Planning and Zoning Commission
April 18, 1978
CALL TO ORDER
The regular meeting of the Planning and
Zoning Commission was called to order at 7:40 p.m. in the Council Chambers of
Euless City Hall by Chairman Carl Tyson. Other members present were Messrs.
Winn Porter, Bob Eden, Neal Adams, Sam Munir, and Mrs. Helen Lightbody. (Absent
was Mr. Robert Johnson)
Also present were Director of Planning
and Development Rick Barnes and Recording Secretary Becky Gunter.
VISITORS
Visitors in attendance were Messrs.
Haydn Cutler, Bill Pasteur, John Lynch, Doug Long, Joe F. Moreland, and Mesdms.
Barbara Humphrey, Tamita Pasteur, Willie Mae McCormick, and Edna Pasteur.
INVOCATION
The invocation was given by Mr. Adams.
APPROVAL OF MINUTES
Mr. Porter made a motion to approve the
minutes of the regular meeting dated April 4, 1978, as written.
Mr. Eden seconded the motion and the
vote is as follows:
Ayes: Messrs. Porter, Eden, Adams, Tyson, Munir, and Mrs. Lightbody
Nays: None
Chairman Tyson declared the motion
carried.

CONSIDER FINAL PLATTING - TIMBER
RIDGE ADDITION. PLATTING OF 206
LOTS AND FOUR TRACTS LOCATED EAST
OF F.M. 157 AND NORTH OF HARWOOD
ROAD
Mr. Long stated he is a consulting
engineer with offices in Hurst, Texas and is representing Mr. Haydn Cutler who
is also present. He stated he is aware of the City Engineer' s letter and is
concerned with a few of the items.
Chairman Tyson requested Mr. Long to
go over each item of the City Engineer' s letter as the Commission has not had
time to review the letter. The City Engineer' s letter is to be made a part of
the minutes.
Mr. Long stated item one states that,
"Easements for water lines and fire hydrants must be shown on Tract B, Block 1 ."
Tract B of Block 1 is a large tract which they hope to have zoned commercial at
a later date. They do not wish to place the water lines in the internal of the
tract until they know what will be developed on the property. They will , however,
make provisions on the plat to say that the easements and fire hydrants will be
dedicated and installed at the time of development if this is satisfactory to
the Commission and staff. There is also the alternative of leaving the potential
commercial tracts unlabeled. The purpose of having them labeled is for simplicity
in referring to the tracts as opposed to referring to them by a metes and bounds
description.
Mr. Long stated items two and three are
related to the sanitary sewer lines on Tract A, Block 3 and Tract B, Block 1
being extended to serve the entire tracts. Since it is a large tract, it was
their opinion to stub service into the property and terminate with a manhole
with stub outs and, for any further development of the tract that needed the
sewer line, it would be available for extension.
Mr. Long stated item four is related to
offsite sewer. He was not aware of the city's complete master plan for the area
and, therefore, was not aware of what area would be served by this line. They
have been working with Mr. Elliott, who represents one of the owners to the north,
and have attempted to arrive at a routing of the sewer line through the property.
However, they do not have a firm agreement with the owner. There are two prop-
erty owners to the north that they will have to negotiate with for right-of-way.

