HomeMy WebLinkAbout1953-04-2011 Called Meeting Board of Aldermen April 20, 1953 The Board of Aldermen of the Village of Euless met in called session on April 20, 1953, at 7:30 p.m. Present were Mayor Joe Umphress and Aldermen W, H. Fuller, Ernest Millican, Jr., M. L. Anders, A. E. Tillery, and J. S. Anderson, being all members of the board. The first order of business was the adoption of Ordinance No. 3. This ordinance is pertaining to the time and place of regular and called meetings of the Board of Aldermen. The vote was unanimously in favor. Next the board took up the matter of granting to Texas Power & Light Company a franchise to furnish light, heat, and power with the limits of the Village of Euless. Meeting with the board as represent- atives of the company were the following gentlemen: W. S. Hi 11 is, H. 0. Rothel 1 , and Paul Harvey. A lengthy discussion of the terms and rates was offered after which M. L. Anders moved that Ordinance No. 4, which is the franchise verbatim, be adopted. A. E. Tillery offered a second and the vote was unanimously in favor. Then Ernest Millican, Jr., made a motion that Ordinance No. 5 be adopted. M. L. Anders offered a second and the vote was unanimously in favor. This ordinance is a listing of the rates to be charged for the various electric services within the limits of the Village of Euless. It was agreed that Texas Power and Light Company would prepare detailed minutes of this meeting, pertaining only to the business transacted with that firm as outlined above, such minutes to be filed as part of this report. In accordance with this agreement reference is hereby made to "Section A ", of these minutes. Finally the Board voted unanimously to install a street light on the north side of Highway 183 at the new business section about one fourth mile east of Euless Business Center. Anderson Secretary, Village of Euless /s/ Joe Umphress Mayor /9 Called Meeting Board of Aldermen EXHIBIT A April 20, 1953 Pursuant to call of the Mayor and to notice d u l y given to a l l members of the Village Council, to the Attorney and to the Secretary, stating the time, place and purpose of the meeting, a Called Meeting of the Village Council of the Village of Euless, Texas, was held Monday, April 20, 1953, at 7:30 p.m., at their usual meeting place. Those present were Mayor Joe Umphress, Aldermen J. S . Anderson W. H. F u l l e r , Ernest M i l l i c a n , Jr., M. L. Anders, and A. E. Tillery, being all the members of the Village Council. J. S. Anderson, Secretary, acted as secretary of the meeting. The Mayor stated that among other business to be considered was the granting of a franchise to Texas Power and Light Company. . Alderman M. L. Anders introduced an ordinance e n t i t l e d "ORDINANCE GRANTING TO TEXAS POWER & LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC LIGHT, HEAT AND POWER FRANCHISE," which was seconded by Alderman A. E . T i I I e r y . Said ordinance was read and, on motion, f i n a l l y passed and adopted, the vote thereupon being unanimous in favor of said ordinance. Mayor Umphress thereupon, in open meeting, signed and approved said ordinance, and it was ordered that the same be recorded and the same is recorded in words and figures as follows: "Ordinance No. 4 ORDINANCE GRANTING lD TEXAS POWER & LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC LIGHT, HEAT AND POWER FRANCHISE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF EULESS, TEXAS: Section 1: That there is hereby granted to Texas Power & Light Company, its successors and assigns (herein called the "Grantee "), the right, privilege and franchise until May 1, 2003, to construct, maintain and operate in the present and future streets, alleys, and public places in the Village of Euless, Texas, and its successors, electric light and power lines, with all necessary or desirable appurtenances (including underground conduits, poles, wires, transmission lines, and other structures and telephone wires for its own use), for the purpose of supplying electricity to the said Village, the inhabitants thereof, and persons and corporations beyond the I i m its thereof, for light, heat, power and other purposes. I$ Page Two, Board of Aldermen, April 20, 1953) Section 2: Poles, structures and other appurtenances shall be so erected and maintained as not to interfere unreasonably with traffic over streets and a l l e y s . The l o c a t i o n of a l l poles, conduits and other structures shall be fixed under the supervision of the street and alley committee of the Village of Euless, or the successors to the duties of that committee, but not so as to interfere unreasonably with the proper operation of said lines. Section 3: The service furnished hereunder to said Village and its inhabitants shall be first class in all respects considering all circumstances, and shall be subject to such reasonable rules and regulations as the Grantee may make from time to time. The Grantee may require reasonable security for the payment of its bills. Section 4: The Grantee s h a l l ' h o l d the V i l l a g e harmless from a l l expense or liability for any act or neglect of the Grantee hereunder. Section 5: That on acceptance of this franchise by Texas Power E Light Company, it shall pay to the Village of Euless the sum of 1VO HUNDRED FIFTY ($250.00) DOLLARS, as street rental for twelve months succeeding May 1, 1953; and on May 1, 1954, and annually thereafter on May 1st of each succeeding year for the life of this franchise, Texas Power & Light Company, its successors and assigns, shall pay to the Village of Euless a sum equal to two percent (2%) of its gross revenue received from the sale of electric energy by said company from its residential and commercial business conducted within the corporate limits of said Village for the preceeding twelve (12) months ending March 31st, in full payment for the privilege of using and occupying the streets, highways, easements, alleys, parks and other public places in the Village of Euless, whether as rental, supervision and inspection charges, or otherwise, for twelve months succeeding May 1st of year in which payment is made. This payment shall be in lieu of any other tax or increased rate of tax or other imposition, assessments, or charges, except ad valorem taxes. Section 6: The Grantee shall file its written acceptance of this franchise within sixty (60) days after its passage and approval. Section 7: This franchise is not exclusive, and nothing herein contained shall be construed so as to prevent the Village from granting other like or similar rights and privileges to any other person, firm or corporation.
