HomeMy WebLinkAbout1992-06-16 CITY OF EULESS CIVIL SERVICE COMMISSION Jane 16, 1992 Special Meethyg MINUTES CALL TO ORDER A special open meeting of the Civil Service Commission to conduct a formal hearing of appeal by Police Officer, Michael Privitt was held on Tuesday, June 16, 1992 at 5:00 p.m. at 201 North Ector Drive, Euless, Texas. PRESENT Tommy Barnes, Civil Service Commission Chairman Willie Mae McCormick, Commissioner David Gilfillan, Commissioner Paul Wieneskie, City Attorney Tom Hart, City Manager Kay Godbey, Assistant City Manager Kenneth B. Fuller, Police Chief Debra Forte', Director Fiscal & Human Resources Ruth Alley, Personnel Manager Alice Cahill, Civil Service Secretary Michael Privitt, Police Officer Leonard Schilling, CLEAT Attorney for Michael Privitt Sgt. Harland Westmoreland Lt. Roger Mangum Officer Randy Burns I. INVOCATION Mr. TO my Barnes gave the invocation. II. APPROVAL OF MINUTES The Minutes of the June 2nd, 1992 Civil Service Special Meeting were approved as read. City of Euless Civil Service Hearing Minutes 06-16-92 Page 2 III. HEARING OF APPEAL Paul Wieneskie, City Attorney discussed the general rules of order for proceedings. Swearing in of witnesses: Lieutenant Roger Mangum Sergeant Harland Westmoreland Officer Randy Burns Mr. Leonard Schilling, the Attorney representing Officer Michael Privitt gave his opening statement for the employee. City Manager, Tbm Hart gave an opening statement for the City. Discussion of incident, questioning of Michael Privitt, and presentation of evidence by Leonard Schilling. The Chairman ordered a ten minute recess at 6:20 p.m. Upon reconvening, discussion and questioning by Kenneth Fuller followed. Discussion and questioning by Leonard Schilling. Discussion and questioning by Kenneth Fuller. Discussion and questioning by the Comission. Presentation of witness Officer Randy Burns. Discussion and questioning by Tbm Hart. The Commission ordered a ten minute recess at 7:40 p.m. Upon reconvening at 7:50 p.m. further discussion by Kenneth Fuller. Closing argument by Leonard Schilling. Mrs. McCormick questioned Michael Privitt. Closing argument by Tam Hart. Additional questions were asked of Kenneth Fuller by David Gilfillan. Presentation of evidence by Leonard Schilling to the Commission for review during Executive Session. City of Euless Civil Service Hearing Minutes 06-16-92 Page 3 Tommy Barnes asked Michael Privitt if he had any additional comments or statements he wished to make. Being there were no additional statements to be heard, the Chairman ordered the open meeting of the Civil Service Commission recessed to convene in Executive Session. IV. EXECUTIVE SESSION The Civil Service Commission convened in Executive Session on Tuesday, June 16, 1992 at 8:14 p.m. , pursuant to V.T.C.S. Art. 6252-17 Section 2(g) , for consideration of the appeal of Police Officer Michael Privitt. At 8:34 p.m. the Chairman declared a ten minute recess from Executive Session before reconvening in open session. V.REOONVENE OPEN SESSION The Civil Service Commission reconvened in open session at 8:44 p.m. to vote on the decision of the hearing. Mr. Barnes made a motion that the disciplinary action as amended by the City Manager, Tom Hart be upheld. David Gilfillan seconded the motion. Ayes: Tommy Barnes, David Gilfillan Noes: Willie Mae McCormick Mr. Barnes declared the motion carried. VI. OTHER BUSINESS A. The Commission scheduled Wednesday, July 1, 1992 at 11:30 a.m. to hold a workshop for final review of the Proposed Civil Service Rules & Regulations. A tentative date for presentation to City Council will be July 14, 1992. B. A proposed change in the Civil Service Rules and Regulations was submitted by Mark Lipman of the Fire Department. The City Manager's proposed policy was to read as follows: 4.36.B Grading Final grades for promotional examinations shall be structured and posted as follows: ' City of Euless Civil Service Hearing Minutes 06-16-92 Page 4 1. One-half (1/2) point for each full year of employment with the department in which the test is given for, up to five (5) points, will be added to the final overall score of the promotional examination. 2. A total of five (5) points for education: Five (5) points for Bachelors Degree Two and one-half (2 1/2) points for an Associates Degree OR sixty (60) hours at an accredited college or university. 3. A maximum of ten (10) points for seniority and education will be added to the final combined scores. mark Lipman's proposed charge would read as follows: 4.36.B. Grading 1.
