A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS, POSTPONING THE GENERAL ELECTION FOR THE OFFICES
OF MAYOR AND CITY COUNCIL MEMBERS PLACE TWO AND PLACE
FOUR.
WHEREAS, pursuant to the Election Code of the State of Texas and the Euless City
Charter, on January 14, 2020, the City Council approved Resolution No. 20-1565 ordering
a General Election to be held May 2, 2020; and
WHEREAS, in accordance with Texas Government Code, Section 418.016, on
March 13, 2020, the Governor of Texas, Greg Abbott, certified that the novel coronavirus
(COVID-19) poses an imminent threat of disaster and, under the authority vested in the
Governor by Section 418.014 of the Texas Government Code, declared a state of disaster
for all counties in Texas; and
WHEREAS, on March 18, 2020, Governor Abbott issued a proclamation
suspending Sections 41.0052(a) and (b) of the Texas Election Code to the extent
necessary to allow political subdivisions that would otherwise hold elections on May 2,
2020, to move their general and special elections for 2020 only to the next uniform
election date, occurring on November 3, 2020, without otherwise adjusting the term of
office; and
WHEREAS, Governor Abbott additionally suspended Sections 31.093 and
42.0621(c) of the Texas Election Code to the extent necessary to require all county
election officers, if requested by an affected political subdivision, to enter into a contract
to furnish election services with any political subdivision who postponed their election to
November 3, 2020, under the authority of the proclamation; and
WHEREAS, a request has been made to the Governor to allow the postponement
of the May 2, 2020 election to another date prior to November 3, 2020.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS, THAT:
SECTION 1.
The City Council of the City of Euless, Texas, at a regular meeting held this date,
does hereby exercise the authority granted by the Governor of Texas to postpone the
election of officers for the City of Euless, Texas, until the first Tuesday in November, that
being November 3, 2020, for the purpose of electing a Mayor, one Council Member for Place
Two, and one Council Member for Place Four, who shall each serve for a period of three
years or until their successors have been duly qualified.
SECTION 2.
Pursuant to Election Advisory No. 2020-12, issued by the Texas Secretary of
State's Office on or about March 18, 2020, this Order also makes the following findings,
and incorporates them by reference into this Resolution:
(1) all candidate filings for the May 2, 2020, general election shall remain
valid for the November 3, 2020, general election;
(2) the filing period will not be re-opened for the November 3, 2020 general
election;
(3) all applications for a ballot by mail for voters who are voting by mail due
to being over the age of 65 or due to disability will remain valid for the
postponed election whereas all applications for a ballot by mail based
upon a voter's expected absence from the county will not be valid for the
postponed election; and
(4) the deadline for registration to vote in the November 3, 2020 election is
October 5, 2020; the deadline to submit an application for a ballot by mail
is October 23, 2020, and early voting will begin October 19, 2020, and
run through October 30, 2020.
SECTION 3.
The City Manager and the City Secretary, in consultation with the City Attorney, are
hereby authorized and directed to take any and all actions necessary to comply with the
provisions of the proclamation in carrying out and conducting the election, whether or not
expressly authorized herein.
SECTION 4.
In the event the Governor authorizes the postponement of the May 2, 2020 election
to another date prior to November 3, 2020, the city council reserves the right to amend this
Order and Resolution to authorize an alternative date for the election.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on
March 24, 2020, by a vote of 7 ayes, 0 nays, and 0 abstentions.
