4-69 thereof. If the removal has caused any damage to the streets, alleys, avenues or public grounds, the mover shall forthwith replace the same in as good repair as they were before the permit was granted. Upon his failure to do so within ten (10) days thereafter, to the satisfaction of the chief of police, he shall cause the damage done to the streets, alleys, avenues or public grounds to be repaired and hold the mover and the sure- ties of the bonds given by said mover responsible for the pay- ment of same.
