HomeMy WebLinkAbout1977-11-15 Regular Meeting Planning and Zoning Commission November 15, 1977 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 7:35 p.m. in the Council Chambers of Euless City Hall by Chairman Carl Tyson. Other members present were Messrs. Bob Eden, Neal Adams, Robert Johnson, Winn Porter, Sam Munir, and Mrs. Helen Lightbody. Also present were Director of Planning and Development Rick Barnes and Recording Secretary Becky Gunter. VISITORS Visitors in attendance were Messrs. Walter A. Elliott, Bill Pasteur, and Mesdms. Willie Mae McCormick and Tamita Pasteur. INVOCATION The invocation was given by Mr. Johnson. APPROVAL OF MINUTES Mr. Johnson made a motion to approve the minutes of the regular meeting dated November 1 , 1977, as written. Mr. Porter seconded the motion and the vote is as follows: Ayes : Messrs. Johnson, Porter, Eden, Tyson, and Mrs. Lightbody Nays: None Chairman Tyson declared the motion carried. (Page Two, Regular Meeting, Planning and Zoning Commission, November 15, 1977) FINAL PLATTING - TRACTS 3AR-2 AND 9, WESTPARK CENTRAL ADDITION. (PROPERTY LOCATED EAST OF THE WESTPARK WAY AND TIBBETS DRIVE INTERSECTION AND SOUTH OF WESTPARK COURT) Mr. Elliott stated he is represent- ing Mr. Harry Hunsicker in his request for final plat approval of Tracts 3AR-2 and 9 of Westpark Central Addition. Preliminary plat approval was requested and approved on this about two months ago. (Mr. Munir arrived at this time. ) Mr. Elliott stated the final plat is the same as the preliminary that was submitted. Mr. Hunsicker has an immediate tenant for Tract 9 which will be an office complex. The plans have been submitted to the city staff for their review. He has the letter from the City Engineer, Mr. John Lynch, dated November 11 , 1977. The four items of the letter have been discussed with the city staff and all of the items will be met. Chairman Tyson stated he under- stands that only two tracts of the original preliminary plat are being final platted. Mr. Elliott stated this is correct. Tract 3AR-1 will be final platted at some future date and could be sub- divided. They do not want to plat it at this time because there would be some easements that would have to be vacated. The street, Westpark Court, and all of the utilities along the street will be installed at this time for the convenience of having a turn around for the Fire Department. Chairman Tyson requested that Mr. Lynch' s letter be made a part of the minutes. He stated that item one refers to the fact that only Tracts 3AR-2 and 9 are being platted and does not include Tract 3AR-1 . He pointed out that "Tract 3AR" in item one should be "Tract 3AR-1". The next two items refer to the proposed 36 inch storm sewer. He stated this is not shown on the plat and asked where it will be located. Mr. Elliott indicated on the plat the location of the storm sewer. Chairman Tyson stated item four states that all drainage plans should receive concurrence of the city engineering department. (Page Three, Regular Meeting, Planning and Zoning Commission, November 15, 1977) Mr. Elliott stated Mr. Lynch wanted to make sure more drainage would not be discharged into the street than it will carry. Mr. Porter made a motion to recommend final plat approval of Tracts 3AR-2 and 9 of Westpark Central Addition subject to the City Engineer' s letter as corrected. Mr. Eden seconded the motion and the vote is as follows: Ayes: Messrs. Porter, Eden, Tyson, Johnson, Munir, and Mrs. Lightbody Nays: None Chairman Tyson declared the motion carried. II . PUBLIC HEARING - CONSIDER AMEND- MENT TO CITY OF EULESS ORDINANCE NO. 347. (ZONING ORDINANCE) Chairman Tyson stated the proposed amendment would remove "medical and dental clinics" from the "C-2" zoning and place it in the "C-1" zoning. (Mr. Adams arrived at this time.) Mr. Barnes pointed out that accord- ing to Section 7-301 (6) , hospitals, doctor' s and dentist's offices and clinics are allowed in "R-3" zoning also. Chairman Tyson stated that doctor's and dentist' s offices and clinics should be removed from "R-3" zoning. Discussion. Mr. Adams made a motion to amend Ordinance No. 347 to eliminate Section 7-301 (6) ; remove the wording "medical and dental clinics" from Section 7-501 (6) ; and add a new section, Section 7-401 (12) , medical and dental clinics. Mr. Johnson seconded the motion and the vote is as follows: Ayes: Messrs. Adams, Johnson, Porter, Eden, Tyson, Munir, and Lightbody Nays: None Chairman Tyson declared the motion carried. (Page Four, Regular Meeting, Planning and Zoning Commission, November 15, 1977) III . PUBLIC HEARING - CONSIDER AMEND- MENT TO CITY OF EULESS ORDINANCE NO. 147. (SUBDIVISION RULES AND REGULATIONS) Chairman Tyson stated the ordinance being considered is the requirement of underground utilities. The require- ment is for new subdivisions only; it does not pertain to utility line replacements. He stated the main factors to be considered are cost, safety, and aesthetics. Mr. Elliott stated the price quoted to him for underground utilities was $305.00 per lot in dealing with the Meadowview Addition, which would be the average cost but could vary depending on topo conditions. Mr. Adams stated the additional $300.00 would also be subject to interest rates which would increase the cost. Chairman Tyson stated $300.00 is not a determining factor in the purchase of a house with a cost of $40,000.00 or more, and feels like the purchaser would prefer to pay the additional $300.00 to have the utilities underground. Mr. Pasteur stated underground versus overhead utilities has not been a significant factor in the purchase of houses in the past. Chairman Tyson stated another item mentioned in the comparison study was the safety factor. Mr. Adams stated he does not feel underground utilities would be safer than overhead. The requirement by O.S.H.A. (Occupational Safety Hazards Agency) that an attempt be made to have all utilities within a work area marked and located on a blueprint before a contractor can begin work is not always complied with. Therefore, when a worker begins digging, it is possible that he may hit a utility line and injure himself critically if not fatally. Mr. Johnson stated there are a great number of accidents where a vehicle runs into a utility pole which, at times, is also fatal . The safety factor between underground and overhead is debatable. Chairman Tyson stated that, from an aesthetic viewpoint, he prefers the utilities to be underground. (Page Five, Regular Meeting, Planning and Zoning Commission, November 15, 1977) Mr. Adams stated there are many instances where, even with underground utilities, the main feeder lines would be overhead. Therefore, the underground placement of the utilities would not be of a considerable aesthetics benefit. Mr. Johnson stated that, since the City of Euless is already developed to a great extent, he feels the underground utility requirement is too late to achieve the aesthetics intended. Chairman Tyson stated that only about 50% of the residential property in the City of Euless has been developed. Discussion. Mr. Adams made a motion to amend Ordinance No. 147 in such a way as to delete the requirement of underground utilities. Mr. Eden seconded the motion and the vote is as follows: Ayes: Messrs. Adams, Eden, and Porter Nays: Messrs. Johnson, Munir, Tyson, and Mrs. Lightbody Chairman Tyson declared the motion failed. I V.
