HomeMy WebLinkAbout2020-03-24 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, March 24, 2020 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:31 p.m. on Tuesday, March 24, 2020, in the Council Chambers of City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Jeremy Tompkins, Council Members Tim Stinneford, Eddie Price, Perry Bynum, Harry Zimmer, and Salman Bhojani. During the Precouncil meeting: ➢ City Manager Loretta Getchell advised that, while the Precouncil and Regular Session are both open to the public, staff has requested that members of the public view the meeting online in an effort to comply with the recommendations outlined in the Declaration of Public Health Emergency in response to the COVID-19 pandemic. ➢ City Manager Getchell reviewed the regular agenda. ➢ Deputy City Manager Chris Barker provided an update regarding provisions for the City Council and the public to safely participate in public meetings in response to the current COVID-19 pandemic. ➢ Emergency Management Coordinator Suzanne Hendrickson provided an update regarding the COVID-19 pandemic and the response taken locally, statewide, and at the federal level. City Manager Getchell expressed her appreciation to Ms. Hendrickson as well as the Department Directors for their ongoing efforts over the past two weeks to ensure continuity of operations, including providing essential services to our residents. CLOSED SESSION The City Council convened into closed session at 5:58 p.m. for deliberation regarding the following: Seek legal advice from the City Attorney as authorized by Section 551.071 of the Texas Government Code related to: • Riverwalk Planned Development The purchase, exchange, lease or value of real property as authorized by Section 551.072 of the Texas Government Code related to: • Cresthaven Addition • 505 Harwood Road Mayor Martin recessed closed session at 6:55 p.m. Council Minutes Page 2 of 9 March 24, 2020 COUNCIL CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:00 p.m. for consideration of scheduled items. PLEDGES OF ALLEGIANCE Council Member Salman Bhojani led the pledges of allegiance to the flags of the United States and Texas. ITEM NO. 1. PRESENTATION OF PROCLAMATION Council Member Stinneford read a proclamation proclaiming April as Child Abuse Prevention Month. CONSENT AGENDA (items 2 through 6) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 2 through 8. Mayor Pro Tern Tompkins seconded the motion. APPROVED RESOLUTION NO. 20-1572 Approved Resolution No. 20-1572, supporting an application to establish a Municipal Setting Designation (MSD) for a tract of land located at 500 Industrial Boulevard, Grapevine, Texas. ITEM NO. 3. APPROVED RESOLUTION NO. 20-1575 Approved Resolution No. 20-1575, authorizing the City Manager to enact modified personnel policies in emergent situations in order to provide for business continuity, or consideration for the health, safety, and welfare of the public or City employees. ITEM NO. 4. AUTHORIZED PURCHASE OF A NETWORK VIDEO RECORDING SYSTEM AND INSTALLATION OF CAMERAS Authorized the purchase of a network video recording system and installation of 74 cameras for the police and courts building from CML Security, 1785 West 60th Street #700, Broomfield, Colorado. The estimated expenditure is $227,979. ITEM NO. 5. AUTHORIZED PURCHASE AND INSTALLATION OF SPORTS TURF AND LIGHTING AT THE PARKS AT TEXAS STAR PHASE VII Authorized the purchase and installation of sports turf at the Parks at Texas Star Phase VII from GeoSurfaces, Inc., 7080 St. Gabriel Avenue, Suite A, St. Gabriel, Louisiana, through the TIPS Interlocal Purchasing System (TIPS #170205) in the amount of $681,200, as well as the purchase and installation of an LED Retrofit lighting system from GeoSport Lighting Systems, LLC., 7080 St. Gabriel Avenue, Suite B, St. Gabriel, Louisiana, through the TIPS Interlocal Purchasing System (TIPS #18120601) in the amount of $434,700. ITEM NO. 6. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the regular meeting of March 10, 2020. REGULAR AGENDA ITEM NO. 7. AUTHORIZED MAYOR TO NEGOTIATE AND EXECUTE CONVEYANCE DOCUMENTS Council Member Bhojani motioned to authorize the Mayor to negotiate and execute conveyance documents related to the purchase/exchange of property located at Cresthaven Addition, Block 2, Lot 10, 907 Cresthaven Drive. Council Member Price seconded the motion. ITEM NO. 8. APPROVED RESOLUTION NO. 20-1573 On March 24, 2020, the Mayor issued a Fourth Amended Declaration of Public Health Emergency for the City of Euless resulting from evidence of local community spread during the outbreak of the Coronavirus Disease 2019 (COVID-19). The Declaration shall continue until expiration of the current Executive Order of County Judge B. Glen Whitley dated March 24, 2020, or any future executive orders or declarations issued by Tarrant County for COVID-19 unless rescinded by order of the City Council. Council Member Bynum motioned to approve Resolution No. 20-1573, ratifying and extending the Declaration of Local Disaster due to Public Health Emergency (COVID-19). Council Member Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 9. APPROVED RESOLUTION NO. 20-1574 City Attorney Wayne Olson advised that in response to the COVID-19 virus and the timing of municipal elections, the Texas Governor issued a proclamation on March 18, 2020, suspending specific sections of the Texas Election Code to permit local entities the ability to postpone their general and special elections to the November uniform election date — November 3, 2020. The proposed Resolution further includes language to allow the City Council the opportunity to consider an earlier date if authorized by the Texas Governor. Council Member Bhojani motioned to approve Resolution No. 20-1574, postponing the May 2, 2020 general election to November 3, 2020 as authorized by the Texas Governor's proclamation issued March 18, 2020. Council Member Stinneford seconded the motion. ITEM NO. 10. HELD PUBLIC HEARING REGARDING PLANNED DEVELOPMENT 20-01-PD AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2240 Mayor Martin opened the public hearing at 7:10 p.m. Deputy City Manager Barker advised that the applicant, David Rey, AIA, Architect representing the Nepali Cultural Center, is seeking to rezone approximately 7.8 acres at the southwest corner of the 2200 Block of West Euless Boulevard and the 1200 Block of Royal Parkway into a Planned Development (PD) zoning district to