HomeMy WebLinkAbout2020-01-07 CITY OF EULESS PLANNING AND ZONING COMMISSION JANUARY 7, 2020 MINUTES A regular meeting of the Planning and Zoning Commission was called to order by Chairman Richard McNeese at 5:30 p.m. on January 7, 2020, in the Pre-Council Room of City Hall, 201 North Ector Drive. Those present included Chairman Richard McNeese, Vice Chairman LuAnn Portugal, and Commission Members: Curtis Brown, Ronald Dunckel, Steve Ellis, and Warren Wilson. During the Pre-Session Meeting: Senior Planner Stephen Cook reviewed the regular agenda. PLANNING AND ZONING CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The Euless Planning and Zoning Commission continued their meeting in the Council Chambers at 6:30 p.m. for consideration of scheduled items. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Vice Chairman Portugal made a motion to approve the minutes for the regular meeting of November 19, 2019. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, and Wilson. (6-0-0) ITEM 2. HELD A PUBLIC HEARING FOR PLANNED DEVELOPMENT CASE NO. 19- 04-PD AND RECOMMENDED AN ORDINANCE Chairman McNeese opened the public hearing at 6:38 p.m. Stephen Cook gave a brief description of the case. The applicant's request is to rezone 4.06 acres of land located at northwest corner of Mid-Cities Boulevard and N. Main Street that is currently zoned Community Business District (C-2) to a Planned Development zoning district. The new zoning would allow single-family detached dwellings. Mr. Brodsky has owned property along Mid-Cities Boulevard for several decades. In the early 1980's, he donated right of way for the widening of Mid-Cities Boulevard that was completed in the early 2000's. The subject parcel, which had previously been zoned Planned Development (PD), was rezoned to the Community Business (C-2) District by Ordinance 717 (No. 82-37-ZC) in 1982. After the right of way donation, the rezoning to C-2 enabled his property to be maintained as commercial along the future alignment of what would become Mid-Cities Boulevard. In the intervening thirty-eight (38) years, the area surrounding the subject property has been developed with primarily residential projects, including the McCormick property on both sides of Mid-Cities Blvd., the adjacent Running Bear Estates, as well as the development of the Bear Creek Elementary School. There have been no viable commercial development prospects for this property in at least nineteen (19) years. The proposed project would create sixteen (16) residential lots with the front of the homes facing internally to a cul-de-sac development. There will also be two (2) open space lots facing onto Mid-Cities Boulevard. The intent is to preserve several of the existing trees within the open space lots. A primary goal of the Planned Development is to create a subdivision that matches the development standards of the R-1 L zoning district. The lots will have an average size over 7,549 square feet, with a minimum lot size of 5,500 SF. The front setback is set at thirteen (13) feet, but requires a garage setback of twenty-two (22) feet to accommodate vehic►es in front of a sidewalk on the driveway. The homes will have a minimum square footage of 1 ,850 square feet. A section on tree preservation and protection through the development process has been included in the Planned Development ordinance to ensure appropriate precautions for the saving of existing trees on the property. A city-maintained cul-de-sac designed to City of Euless standards will provide access into the subdivision. The street width conforms to the City's standards. However, the internal radii at the curve is increased and a "No Parking" area established on the internal curve of the future street to enhance the emergency access into the cul-de-sac. Planning and Zoning Commission Minutes Page 3 of 6 January 7, 2020 An HOA maintained six (6) foot masonry screening wall will be installed that will parallel Mid- Cites Boulevard and N. Main Street. A small section of ornamental iron fencing will be installed in the cul-de-sac that will provide pedestrian access to the public sidewalk. Architectural standards established in the PD ordinance requires no repetition of building facades within four units, and a minimum 8/12 roof pitch. A combination of stucco, stone, and brick, with wood finish garage doors will used in the construction of the homes. Staff recommends approval of the Planned Development Ordinance. Mr. Cook introduced the applicant, Mr. Curtis Young, and stated that he would like to address the Commission. Mr. Curtis Young, representative for the Sage Group, was asked to step forward and speak about the case. Mr. Young stated that he and his staff have worked for several months to develop this project into a great addition to the City of Euless. The intersection into the development was moved so that it would be further away from the intersection of Mid-Cities and N. Main and worked well with the topography of the area. The major concept of the project is to put the majority of the homes on the north side of the property. This design would allow for a large open area for the residents to use for recreational purposes and create a focal area for the community. Mr. Young also stated that they are requesting for a slight variation change to the front set back. This would allow room for a porch in the front of the house and so cars may park in the driveway and not block the sidewalks. He also stated that the articulated front elevation shown in the PD would give a better streetscape look to the development instead of a flat front. Chairman McNeese asked to hear from those that are for the case to speak. Mr. Doug Terry, Century 21 Judge Fite Realtor, read a letter from the seller. The letter stated that Mr. Fred Brodsky, the property owner, has owned the property for over 30 years and is in support of the proposed zoning change. Mr. David Hettick, neighboring Ridgecrest Estates HOA President, voiced his support for the case and felt that this development would help