Call to Order The Civil Service Comission Policy Review Committee met in a regular meeting on Friday, August 9, 1991 at 9:00 a.m. in the downstairs Administration Building Conference Room. The July 12, 1991 Minutes were corrected as follows: Page 6 of July 12, 1991 Minutes - Section 10.20 ASP C: [Social Security - Regular full-time employees are not participants in the Federal Social Security System, except for MEDICARE deductions only, as of April 1, 1986. CHAPTER 9 - DIS IMAINE AM) APPEALS The Committee recommended Section 9.03 be approved to read as follows: Section 9.03 - Disciiplinffly Aaim In the interest of good discipline and efficiency, and for just cause, a 000X000 C/$00 [Manager or Director] may issue a verbal reprimand, written reprimand, demote an employee, suspend an employee without pay up to thirty (30) [calendar] days or terminate an employee. The cause for discipline B. The specific reason supporting the cause C. The discipline to be imposed D. The effective dates E. The right of the employee to appeal within ten [business] days The written disciplinary action shall be filed with the Personnel Department and a copy shall be served personally to the employee or mailed to him at his last ]mown address by certified mail, return receipt requested. If the disciplinary action takes the form of a verbal or written reprimand the ØpØ/ØØ/00 /O1 [disciplinary action form] should be used. The incidents leading up to the disciplinary action, the action taken at this time, and the employee's statement should be included on this 00000 /ono [disciplinary action form]. The employee must sign the Mg [form] and a copy must be sent to the Personnel Department. [If the employee refuses to sign the form it should be so stated on the form.] During investigation, hearing, or trial of an employee on any civil cause or criminal charge when suspension would be in the interest of the City, and employee may be suspended without pay for the duration of the proceedings. The Committee recommended Section 9.04 be approved to read as follows: SIETMOIN 9.04DNN71`iCN - An employee may be demoted for just cause and in the interest of good discipline. An employee who is so demoted shall be given [written] notice by his poopyrowy /y1100¢ [Director] or supervisor of the reasons for such action. An employee may request or accept voluntary demotion when assignment to a less difficult or responsible work would be to his advantage or in the interest of the City. CHAPTER 10 �PtOY� AND IEAVE PRAGTIC� The Committee recommended Section 10.01 A-I be approved to read as follows: SECTION 10.01 - HOLIDAYS A. Employees, other than temporary and part-time employees, shall be eligible for paid holidays. B. A new employee whose first working day is the day after a paid holiday shall not be paid for that holiday. C. An employee who is terminating his employment and whose last day as a paid employee is the day before a holiday shall not be paid for that holiday. D. As many employees as possible shall be given each holiday off without loss of pay. Ally [regular full-time] employees, except employees of the Fire and Police Departments, who are required to work on a holiday which is a work day, shall in addition to their regular pay for that day, be paid for the actual time worked. E. An employee who is on leave of absence without pay shall not be paid for official holidays. F. When an official holiday occurs on a scheduled work day of a O [regular] part-time employee, and he works the day preceding and following the holiday, such employee shall be entitled to the holiday and shall receive pay for the number of hours he normally would have worked. G. An employee who is absent without permission or without making advance arrangements on the working day immediately preceding or following a holiday shall lose pay for the holiday as well as for the other day or days off. Employees wishing to observe religious holidays not listed hereon shall at their option be given time off without pay or have the time charged to compensatory time off or vacation time off. The Committee requested Section 10.01 J be tabled for further discussion at the September 13th meeting. J. Paid holidays include: 1. New Year's Day January 1st 2. Memorial Day rant Monday in May 3. Independence Day July 4th 4. Labor Day First Monday in September 5. Thanksgiving Day Fourth Thursday in November [6. Day after Thanksgiving Friday following Thanksgiving] 7. Vacation leave shall accrue at a rate of 13.33 hours per month to a maximum of 160 hours per year. Civil Service Policy Review Committee 08-09-91 Minutes Page 6 [Hours for vacation leave will accrue as follows: 1 - 5 years @ 3.08 hours per pay period 6 - 15 years @ 4.62 hours per pay period 16 + years @ 6.15 hours per pay period The increased rate of Vacation accrual will begin on the 5th anniversary but may not be used until the 6th year anniversary date. Example: At 5 years, ten (10) days vacation is available to be used. At 6 years, fifteen (15) days vacation is available to be used. Due to the shift differential for firefighters, the following accrual rates for vacation will apply: 1 - 5 years @ 4.62 hours per pay period 6 - 15 years @ 6.92 hours per pay period 16 + years @ 9.23 hours per pay period] A. 0000000y [Directors] and 00000/0000 [Managers] shall schedule vacations giving due consideration to the needs of the service and the ability of the remaining staff to perform the work of the division. The employee shall be permitted to take his vacation at such time in the judgment of the 0000004 [Director] or PA/WOO/WOO [Manager] as will best serve the interest of the City and the employee. B. Upon termination of service with the City, either voluntarily or otherwise, an employee who has completed one year's service shall be paid all unused vacation leave to date of termination, but in no event to exceed two year's accumulated leave. C. Official holidays occurring during a vacation shall be added to the vacation time. D. Earned vacation time shall not be approved in periods of 4 00Y [less than one-half days] O/X0$0 unless such schedule will not interfere with the duties of the departments, or such schedule is necessary to meet an emergency. E. No cash payment for unused vacation leave shall be made except upon termination, retirement or death of an employee. Cash payments in lieu of vacation to persons currently employed shall not be permitted. F. SECTION 10.03 S]X IEAVE The intent of sick leave is to preclude a loss of income for absences due to illness or injury during the