HomeMy WebLinkAbout2020-03-03 CITY OF EULESS PLANNING AND ZONING COMMISSION MARCH 3, 2020 MINUTES A regular meeting of the Planning and Zoning Commission was called to order by Chairman Richard McNeese at 5:30 p.m. on March 3, 2020, in the Pre-Council Room of City Hall, 201 North Ector Drive. Those present included Chairman Richard McNeese, Vice Chairman LuAnn Portugal, and Commission Members: Curtis Brown, Ronald Dunckel, Steve Ellis, Eric Owens, and Warren Wilson. During the Pre-Session Meeting: ➢ Senior Planner Stephen Cook reviewed the regular agenda. PLANNING AND ZONING CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The Euless Planning and Zoning Commission continued their meeting in the Council Chambers at 6:33 p.m. for consideration of scheduled items. APPROVED PLANNING AND ZONING MINUTES Planning and Zoning Commission Minutes Page 1 of 7 March 3, 2020 Planning and Zoning Commission Minutes Page 2 of 7 March 3, 2020 Commissioner Ellis made a motion to approve the minutes for the regular meeting of February 4, 2020. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens, and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 2. HELD A PUBLIC HEARING FOR PLANNED DEVELOPMENT CASE NO. 20- 01-PD AND RECOMMENDED AN ORDIANCE Chairman McNeese opened the public hearing at 6:38 p.m. Stephen Cook gave a brief description of the case. During 2009, the Nepali Cultural Center purchased frontage property in the 2200 Block of W. Euless Boulevard just north of the Right Step center. After the purchase in 2009, the Nepali Cultural Center received approval of a Specific Use Permit to construct temples and a community center. Development of the project was put on hold while the community was building up resources for the construction. In the intervening period, the community purchased additional property. The purchases included the southwest corner of W. Euless Boulevard and Royal Parkway and the building located at 1212 Royal Parkway that had been a former manufacturing business. The development proposed with the rezoning of the property will be a two-phase project. Approval of the Planned Development zoning will enable conversion of the existing building to a community center and construction of the additional parking as the first phase of the project. The second phase will be the construction of a place of worship / assembly building, which will be developed after a site plan application is made to the city in the future. Phase one of the development will be to convert the manufacturing building into a community center. Offices, business incubator, classrooms, health and nutrition services, and a cafeteria for the community will be constructed within the building. Additional parking will be constructed with the first phase of the development, as well as sidewalks connecting the parking to the site. Phase two will be the construction of a 23,762 square foot cultural and spiritual center, which will be the foundation of the place of worship and include spaces for meditation, singing, ritual, and the primary inner sanctums for the practice of Hinduism and Buddhism. The new building will have temple spires similar to the original plan approved in 2009. Access to the site will be made in several locations. The existing building already has two access drive approaches from Royal Parkway. The construction of the new parking lot to the rear of the community center will enable an internal drive isle to connect to the phase two property. New parking at the corner of Royal Parkway and W. Euless Boulevard will be constructed with phase one and will include a new drive approach from Royal Parkway. The community has an agreement with the Right Step to utilize the drive from Euless Boulevard for access to the community's property that will be developed in phase 2. Euless Boulevard, with a variety of shrubs and flowering plants throughout the site to reflect the Place of Worship. Trees will also be planted along the parking areas. Chairman McNeese asked if the applicant wished to speak. Mr. David Rey, the project architect and representative for the Nepalese community, thanked the commission for considering their case. They look forward to investing into the community and the City of Euless. Chairman McNeese asked to hear from any proponents who wish to speak. Rabi Adhikari, member of the Nepalese community, came forward in favor of the case. He expressed their excitement at what this project will bring for the Nepalese community but for the city as well. This addition to the city would bring several new businesses and cultural restaurants that would result in new income for the City of Euless. Rabi Adhikari also thanked the