in increasing the value of the homes in the area. Chairman McNeese asked if there were any others wishing to speak in favor of this case. Seeing none, Chairman McNeese asked to hear from those who are opposed to the case. Mr. Charles Brockett, resident at 105 Pinion Dr, Euless, came forward to oppose the residential development. He is opposed to having two story homes in the subdivision because of the lack of privacy it would cause to his property that is adjoining this new development. Chairman McNeese asked Mr. Young to step forward and give some input to Mr. Brockett's concern. Mr. Young stated that the developers were aware of the privacy concerns and designed the homes to help with this issue. A regulation was placed in this PD that would not allow view level Planning and Zoning Commission Minutes Page 4 of 6 January 7, 2020 windows on the second floor of the rear side of the homes which face Pinion Dr. Any window on the second story would be required to be 6 feet or higher; which would block the view of the neighbor's backyard. Mr. Franklin Leonard, resident at 102 Pinion Dr, Euless, also opposes the development and agreed with Mr. Brockett's view on the lack of privacy. His other concern was about the time frame of construction and the noise levels. He also pointed out that he is not in favor homes being built on every square inch of land within the city and hopes that nothing is done to change Bob Eden Park. Chairman McNeese thanked the audience for their comments. He also pointed out that because Euless is located between Dallas and Fort Worth it makes an excellent location for development. The current land owner has been the owner for many years and has maintained the property well. The property being developed for new homes, as opposed to a convenience store, would only complement the area. Chairman McNeese asked Mr. Young to please step forward and address the construction and noise levels this development would create. Mr. Young explained that on a typical home development, construction of the site development (utilities and streets) would most likely be about 6 months to a year. Homes are selling well in the area and the developer is projecting the homes in this development to sell within a year or two. Mr. Mike Collins, Director of Planning and Economic Development, responded to Mr. Leonard's concern about the construction and noise levels. Mr. Collins stated that the city's noise ordinances would allow the contractors to work from 7 a.m. to 7 p.m. Monday — Friday. To work on the weekends, special permission will be required from Mr. Hal Cranor, Director of Public Works and Engineering. This special weekend permission would allow the contractors to begin laying the underground utilities and complete the grading of the lots. Once the vertical building of the outside of the homes begins the city strictly enforces no working on the weekends. When the exterior of the home is completely finished and all work has turned on the interior of the home, the contractors may be allowed to work on the weekends. Mr. Collins made a point to mention again the verbiage of the PD Ordinance that pertained to the windows on the two story homes. The ordinance states that any second story window facing the existing homes to the north shall either be frosted (or translucent) or be located at least 6 feet above the floor level. Chairman McNeese asked if there were any others wishing to speak against this case. Seeing none, Chairman McNeese closed the public hearing at 6:57 p.m. Commissioner Wilson commented on the beautiful homes that were presented and wished the project good luck. Commissioner Ellis voiced his appreciation to the developers for setting the building standards according to the Ordinances that were presented. Planning and Zoning Commission Minutes Page 5 of 6 January 7, 2020 Commissioner Dunckel asked Mr. Young if this development was going to have a Home Owners Association (HOA) and if so, would it be responsible to maintain the open spaces. Mr. Young confirmed that there will be an HOA, where the residents will be required to pay dues that would maintain the open spaces of the development. Mr. Collins also noted that the masonry screening wall will also be maintained by said HOA. Vice Chairman Portugal thanked the deve►opers for thinking about the surrounding home owners' privacy by keeping the existing tree line between the new homes and neighboring homes. Commissioner Brown commented that this new development complements the surrounding neighborhoods very well and would be a nice addition to the corner of Mid-Cities and N. Main. There were no further questions or comments presented by the Commission. Commissioner Wilson made a motion to approve Case No. 19-04-PD for a Planned Development to change the zoning of 4.06 acres in the Franklin, Levy Survey, Abstract 513, Tract 2G located at the northwest corner of Mid-Cities Boulevard and N. Main Street from Community Business (C-2), to Planned Development (PD) zoning to allow single family residential, and consider recommendation for an Ordinance. Commissioner Ellis seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (6-0-0) ITEM 3. APPROVED FINAL PLAT CASE NO. 19-16-FP Senior Planner Stephen Cook gave a brief description of the case. A final plat establishes the appropriate easements for the development and enables the required public infrastructure to be constructed in the future. The final plat conforms to the standards of the zoning district. The Development Services Group (DSG) has reviewed and certified the application has met a►► of the information required for consideration by the City of Euless. Staff recommends approval of the final plat. There were no questions or comments presented by the Commission. Commissioner Dunckel made a motion to approve Case No. 19-16-FP for a Final Plat to be located on 1.047 acres out of the J. Doss Survey, Abstract No. 441, to be platted as Glade Parks Addition, Block C, Lot 3, 2501 State Highway 121. Commissioner Wilson seconded the motion.
