A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS, SUPPORTING A PROPOSED SENIOR COMMUNITY TO BE
CONSTRUCTED IN THE CITY OF EULESS, TEXAS, AUTHORIZING
EVERGREEN EULESS SENIOR COMMUNITY, L.P. TO APPLY TO THE
TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS
FOR FUNDING FOR SUCH SENIOR COMMUNITY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Evergreen Euless Senior Community, L.P. has proposed a new
development of age restricted affordable senior housing located at the southwest
quadrant of Dickey Drive and East Euless Boulevard (Texas Highway 10), Euless,
Tarrant County, TX 76039. The proposed community is to be named "Evergreen at
Euless Senior Living Community'; and
WHEREAS, as the American population ages, there is a need for reasonably
priced rental housing for seniors in the community, and City Council wishes to evidence
its support for this proposed development in the City of Euless; and
WHEREAS, in order to help provide funds and secure necessary financing
approvals, Evergreen Euless Senior Community, L.P. intends to submit a joint
application to the Texas Department of Housing and Community Affairs ( TDHCA) for
2012 Housing Tax Credits, HOME "Persons with Disabilities Set- Aside ", and HOME
Investment Partnership Program funds for Evergreen at Euless Senior Living
Community which requires permission from the Euless City Council; and
WHEREAS, §50 9(b)(5), Texas Administrative Code, which gives Housing Tax
Credit points for the commitment of development funding by the Unit of General Local
Government, states that the TDHCA HOME Program funds will not qualify for points in
this category "unless a resolution is submitted with the application from the Governing
Body of the Unit of General Local Government authorizing that the Applicant act on
behalf of the Unit of General Local Government in applying for HOME Program funds
from TDHCA for the particular application ";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
Section 1.
The City of Euless appoints Evergreen Euless Senior Community, L.P. to act on
its behalf in applying for TDHCA HOME funds for the Evergreen at Euless Senior Living
Community; provided, however, that the City of Euless disclaims any liability for
administration or repayment of any HOME funds which may be loaned to Evergreen
Euless Senior Community L.P. by the TDHCA.
Section 2.
That the City Council of the City of Euless, Texas understands that this
Resolution, related to potential financing, is not a statement of support for rezoning the
site, or for other development approvals that may be required. Such decisions will be
made in due course.
Section 3.
That this Resolution shall become effective immediately from and after its
passage, as the law and charter in such cases provide.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on
the 14th day of February 2012, by a vote of 7 ayes, o nays, and o
abstentions.