Mr. Adams stated that if the potential
commercial tracts were not platted, items one, two, and three would be solved
as another plat would be required.
Mr. Lynch stated if the tracts are
labeled, they become platted lots and the only control the city would have would
be through the issuance of a building permit which has no control over the in-
stallation of improvements such as water, sewer and streets.
Mr. Adams asked Mr. Long if the only
purpose of platting the large tracts is to eliminate having to describe the
tracts by metes and bounds at the tax office.
Mr. Long stated they do not have an
immediate use for the property and would therefore, eliminate the large tracts
from the plat. Also, by doing so, items six, eight and nine of the engineer's
letter would be resolved. Mr. Long stated item five, "There should be a mini-
mum distance of 500 feet between manholes on all sewer lines" would not be a
problem; there will be about four additional manholes needed. Mr. Long stated
the ten foot utility easement referred to in item seven will have to be nego-
tiated with the property owners. He stated the permanent barricade required at
the end of Shelmar Drive would not be a problem. The cost of the barricade will
be much less than a bridge, which would be the alternative.
Mr. Long stated item eleven refers to the
drainage channel . They propose the channel to have a paved bottom with earthen
sides. The request for indication on the plans that the velocity for the design
storm will remain within the accepted limits of Section 103(d) of the ordinance
will not be a problem. There is one area that the velocity has not been checked
but it will not be difficult to do so. Mr. Cutler' s attorney is in the process
of drafting a perpetual maintenance agreement as required in Section 103. Con-
cerning subsection "d" of item eleven, "Some provision shall be made to minimize
the erosion at the point of exit from the 72" pipe crossing at Glenn Drive", the
pipe is designed to carry a larger flow than the 25 year flow as required and he
feels they can hold down the velocity with some type of protective measure without
any problem. The last request of Mr. Lynch' s letter is that the drainage plans
be approved by the city staff prior to the filing of the final plat, which has
been done.
Mr. Adams stated a perpetual mainten-
ance agreement was drafted by Mr. Cutler' s attorney at the time of preliminary
platting. However, there has been an ordinance passed since that time which
would have some penal provisions placed in the maintenance agreement, which
would give the city the authority to fine individuals if they did not comply
with the terms of the agreement. He asked Mr. Long if he was aware of this.

Mr. Long stated he was not. However,
since Mr. Cutler is having a lawyer draw up the maintenance agreement, he is
not familiar with it.
Mr. Adams asked Mr. Cutler if he was
aware of the penal provision.
Mr. Cutler stated he was not, but that
it would not be a problem.
Chairman Tyson inquired about the twenty-
five year channel that goes under Glenn Drive.
Mr. Long stated the 72 inch pipe has
been designed to handle more water than a twenty-five year storm. They are
exceeding the ordinance requirement because they will be creating a dam and
want to eliminate any potential flooding of the houses. The channel is of
sufficient depth that a 100 year storm will stay within the boundaries.
Discussion of further drainage infor-
mation followed.
Chairman Tyson read a second letter
from the City Engineer concerning Cummings Road which is to be made a part of
the minutes. He asked the location of the proposed Hwy. 121 extension.
Mr. Lynch indicated the proposed ex-
tension on the map.
Mr. Pasteur stated he and his partner
are the owners of the twenty-four acres north of the proposed Timber Ridge
Addition. He stated he intends to come before the Planning and Zoning Commis-
sion at their next meeting for platting of the R-4 zoned property. He stated
he plans to construct four-plexes on the property with a density of about ten
units per acre. Their plan shows Cummings Road to be developed as it has
always been their distinct impression that it would be there. When Mr. Long
submitted the preliminary plat, it showed Cummings Road to be closed. He was
notified at that time that Mr. Pasteur and his partner were the owners of the
property and that they were not in favor of the closing of Cummings Road. Mr.
Long was requested to get with Mr. Pasteur and negotiate the closing of Cummings
Road. Mr. Pasteur stated they did meet with Mr. Long and discussed with him
the reasons they felt Cummings Road should remain open. They also offered to
give their share of right-of-way that was needed to widen Cummings Road and
pay half of the cost of paving the road. Mr. Long stated he would respond to
their request prior to submitting the final plat for approval . However, he
did not do so. Mr. Pasteur distributed a copy of the City of Bedford' s Master
Plan. On this master plan, Cummings Road is shown traversing most of the north
end of Bedford and currently, it exists as dedicated right-of-way and a hot top
road directly across Highway 157. The State of Texas has contracted to build

