ORDINANCE NO. 2237 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE, AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON 4.06 ACRES IN THE FRANKLIN, LEVY SURVEY, ABSTRACT NO. 513, TRACT 2G, BY CHANGING THE ZONING FROM COMMUNITY BUSINESS (C-2) DISTRICT ZONING INTO PLANNED DEVELOPMENT (PD) DISTRICT ZONING AS DESCRIBED HEREIN AND ON THE ATTACHED EXHIBIT A; PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the Planning and Zoning Commission has conducted a public hearing on January 7, 2020 in conjunction with Zoning Case No. 19-04-PD, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, the City Council has conducted a public hearing on January 28, 2020 considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of 4.06 acres in the Franklin, Levy Survey, Abstract No. 513, Tract 2G, is changed from Community Business (C-2) District zoning into Planned Development (PD) District zoning As Described Herein and on the Attached Exhibit A. Said property described above shall be subject to all the safeguards and conditions set forth on said Exhibit A or stipulated herein. Said Exhibit A shall be applicable only to the property described in herein. SECTION 2. DEVELOPMENT STANDARDS. It is hereby declared that the following development standards shall be applicable to the Planned Development zoning district. All other development standards to residential development within the City of Euless Unified Development Code (Chapter 84 City of Euless Code of Ordinances) are applicable to this Planned Development with the exception of the following: A. Density: There shall be a maximum of 16 Single-Family Residential Lots on the 4.06 acres within the Bear Park Estates development, along with 0.51 acres of usable open space, resulting in an overall maximum density of 4.43 units per acre. B. Lot Sizes: The lot sizes within Bear Park Estates shall be as follows: Lot Type R-1 L PD Minimum Lot Area 5,500 SF Average Lot Area 7,549 SF Minimum Lot Width 50' Minimum Lot Depth 105' C.Setbacks and Lot Coverage: The setbacks and lot coverage criteria for Bear Park Estates are as follows: Lot Type R-1 L PD Front Yard Setback 13' FY ;Garage 22" Garage Side Yard Setback 5' Street Side Setback 15' Rear Yard Setback 15' :Max. Lot Coverage* 50% *Lot Coverage defined as percentage of site within the perimeter walls of all structures. Maximum overall Impervious Coverage of all lots shall be limited to 75% of the total lot area. D. Minimum Home Area: There shall be the following minimum area for single family residential homes built within this Planned Development: Lot Type R-1 L PD Minimum Home Area 1,850 s.f. E. Maximum Height: The maximum height of all homes in Bear Park Estates shall be two and one- half stories, or thirty-five (35') feet. F. Open Space: The defining feature of the Bear Park Estates community will be the internal preserved Open Space area. Over thirteen (13%) percent of the site will be dedicated to Open Space. All streets adjacent to the open space lots will be tree-lined, and every attempt will be made to save quality existing trees within these areas. All open space areas will be fully maintained by the Bear Park Estates Homeowners Association. Ordinance No, 2237, Page 2 of 10 G.Street Standards: All streets in Bear Park Estates will be constructed within public right of ways, of concrete and built to meet City of Euless standards. The street shall be no less than thirty one (31') feet back of curb to back of curb wide (in a 50' ROW). A "No Parking" area at the turn will be implemented to address the required space for unobstructed Fire Truck access, as indicated on the Site Plan within "Exhibit A". H.Sidewalks and Trails: A five (5') foot sidewalk shall be built by the homebuilder in the right-of-way (ROW) of the adjacent street as the homes are built. The Developer shall be responsible to build sidewalk along the open space lot, and along Mid-Cities Blvd. and Main Street. I. Parking: A minimum of four (4) off-street parking spaces will be provided on each lot, two (2) within an enclosed garage and two (2) within a driveway on the lot. J. Lot Grading: All lots shall be graded to meet minimum City of Euless standards. K. Tree Preservation: Every attempt will be made to save existing quality trees on the site, where feasible. The following requirements shall apply: a. Unless otherwise exempted by this Ordinance, the following procedures shall apply to protect any tree which will be preserved within this development. b. All persons submitting construction plans shall insure that such plans comply with the requirements of this Ordinance. c. The following activities are prohibited within the limits of the critical root zone of any protected tree subject to the provisions of this Ordinance. i. Material Storage: No storage or placement of materials intended for use in construction or waste