allow a Place of Worship and Community Center. The project was originally approved in 2009 as a Specific Use Permit to construct temples and a community center and was put on hold while the community was building up resources for the construction. In the intervening period, the community purchased additional property. The development is proposed as a two-phase project. Phase one of the development will be to convert the 15,000 square foot manufacturing building into a community center, including additional parking and required landscaping. Phase two will be the construction of a 23,762 square foot cultural and spiritual center, which will be the foundation of the place of worship and include spaces for meditation, singing, ritual, and the primary inner sanctums for the practice of Hinduism and Buddhism. Mr. Barker reviewed the proposed architectural design features, landscaping, site access, and parking requirements. The Planning and Zoning Commission held a public hearing on March 3, 2020, and voted by a vote of 7-0-0 to recommend approval of the Planned Development Ordinance. Mr. Barker advised that landscaping requirements will be fulfilled as part of phase two of the project. Council Member Bhojani motioned to approve Ordinance No. 2240, to change the zoning on approximately 7.8 acres in the Park Center Addition, Lots 1 B and 1 C, 2200 Block of W. Euless Boulevard and International Regional Industrial Complex Portion, of Block C and Block C, Lot 10, 1200 Block of Royal Parkway; from Texas Highway 10 Multi-Use (TX-10) zoning district to allow for a Place of Worship and Community Center uses. Mayor Pro Tem Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 11. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 20- 02-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2238 Mayor Martin opened the public hearing at 7:14 p.m. Deputy City Manager Barker presented the item to the City Council and advised that the applicant, Bugless Collins, Pastor, Refuge Deliverance Center, intends to lease 520 Council Minutes Page 7 of 9 March 24, 2020 square feet of vacant office space at 1101 Royal Parkway, Suite 107. The building meets all code requirements for an assembly use. Pastor Collins has indicated that the congregation is about six people and would meet on Sunday mornings. Additionally, the Planning and Zoning Commission held a public hearing on March 3, 2020, and voted 7- 0-0 to recommend approval of the Specific Use Permit with the following conditions: 1) Tied to the church pastor: Bugless Collins; 2) Tied to the church name: Refuge Deliverance Center; and 3) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin advised that no comments were received from any proponents or opponents of the case. Mayor Martin closed the public hearing at 7:16 p.m. Mayor Pro Tern Tompkins inquired if the applicant was aware of the maximum occupancy allowed based on the square footage of the building. Mr. Barker confirmed that the maximum occupancy is included on the Certificate of Occupancy and discussed during the Fire Marshal's inspection. Council Member Stinneford motioned to approve Ordinance No. 2238, authorizing a Specific Use Permit on International Regional Industrial Complex, Block A, Lot B, 1101 Royal Parkway, Suite 107 for a Place of Worship in Texas Highway 10 Multi-Use (TX-10) zoning district. Council Member Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Tompkins, Council Members Stinneford, Price, Bynum, Zimmer, and Bhojani Nays: None Mayor Martin declared the motion carried. ITEM NO. 12. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 20- 03-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2239 Mayor Martin opened the public hearing at 7:17 p.m. Deputy City Manager Barker presented the item to the City Council and advised that the applicant, Nathan Hallford, Owner, Sloth BJJ, is the owner and instructor of Brazilian Jujitsu and intends to utilize 1,850 square feet in a strip commercial center at 218 North Main Street. The applicant indicates that class sizes are under 20 people and generally no more than 15 vehicles would be onsite at any one time. Additionally, the Planning and Zoning Commission held a public hearing on March 3, 2020, and voted 7-0-0 to recommend approval of the Specific Use Permit with the following conditions: Council Minutes Page 8 of 9 March 24, 2020 1) Tied to the business owner: Nathan Hallford; 2) Tied to the business name: Sloth BJJ; and 3) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin advised that no comments were received from any proponents of the case. Mayor Martin advised that Charles Cinquemani, 2803 Baze Road, Euless, submitted a comment expressing his opposition to the case due to the limited amount of parking. Council Member Stinneford inquired about the boundary area of the specific use permit. Mr. Barker provided additional details regarding the boundary lines of the property. Mayor Pro Tern Tompkins inquired about the possibility of students utilizing the backdoor to access the facility as a way to address the parking issue brought forth by Mr. Cinquemani. Mr. Barker advised that the applicant will be informed of the suggestion. Council Member Zimmer inquired about a vacant lot adjacent to the property and the possibility of utilizing for additional parking. Mr. Barker advised that the adjacent vacant property is unimproved but is available as additional parking right now. Council Member Bynum inquired about the required parking for the entire property, including the restaurant. Mr. Barker advised that the required number of parking spaces for the entire commercial strip is 9.5 and the property has 14 spaces. Additionally, he advised that restaurants generally have different parking requirements than other commercial businesses. There being no others wishing to speak, Mayor Martin closed the public hearing at 7:25 p.m. Council Member Zimmer motioned to approve Ordinance No. 2239, authorizing a Specific Use Permit on Euless Gardens, Block 2, Lot 3B, 218 North Main Street for a Membership Sports and Recreation Club in Neighborhood Business District (C-1) zoning district. Council Member Bynum seconded the motion. City Council Mayor Martin expressed her appreciation to the citizens of Euless for being diligent in following the public health declarations as they have been announced. Additionally, she asked for prayers for a local mayor, his wife, and their son who have been diagnosed with COVID-19. ITEM NO. 15.