commission for their consideration in the case. Chairman McNeese asked to hear from any opponents who wish to speak. Seeing none, Chairman McNeese closed the public hearing at 6:46 p.m. Commissioner Brown, who lives on the south side of Highway 10, welcomed the Nepalese community to the neighborhood. Vice Chairman Portugal stated that she was thrilled to see this project before the commission again and that it would be a great addition to the area. There were no further questions or comments presented by the Commission. Commissioner Brown made a motion to approve Case No. 20-01-PD for a request for Planned Development to change the zoning of approximately 7.8 acres in the Park Center Addition, Lots 1B and 1C, 2200 Block of W. Euless Boulevard and International Regional Industrial Complex, Portion of Block C and Block C, Lot 10, 1200 Block of Royal Parkway; from Texas Highway 10 Multi-Use (TX-10) zoning district to Planned Development (PD) zoning to allow Place of Worship and Community Center uses, and consider recommendation for an Ordinance. Vice Chairman Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 20-02- SUP AND RECOMMENDED AN ORDIANCE Chairman McNeese opened the public hearing at 6:47 p.m. Planning and Zoning Commission Minutes Page 4 of 7 March 3, 2020 Stephen Cook gave a brief description of the case. The Texas Highway 10 Multi Use zoning district requires a Specific Use Permit for all places of worship. The congregation Refuge Deliverance Center intends to lease 520 square feet of vacant office space at 1101 Royal Parkway, Suite 107. The building meets all code requirements for an assembly use. Vehicle access to the site is provided from W. Euless Blvd., as well as from Royal Parkway. Pastor Collins has written that the congregation is about six (6) people and would meet on Sunday mornings. The Development Services Group has reviewed and certified the application for a Specific Use Permit. Staff recommends approval with the following conditions: a. Tied to the church pastor: Bugless Collins b. Tied to the church name: Refuge Deliverance Center. c. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Chairman McNeese asked if the applicant wished to speak. Mr. Bugless Collins came forward to thank the commission for giving him the opportunity to serve the community and allowing him to have a place for those to come to and worship. Chairman McNeese asked to hear from any proponents/opponents who wish to speak. Seeing none, Chairman McNeese closed the public hearing at 6:49 p.m. There were no questions or comments presented by the Commission. Commissioner Wilson made a motion to approve Case No. 20-02-SUP for a Specific Use Permit on International Regional Industrial Complex, Block A, Lot B, 1101 Royal Parkway, Suite 107, for a Place of Worship in Texas Highway 10 Multi-Use District (TX-10) and consider recommendation for an Ordinance. Commissioner Ellis seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 4. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 20-03- SUP AND RECOMMENDED AN ORDIANCE Chairman McNeese opened the public hearing at 6:51 p.m. Stephen Cook gave a brief description of the case. The Neighborhood Business District requires a Specific Use Permit for all membership sports and recreation clubs. Mr. Hallford is the owner and instructor of Brazilian Jujitsu. Previously he has been leasing time with a martial arts studio located at 501 N. Main, and is wishing to operate within his own space. He intends to utilize Planning and Zoning Commission Minutes Page 5 of 7 March 3, 2020 1,850 square feet in a strip commercial center at 218 N. Main Street which had previously held a small retail operation. The applicant indicates that class sizes are under twenty people and that usually no more than fifteen vehicles would be onsite at any one time. The retail center has a donut shop and a beauty salon which operate during different hours of the day than the proposed use. Parking for the center includes 12-14 parking spaces along the front and south side of the building and open parking areas to the rear of the building. The building also shares cross access and parking with the cleaners and restaurant in the building to the north. The applicant intends that classes would be in the evenings when the other businesses immediately adjacent are not open or are closing for the day. No tournaments are planned at the facility which would increase the number of vehicles. The Development Services Group has reviewed and certified the application for a Specific Use Permit. Staff recommends approval with the following conditions: a. Tied to the business owner: Nathan Hallford b. Tied to the business name: Sloth BJJ. c. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Chairman McNeese asked if the applicant wished to speak. Mr. Nathan Hallford came forward and thanked the commission for consideration of his case. He also mentioned how some of the parents called into the city showing support and that they are very excited to be moving into the new space. Chairman McNeese responded with thanking Mr. Hallford for keeping his business in Euless and wished him good luck. Chairman McNeese asked to hear from any proponents/opponents who wish to speak. Seeing none, Chairman McNeese closed the public hearing at 6:53 p.m. Commissioner Wilson also thanked Mr. Hallford and wished him good luck. Vice Chairman Portugal also thanked and welcomed Mr. Hallford. Commissioner Owens asked Mr. Hollford how many students are currently enrolled in his school. Mr. Hallford responded with about 65 kids and adults combined. There were no further questions or comments presented by the Commission. Commissioner Owens made a motion to approve Case No. 20-03-SUP for a Specific Use Permit on Euless Gardens Block 2, Lot 3B, 218 N. Main Street for a Membership Sports and Recreation Club in Neighborhood Business District (C-1) and consider recommendation for an Ordinance. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens and Wilson. APPROVED FINAL PLAT CASE NO. 19-15-FP Stephen Cook gave a brief description of the case. A final plat establishes the appropriate easements for the development and enables the required public infrastructure to be constructed in the future. The final plat conforms to the standards of the zoning district. The Development Services Group (DSG) has reviewed and certified the application has met all of the information required for consideration by the City of Euless. Staff recommends approval of the final plat. There were no questions or comments presented by the Commission. Commissioner Dunckel made a motion to approve Case No. 19-15-FP for a Final Plat to be located on 1.8140 acres out of the J. Doss Survey, Abstract No. 441 , and Buffalo Bayou, Brazos and Colorado Railroad Company Survey, Abstract No. 204 to be platted as Glade Parks Addition, Block F, Lot 1 , 3801 Cheek-Sparger Road. Commissioner Wilson seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 6. APPROVED FINAL PLAT CASE NO. 19-17-FP Stephen Cook gave a brief description of the case. A final plat establishes the appropriate easements for the development and enables the required public infrastructure to be constructed in the future. The final plat is for two commercial lots containing hotels. The final plat conforms to the standards of the zoning district. The Development Services Group (DSG) has reviewed and certified the application has met all of the information required for consideration by the City of Euless. Staff recommends approval of the final plat. There were no questions or comments presented by the Commission. Vice Chairman Portugal made a motion to approve Case No. 19-17-FP for a Final Plat to be located on 5.562 acres out of the Bryant Harrington Survey, Abstract No. 808, and Levi Franklin Survey, Abstract No. 513 to be platted as Centurion Addition, Block B, Lots 1 & 2 and 2550 and 2570 State Highway 121 . Commissioner Wilson seconded the motion. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 7. APPROVED FINAL PLAT CASE NO. 19-06-RP Stephen Cook gave a brief description of the case. The applicant proposes to replat the above described property in order to consolidate property for the place of worship's facilities and set appropriate easements for the development. The Development Services Group (DSG) has reviewed and certified that the application has met all of the information required for consideration by the City of Euless. Staff recommends approval of the replat. There were no questions or comments presented by the Commission. Commissioner Ellis made a motion to approve Case No. 19-06-RP for a Replat to be located on 3.3 acres on Alexander & Cullum Subdivision Addition, Lots 20, 21 and a portion of Lot 22, replatted as Alexander & Cullum Subdivision, Lot 21 R, 200 E. Euless Boulevard. Commissioner Wilson seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Portugal and Commission Members: Brown, Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Chairman McNeese declared the motion carried. (7-0-0) ITEM 8. PUBLIC COMMENTS Mr. Mike Collins, Director of Planning and Economic Development, informed the Planning and Zoning Commission that Fire Marshal Paul Smith will be retiring and this meet would be his last. The commission congratulated Fire Marshal Smith for the years of service and stated that he will be missed. ITEM 9.