materials accumulated due to excavation or demolition shall be placed within the limits of the critical root zone of any protected tree. ii. Equipment Cleaning/ Liquid Disposal: No equipment shall be cleaned or other liquids, including, without limitation, paint, oil, solvents, asphalt, concrete, mortar or similar materials deposited or allowed to flow into the critical root zone of a protected tree. iii. Tree Attachments: No signs, wires or other attachments, other than those of a protective nature, shall be attached to any protected tree. iv. Vehicular Traffic: No vehicular and/ or construction equipment traffic or parking shall take place within the critical root zone of any protected tree other than on existing street pavement. This restriction does not apply to single incident access within the critical root zone for purposes of establishing the building pad and associated lot grading, vehicular traffic necessary for routine utility maintenance, emergency restoration of utility service, or routine mowing operations. v. Impervious Paving: No paving with asphalt, concrete or other impervious materials shall be placed within the limits of the critical root zone of a protected tree except as otherwise allowed in this Ordinance. vi. No heavy equipment, including but not limited to trucks, tractors, trailers, bulldozers, bobcat tractors, trenchers, compressors, and Ordinance No. 2237, Page 3 of 10 hoists, shall be allowed inside the drip- line of any protected tree on any construction site without prior written approval of the Building Official. d. The following procedures shall be followed on all types of construction projects( including residential, land development, municipal/ public domain projects): e. Protective Fencing: Prior to the issuance of any building or earth disturbance permit, or commencing construction, the owner, contractor or subcontractor shall construct and maintain, for each protected tree on a construction site, protective fencing which encircles the outer limits of the critical root zone of the tree to protect it from construction activity or in cases of heavily wooded sites, as approved by the Building Official. i. All protective fencing shall be in place prior to commencement of any site work and remain in place until all exterior construction activity at the site has been completed. ii. Protective fencing shall be at least four (4) feet high, clearly visible, and shall have a tree protection sign affixed to the fence every twenty (20) feet in such a manner to be clearly visible to workers on the site. iii. The use of orange vinyl construction fencing or other similar fencing is generally permitted only if there is no construction or vehicular activity within ten (10) feet of the fence. If construction activity or vehicular traffic is expected within ten (10) feet of the fence, the fence shall be constructed of chain link or other similar metal, wooden material or semi- rigid vinyl tape fencing supported with a top support wire or equivalent support material affixed to metal or wooden posts, all of which shall be six (6) feet in height. iv. All protective fencing shall be supported at a maximum of ten (10) foot intervals by approved methods sufficient enough to keep the fence upright and in place for the duration of the construction. v. The owner shall cause the required fencing to be installed and maintained for the duration of the construction. vi. For permits involving trenching such as sewer services, irrigation systems or underground electrical work, the applicant shall provide sufficient plans to provide protection of the trees in the vicinity of thework. vii. All of the above conditions must adhere to and be inspected by a City inspector prior to the issuance of any building or earth disturbance permit. viii. In situations where a protected tree remains in the immediate area of intended construction and the Building Official determines the tree bark to be in danger of damage by construction equipment or other activity, the contractor or subcontractor shall protect the tree by enclosing the entire circumference of the tree trunk with two (2) inches x four(4) inches lumber encircled with wire or other means that do not damage the tree. The intent is to protect the bark of the tree against incidental contact by large construction equipment. The contractors shall comply with the requirements of this Ordinance regarding bark protection. Ordinance No. 2237, Page 4 of 10 f. Construction Methods: i. Boring: Boring of utilities under the critical root zone of a protected tree shall be required in those circumstances where it is not possible to trench around the critical root zone of the protected tree. When required, the bore shall be a minimum depth of forty- eight (48) inches. ii. Trenching: No trenching shall cross the critical root zone of any protected tree, unless