an overpass over Cummings Road at S.H. 121A and not close the road off. He dis-
tributed an excerpt from the State of Texas Highway Department plans. As the
plans are stated at this time, there are no entrances or exits at Cummings Road,
but there may be at a future date. Colony Homes has recently purchased a large
tract of land just west of S.H. 121A. He displayed a copy of the preliminary
plat. The City of Bedford has required him to dedicate sixty feet of right-of-
way for Cummings Road. He displayed a subdivision plat signed by the City of
Euless filed of record in 1972 when Lakewood Addition was first developed. It
was for the purpose of developing and platting the lots where Centennial built
their homes. Cummings Road is noted on the plat and in existance. At that time,
the city took a portion in right-of-way to construct the intersection at Ash Lane
and Cummings Road. There were subsequent plats filed for the development of the
townhouses and they also reflected the intersection and Cummings Road. Therefore,
he does not feel the construction of Cummings Road is a new concept. They have
planned on the extension since acquiring the property.
Chairman Tyson asked Mr. Pasteur if
he acquired the property prior to, or after the extension of Ash Lane.
Mr. Pasteur stated he acquired it
afterwards.

Mr. Cutler stated paragraph three on
page two of the City Engineer' s letter dated July 2, 1977 stated the need for
the extension of Cummings Drive was eliminated by the construction of, and
extension of Ash Lane. The right-of-way was not dedicated on this property,
so they proceeded accordingly. They did not feel the extension would be
beneficial to the city.
Mr. Porter asked if the city has made
any previous commitments for the extension of Cummings Road.
Mr. Barnes stated there are no previous
commitments that he is aware of; if so, only in the form of dedication on pre-
vious plats.

Mr. Adams stated the Commission has
three choices of action regarding this plat; it can recommend approval as sub-
mitted and direct the City Council to close the street, deny the plat and
recommend the extension of the street, or table the platting until the property
owners can work out the street situation. Mr. Adams further stated he feels it
would be best to table the plat, as he feels the problem can be worked out
amongst the property owners ; he does not wish to deny the plat.

Chairman Tyson asked if there is
information available as to the reason the Ash Lane extension was curved and
did not extend straight to Hwy. 157.
Mr. Barnes stated the information
possibly will be in the minutes of the Planning and Zoning or City Council
meetings; he will check.
Chairman Tyson asked Mr. Long if there
is a possibility of utilizing a portion of the potential commercial property
for additional residential .
Mr. Long stated that, due to the contour
of the land, the property is not conducive to residential use.
Chairman Tyson suggested tabling the
plat to give the property owners a chance to work out the street situation, and
also give the Commission a chance to review the minutes of the meeting in which
Ash Lane was dedicated. He further requested information on off-set intersections
from the traffic safety officer.
Mr. Adams made a motion to table final
platting of Timber Ridge Addition for the purpose of allowing the property owners
to resolve the problem with Cummings Road.
Mr. Eden seconded the motion.
Mr. Adams suggested that for the benefit
of the property owners, each Commission member express their personal opinion
of the Cummings Road extension in order to give them an input from the Commission.
Chairman Tyson stated he is concerned
about previous commitments made by the city. If there were no previous commit-
ments, the situation would be different.
Mr. Porter stated he agrees with Chairman
Tyson.
Mr. Eden stateded he would like for
Cummings Road to be extended if a satisfactory agreement could be reached by the
property owners.
Mr. Munir stated he is afraid that if
Cummings Road is extended, a traffic problem will be created at the intersection
of Ash, Timber Ridge and Cummings.

Mr. Adams stated the staff could work
out the traffic problem.
The vote on Mr. Adams' motion is as
follows:
Ayes: Messrs. Adams, Eden, Porter, Tyson, Munir, and Mrs. Lightbody

Chairman Tyson declared the motion
carried.

PLANNING AND ZONING CONFERENCE
Mr. Barnes stated North Central Texas
Council of Governments will be presenting a Planning and Zoning Conference May
19th and 20th in the Fuller Room of the Euless Library. Further information
will be mailed at a later date.
