ZONING BOARD OF ADJUSTMENT
OCTOBER 24, 2019
MINUTES
A regular meeting of the Zoning Board of Adjustment was called to order by Chairman
Crites at 6:00 p.m. on October 24, 2019 in the Council Chambers of City Hall, 201 North
Ector Drive. Those present included Chairman Ruby Anne Crites, and Board Members:
Steve Elliot, Charles Cinquemani, Ron Young, and Alternate Board Members: David
Brown and Carol Dufinetz.
During the Pre-Session Meeting:
• Director of Planning and Economic Development, Mike Collins reviewed the regular
agenda.
ZONING BOARD OF ADJUSTMENT CONSIDERATION OF SCHEDULED ITEMS —
PRE-COUNCIL CONFERENCE ROOM
The Euless Zoning Board of Adjustment continued their meeting in the Council Chambers
at 6:30 p.m. for consideration of scheduled items.

Board Member Young led the pledge of allegiance.
ITEM 1. APPROVED ZONING BOARD OF ADJUSTMENT MINUTES
Board Member Young made a motion to approve the minutes for the regular meeting of
December 6, 2018. Board Member Young seconded the motion. The vote was as follows:
Ayes: Chairman Crites, and Board Members: Elliot, Cinquemani and Young.
Nays: None
Abstention: None

Chairman Crites declared the motion carried. (4-0-0)
ITEM 2. HELD A PUBLIC HEARING FOR ZONING BOARD OF ADJUSTMENT
CASE NO. 19-01-ZBA
Chairman Crites opened the public hearing at 6:37 p.m.
Director of Planning and Economic Development, Mike Collins gave a brief description of the
case. The applicant, Lennar Homes, represented by Kyle Dickerson, is requesting a
variance to the side yard setback requirement for The Dominion at Bear Creek Addition,
Block F, Lot 18. The currently platted side-yard setback requirement of five (5) feet is
consistent with the R-5 lot type approved in the RiverWalk Planned Development under
Section 9 "Lot Type Standards — R-5 Side Yard Setback" (Ordinance 1904). Lot 18 is the
last lot to be developed out of the 216-lot Dominion at Bear Creek subdivision that was
approved in January 2013 (#12-11-SP). Lot 18 is located on the southwest corner of a
cul-de-sac and adjacent to open space that parallels the west side of Bear Creek
Parkway. Due to the unusual shaped lot in relation to the cul-de-sac, the applicant is very
limited on building options on this lot. The applicant is proposing to construct a home with
a footprint that encroaches no more than eleven inches (11") within the five foot (5)
setback at the southeast corner of the foundation, creating a total encroachment of 18.25
square inches. Because Lot 18 is located immediately adjacent to the west of the HOA
open space lot, this minor variance will have virtually no impact.
Staff believes that practical difficulties would result from the strict compliance with the
platting regulations and that the public interest is better served by the granting of the
variance to the platting regulations. Staff supports the applicant's request, and
recommends that the ZBA authorize a variance to the side yard setback requirement.
Chairman Crites asked if the applicant wished to address the Commission.
Mr. Kyle Dickerson, Lennar Homes Representative, spoke about why the variance is
needed. He stated that this is the last lot available and that they chose the smallest home
option available but it would not fit within the current setbacks that are placed on the
property.
Chairman Crites asked to hear from any proponents/opponents who wish to speak.
Seeing none, Chairman Crites closed the public hearing at 6:43 pm.
Board Member Elliot asked that if Lennar was not granted the setback change what
would be their other option.
Mr. Dickerson answered that the only option would be to sell the lot to another builder.
He went on to say that this option would be difficult to sell the property due to the fact
that the setback would limit what can be built on the lot. The structure would most likely
need to be custom designed and may not fit with the look of the neighborhood.

There were no further questions or comments presented by the Board.
Board Member Cinquemani made a motion to deny Case No. 19-01-ZBA for a Zoning
Variance for The Dominion at Bear Creek Addition, Block F, Lot 18. The applicant is
requesting a variance to the side yard setback requirements. This property is located at
808 River Birch Court and is zoned Planned Development (RiverWalk Planned
Development). Board Member Elliot seconded the motion. The vote was as follows:
Ayes: Chairman Crites, And Board Members: Elliot, Cinquemani and Young.
Nays: None
Abstention: None
Chairman Crites declared the motion carried. (4-0-0)
ITEM 6. ADJOURN
There being no further business, the meeting was adjourned at 6:45 p.m.