approved in writing by the Building Official. The placement of underground utility lines is encouraged to be located outside of the critical root zone of protected trees. Irrigation system lines shall be placed outside of the critical root zone, except the minimum number of single head supply lines required to irrigate within the critical root zone. Any such irrigation line shall be installed along a horizontal line that bisects the tree trunk, in the manner that has the least possible encroachment into the critical root zone, and that extends no further into the critical root zone as is necessary to provide proper irrigation. iii. Root Pruning: All roots two inches or larger in diameter which are exposed as a result of trenching or other excavation shall be cut off square with a sharp medium tooth saw and covered with pruning compound within two hours of initial exposure. L. Fencing: All perimeter fencing will be as shown on the Fencing Plan. All lots backing to open space lots shall be fenced with a six (6') high ornamental metal fence. All front yard fences, parallel to the ROW, shall also be of six (6') ornamental metal. Fencing between lots shall be six (6') high, stained cedar wood fence, with a cap. M.Entryways: The primary project entry shall be from Mid-Cities Blvd. Entry signage/ masonry walls/ fences will be built at each entry, and such entries will be fully landscaped with turf, trees, shrubbery and will be irrigated. The entry areas will be fully maintained by the Bear Park Estates Homeowners Association. N. Prohibition of Building Repetition: The same building elevation and/or color palette shall not be repeated on the adjacent four (4) neighboring lots and the lots across the street from those lots. A change in elevation can be achieved by either two (2) of the three (3) following: a. The use of different materials (i.e. a change in brick or stone color, or type), b. A varied window pattern(arched, peaked, flat, eyebrow, etc.) or; c. A change to eave, roof or fenestration configuration; or a completely different elevation design and layout using similar materials. O.Exterior Materials: All exteriors of the homes constructed within the subdivision shall be constructed of brick, stone, or true, three-part stucco materials, exclusive of doors and windows. P.Windows: Low E vinyl windows. All front elevation windows shall be divided unless an alternative is dictated by architectural style. For all homes backing to the northern Ordinance No. 2237, Page 5 of 10 boundary of the project, any second floor window facing the existing homes to the north shall either be frosted (translucent only) or be located at least six (6') feet above the floor level. Q.Front Door: Minimum eight (8') feet height, decorative architectural style. R. Driveways and Walkups: Salt finished, brushed concrete or exposed aggregate. S. Roof Pitch: Minimum roof pitches shall be 8:12, unless architectural style dictates otherwise. No flat roofs shall be allowed. T. Roof Material: Forty (40) year, high performance composite roof, or metal standing seam, or tile. U.Mailboxes: Mailboxes shall be located at a "Cluster Mailbox" location, as indicated on the plan. V. Mechanical Equipment: All mechanical equipment, such as HVAC condensers, shall be located away from the street-side elevation, and screened from view from either the streets or open space areas with a minimum of fourteen (14) shrubs. W. Retaining Walls: All retaining walls shall be constructed of reinforced concrete, natural stone or engineered stone. Wooden retaining walls are not permitted. X. Landscaping: All lots shall be fully landscaped with a combination of trees, shrubs, flowering plants and turf grass. All beds shall be mulched with natural materials, and be edged with metal, stone or brick. Each home will be required to have at least one(1) 3-1/2" caliper shade tree planted in the front yard, in addition to the Street Trees indicated on the Landscape Plan, and a minimum of fourteen (14) shrubs. An automatic irrigation system is required for all landscaped areas visible from the right- of-way, open spaces and other private properties adjacent to Bear Park Estates. SECTION 3. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment ordecree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 4. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon Ordinance No. 2237, Page 6 of 10 conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 5. SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly saved as to any and all violations of the provisions of the Euless Unified Development Code applicable to the Property that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 6. PUBLICATION CLAUSE. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12 of the Euless City Charter. SECTION 7. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
