A RESOLUTION OF THE BOARD OF DIRECTORS OF THE EULESS
CRIME CONTROL AND PREVENTION DISTRICT , POSTPONING A
SPECIAL ELECTION ON A MEASURE PURSUANT TO CHAPTER 363
OF THE TEXAS LOCAL GOVERNMENT CODE .
WHEREAS , the Crime Control and Prevention District approved Resolution No .
19- 11 CCPD ordering a special election for the continuation of the Euless Crime Control
and Prevention District and the extension of a local sales and use tax at a rate of one-
quarter of one percent for a 20-year period to be held May 2 , 2020 ; and
WHEREAS , in accordance with Texas Government Code , Section 418 . 016 , on
March 13 , 2020 , the Governor of Texas , Greg Abbott , certified that the novel coronavirus
(COVID- 19 ) poses an imminent threat of disaster and , under the authority vested in the
Governor by Section 418 . 014 of the Texas Government Code , declared a state of disaster
for all counties in Texas ; and
WHEREAS , on March 18 , 2020 , Governor Abbott issued a proclamation
suspending Sections 41 . 0052 (a) and (b) of the Texas Election Code to the extent
necessary to allow political subdivisions that would otherwise hold elections on May 2 ,
2020 , to move their general and special elections for 2020 only to the next uniform
election date , occurring on November 3 , 2020 , without otherwise adjusting the term of
office ; and
WHEREAS , Governor Abbott additionally suspended Sections 31 . 093 and
42 . 0621 (c) of the Texas Election Code to the extent necessary to require all county
election officers , if requested by an affected political subdivision , to enter into a contract
to furnish election services with any political subdivision who postponed their election to
November 3 , 2020 , under the authority of the proclamation ; and
WHEREAS , a request has been made to the Governor to allow the postponement
of the May 2 , 2020 election to another date prior to November 3 , 2020 .
NOW, THEREFORE , BE IT RESOLVED by the Board of Directors of the Euless
Crime Control and Prevention District that :
SECTION 1 .
The Board of Directors of the Euless Crime Control and Prevention District , at a
special meeting held this date hereby postpone an election for a proposition , until the first
Tuesday in November, that being November 3 , 2020 .
PROPOSITION
Whether the Euless Crime Control and Prevention District should be
continued for twenty (20) years and the Crime Control and Prevention
District sales tax should be continued for twenty (20) years .
SECTION 2 .
The City Manager and the City Secretary, in consultation with the City Attorney,
are hereby authorized and directed to take any and all actions necessary to comply with
the provisions of federal and state law in carrying out and conducting the election , whether
or not expressly authorized herein .
APPROVED AND ADOPTED at a special called meeting of the Euless Crime
Control and Prevention District Board of Directors on April 15 , 2020 , by a vote of `7
ayes , 0 nays , and O abstentions .
