HomeMy WebLinkAbout2020-03-17 CITY OF EULESS PLANNING AND ZONING COMMISSION MARCH 17, 2020 MINUTES A regular meeting of the Planning and Zoning Commission was called to order by Commissioner Eric Owens at 6:00 p.m. on March 17, 2020, in the Council Chambers of City Hall, 201 North Ector Drive. Those present included Commission Members: Ronald Dunckel, Steve Ellis, Eric Owens, and Warren Wilson. Those absent included Chairman Richard McNeese, Vice Chairman LuAnn Portugal, and Commissioner Curtis Brown. Commissioner Eric Owens served as Chairman in the absences of Chairman Richard McNeese and Vice Chairman LuAnn Portugal. STAFF PRESENT: Mike Collins, Director of Planning and Economic Development Stephen Cook, Senior Planner Jeanne Flores, Administrative Secretary VISITORS: Janghee Lee INVOCATION Commissioner Dunckel gave the invocation. THE PLEDGE OF ALLEGIANCE Commissioner Ellis led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Commissioner Wilson made a motion to approve the minutes for the regular meeting of March 3, 2020. Commissioner Ellis seconded the motion. The vote was as follows: Ayes: Commission Members: Dunckel, Ellis, Owens, and Wilson. Nays: None Abstention: None Commissioner Owens declared the motion carried. (4-0-0) ITEM 2. HELD A PUBLIC HEARING AND CONSIDERED APPROVAL OF REPLAT CASE NO. 20-01-RP Commissioner Owens opened the public hearing at 6:02 p.m. Stephen Cook gave a brief description of the case. The applicant proposes to replat the above described property by taking a floodplain designation off of the previous plat. The developer has Planning and Zoning Commission Minutes Page 1 of 4 March 17, 2020 Planning and Zoning Commission Minutes Page 2 of 4 March 17, 2020 applied for, and has had approved a Letter of Map Revision (LOMR) from the Federal Emergency Management Agency (FEMA) which oversees the official boundaries of floodplain in the United States. None of the boundaries, utility easements or Emergency Access, Drainage and Utility Easements (EADUE) have been modified on the included lots in the replat. Removing the official designation of floodplain from the lots allows for their development. For the lots under commercial or urban loft development, where easements have not been set—further replats will be required. The Development Services Group (DSG) has reviewed and certified that the application has met all of the information required for consideration by the City of Euless. Staff recommends approval of the replat. Commissioner Owens asked to hear from any proponents/opponents who wish to speak. Seeing none, Commissioner Owens closed the public hearing at 6:05 p.m. Commissioner Dunckel asked if there were any lots that would remain in the boundaries of the floodplain. Mr. Cook stated that there are no lots remaining in the floodplain. He also stated that the large ponds and other work that was done to the area allowed the lots to be removed from the floodplain. The developer was able to receive the approval from the FEMA because of all the work they did to the property. There were no further questions or comments presented by the Commission. Commissioner Dunckel made a motion to approve Case No. 20-01-RP for a request for a Replat of 29.482 acres out of property previously platted as Euless Founders Parc Addition, Block H, Lot A; Block I, Lots 1-11 & A; Block J, Lots 1-5 & A; Block R, Lot 1; Block S, Lots 1 & A; Block T, Lots 2 & A, Block U, Lot A; Block V, Lot A; Block Q, Lot 1 and Block W, Lot A to be replatted as Euless Founders Parc Addition, Block H, Lot AR; Block I, Lots 1 R-11 R & AR; Block J, Lots 1 R-5R & AR; Block R, Lot 1 R; Block S, Lots 1 R & AR; Block T, Lots 2R & AR, Block U, Lot AR; Block V, Lot AR; Block Q, Lot 1 R and Block W, Lot AR. Commissioner Wilson seconded the motion. The vote was as follows: Ayes: Commission Members: Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Commissioner Owens declared the motion carried. (4-0-0) ITEM 3. APPROVED FINAL PLAT CASE NO. 20-02-FP Stephen Cook gave a brief description of the case. A final plat establishes the appropriate easements for the development and enables the required public infrastructure to be constructed in the future. The final plat is for a single commercial lot containing a restaurant. The final plat conforms to the standards of the zoning district. Staff recommends approval of the final plat. There were no questions or comments presented by the Commission. Commissioner Ellis made a motion to approve Case No. 20-02-FP for a Final Plat to be located on 1.0 acre out of the J.P Halford Survey, Abstract No. 711, to be platted as Rose Addition, Block A, Lot 3 located at 708 N. Industrial Boulevard. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Commission Members: Dunckel, Ellis, Owens and Wilson. Nays: None Abstention: None Commissioner Owens declared the motion carried. (4-0-0) ITEM 4. DENIED FINAL PLAT CASE NO. 20-04-FP Stephen Cook gave a brief description of the case. A final plat establishes the appropriate easements for the development and enables the required public infrastructure to be constructed in the future. The final plat is for one commercial lot. The final plat does not conform to the standards of the zoning district. A written statement containing the reasons for denial of the Final Plat is included in an attachment described as Development Services Group First Review Comments — March 10, 2020. The Development Services Group (DSG) has reviewed and certified the application has not met all of the information required for consideration by the City of Euless. Staff recommends denial of the final plat. Commissioner Dunckel asked if the case would have to go through the process all over again if the Commission denies this case. Mr. Cook stated that the denial will allow the applicant to subdivide the property and submit a conveyance plat for three of the lots. The other lot is going to be a hotel and the applicant will supply a site plan application for that lot. Mike Collins added that this denial follows the process that is consistent with the resent change in the state law. There were no questions or comments presented by the Commission. Commissioner Ellis made a motion to deny Case No. 20-04-FP for a Final Plat to be located on 2.88 acres out of the Adam Bradford Survey, Abstract No. 152 to be platted as Midway Square Addition, Phase Two, Lot 1 R2 & X, Block B, at the northwest corner of Fuller-Wiser Road and E. Airport Freeway. Commissioner Dunckel seconded the motion. The vote was as follows.. Ayes: Commission Members: Dunckel, Ellis, Owens and Wilson.