employee's regular work week. Sick leave days shall be used for absences during the regularly scheduled work week due to disability resulting from illness or injury, to the extent of the total number of days the employee has accumulated, and any other requirements are met. Pay for each day of sick leave utilized will be calculated at the employee's straight time hourly rate. An employee scheduled to work on a Saturday or Sunday at premium pay who is absent due to illness or injury shall not be entitled to sick pay for that day. A. Sick leave shall be accrued by all 0000 [regular] full-time employees on the basis of 00/000 ` /W/000K/XOXX 0930471/070pW0y1Mfygpf/#10/09100;10/144# [4.62 hours per pay period for employees with zero - twenty (0 - 20) years of service. Due to the shift differential for Firefighters, the accrual rate for sick leave with zero - twenty (0-20) years of service is 6.92 hours per pay period,] or a total of 120 hours for each year of employment. Sick leave may be accumulated to a maximum of 90 days (720) hours and any unused sick leave accumulated during the calendar year shall be carried to the employee's credit for the next year provided it does not exceed the maximum of 90 days. B. After twenty (20) years of service an employee shall begin to accrue additional sick leave at the rate of 0,0/0000 Y0 /OO /XOXX / 14f /OX / XOYytWill [6.15 hours per pay period. Firefighters shall begin to accrue additional sick leave at the rate of 9.23 hours per pay period. After an employee's accumulated sick leave has been exhausted, unused vacation leave or compensatory time off may be used as sick leave when requested. When absence due to illness exceeds the amount of paid leave earned and authorized, the employee shall be placed on leave of absence without pay. F. Employees who become ill during the period of their vacation may request that their vacation be temporarily terminated and their time charged to sick leave. Vacation days unused may then be taken later in the year at such time as may be designated by the employee's 00000000A1000 [Director or Manager.] The Committee recommended Section 10.03 G to read as follows: G. H. On separation from the service of the City, voluntarily or otherwise, no employee shall receive any pay for any accumulated sick leave. I. Sick leave shall be for the purpose of permitting an employee to be relieved of his duties during actual illness /)Y / / /kid /j O' /MY/MO /¢X0M10000$1 [of himself or his dependents. Sick leave may also be used for visits to the doctor or dentist and when an employee's dependent is ill or incapacitated and requires the employee's care or presence. For the purpose of authorizing sick leave, see dependent in "Definitions".] Employees who use their sick leave without just cause as it is earned, or fail to accumulate it may be dismissed from the service. Disability arising from any sickness or injury purposely inflicted or caused by willful misconduct. 2. Sickness or disability sustained while on leave of absence without pay. 3. Disability acquired as a result of [gainful employment] [in] another job. 4. Ordinary tiredness or restlessness. The Committee recommended Section 10.04 be tabled for further discussion at the September 13th meeting. SECTION 10.04 - OOCUFATIC WL DUAEMIZTY OR INJURY IB?iVF/1)ICAL CARE An employee injured in the course of his employment shall be granted occupational disability or injury leave and medical aid and hospital services as prescribed by the Texas Workman's Compensation Act. A. All employees while on occupation injury or disability leave shall continue to earn vacation and sick leave at the regular rate. An employee who is injured on the job must report the accident or injury to his supervisor immediately. The supervisor will direct the employee to obtain the necessary medical treatment. ] C. When an employee is injured on the job, the job foreman or supervisor shall complete the 000000Y/Y00044 [First Report of Injury] required by the Workman's Compensation Act within the time limits established. Subsequent reports must be filed according to the Act. Where an accident causes serious bodily injury or death to an employee, the gywegy/m00 [Director] and the YOY0000¢X [Insurance] Department must be notified immediately. D. The employee shall have the sole right to select or choose the persons or facilities to furnish medical aid, chiropractic services, hospital services and nursing. However, if the employee wishes, the City may make such selection for him. Emergency treatment is to be obtained from the hospital designated by the City Manager. An employee who is able to return to work in light duty status may be required to work in a different department and perform duties not contained within his current classification. F. It is the responsibility of the employee to contact his supervisor while he is on occupational injury leave at least once every five working days, if he is physically able to do so. G. Injury leave shall be limited to six (6) months. This leave may be extended by the City Manager/City Council at their discretion. H. Injury leave shall not be deducted from accrued sick leave or vacation time. AmITIQ1: [REREN ZO Tim] [I. An employee who has been off work due to an on-the-job injury for any length of time; or any employee who is off work for more than three (3) [working] days for a non-job related injury, will be required to get a doctor's full release, and then take and pass a physical examination before returning to work status. (Except for firefighters who must get a full release after four (4) days off.) The examination will be performed by the physician designated by the City and will be paid for by the City.] The Committee recommended Section 10.18.C.1 be tabled for further discussion at the September 13th meeting. The Committee raided the Uniform Allowance be consistently applied to all departments. 1. Uniform Allowance - The City will provide for uniforms, special clothing, safety equipment and cleaning services in certain departments. Since these requirements change from time to time it is not possible to be specific. Generally, these allowances are limited to the Department of Public Safety (Fire and Police) , however, other departments will extend this allowance to some degree. Employees should refer to their supervisor for the specific applicability of this allowance to their assignment. The City reserves the right to issue, suspend or revoke this special allowance at any time to any employee where no conflict exists with preemptive law.
