Chairman Richard McNeese stated there was a quorum of members of the Planning and Zoning Commission present. ITEM 1 CONSIDER APPROVAL OF PLANNING AND ZONING MINUTES Regular Meeting of February 7, 2012. Vice Chairman Mennis made a motion to approve the minutes for called meeting of February 7, 2012. Commissioner Tompkins seconded the motion. The vote was as follows. Nays: None Abstention: Commissioner Zahn The motion carried (5-0-1) ITEM 2 HOLD PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 12- 01-SUP, AND CONSIDER RECOMMENDATION FOR AN ORDINANCE. Receive public input on an application for a Specific Use Permit for a Public Assembly and Place of Worship in Texas Highway 10 Multi-Use District (TX-10) zoning in the Park Center Addition, Lot 1, 2219 W. Euless Boulevard and consider recommendation for an Ordinance. Stephen Cook, Senior Planner, gave a brief description of the case. In January 2010, the City Council approved a Specific Use Permit for the Nepali Cultural & Spiritual Center for a Place of Worship/Assembly Use located at 2219 Euless Boulevard. Section 84-156 of the Euless Unified Development Code establishes.that a Specific Use Permit is valid for two years from the date of issuance and becomes null and void-unless construction or use is substantially under way during the two-year period, or unless an extension of time is approved by the City Council. With no changes proposed to the original application that was approved, the applicant has applied for an extension of time for the SUP. As with many places of worship, funding-for construction is based primarily on congregation/community pledges and donations. The applicant has indicated that they believe that they will have enough donations to secure financing that will enable them to complete initial design and construction documents. Formal submittals will be presented to the City in the next year. Places of worship and assembly uses are required to be considered for Specific Use Permits within the Texas 10 zoning district to allow the City to consider the impact of the development, affects of the development on the transportation system and to ensure adequate parking and site circulation will be maintained for the intended use. The applicant intends to construct a multipurpose community center, a Pashupati Nath Temple, a Buddha Nath Temple and required supportive facilities at the location. The site currently is undeveloped and contains an access drive to The Right Step assistance facility. The Right Step is located to the south of the subject property and would maintain an Emergency Access, Drainage and Utility Easement (EADUE) through the subject property to provide cross access to their facility. The entire track will be developed during the initial phase, including installation of all infrastructure, parking, access drives, EADUE's and landscaping, as well as construction of the primary phase of the assembly use. Expansion of the assembly use, Page 2 of 9 Planning and Zoning Minutes February 21, 2012 the two temples and worship garden would be constructed in future phases. This process is similar to a multi-phase retail development which would have the base infrastructure and landscaping installed, but leave pad sites out for future development. A decorative tubular steel fence with masonry columns will be installed along the outer perimeter of the site as well as along the internal EADUE. A six (6') foot masonry wall will be constructed along the rear of the property between this use and The Right Step facility. Staff believes that the total of two-hundred (200) parking spaces and access to a state highway will allow for adequate traffic ingress and egress flow from the site. The existing access drive to the site is located at a median opening on SH 10. The configuration and size of the median opening is adequate to handle the additional traffic that the site would generate. Unlike other places of worship with weekend services, the Nepali community does not have a regularly scheduled set time for a call for worship. Therefore, there will be no specific peak period of heavy traffic. However, for special events such as weddings, annual celebrations, special classes and similar events, peak time period usage could be anticipated. The three proposed structures on the site will exhibit culturally significant architecture in • the form of sloping and curved rooflines.as well as statuary. The structures will be required-to meet the masonry standards of the City of Euless. Landscaping will come in the form of trees lining SH 10, along the internal access easement, as required within the parking areas, along the perimeter boundaries of the property, and as a reflection worship garden adjacent to the temples. If the SUP is renewed, the applicant's next step will be to replat the property and to submit a site plan. The SUP would be valid for a new two year time frame. The Development Services Group has reviewed and certified the application for a renewal of the SUP. Chairman McNeese asked for any proponents/opponents to come forward for any comments. Seeing none, the public hearing was closed. Commissioner Mennis asked for a status update for the project. Dr. Murali Adhikari, 513 Angela Lane, Euless, Texas, 76039, informed the Commission that they were currently waiting for approval of a loan from the bank they are currently working with. Commissioner Tompkins asked the applicant where there group is currently meeting. Dr. Adhikari stated that they are renting a facility in Irving. Page 3 of 9 Planning and Zoning Minutes February 21, 2012 Commissioner Portugal asked the applicant how many members they have in their organization. Dr. Adhikari stated that there are 20,000 Nepali people living in the Metroplex area and that 600 members have pledged money for this project. Vice Chairman Mennis made a motion to recommend approval of case #12-01-SUP with the following conditions: 1. The SUP would be tied to the Nepali Cultural and Spiritual Center; and, 2. All required infrastructure will be required to be installed with the initial development of the site; and, 3. All parking required to adequately serve the assembly use will be required to be installed with the initial phase of the development; and, 4. All parking, street tree and landscaping associated with the assembly use will be required to be installed with the initial phase of the development. Commissioner Portugal seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Mennis, Commissioners Huffman, Portugal, Zahn, and Tompkins. Nays: None Abstention: None The motion carried (6-0-0) ITEM 3 HOLD PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 12- 02-SUP, AND CONSIDER RECOMMENDATION FOR AN ORDINANCE. Receive public input on an application for a Specific Use Permit for Used Merchandise Retail Sales in Community Business District (C-2) zoning in the Harwood Plaza Addition, Lot 5, 1007 Harwood Road and consider recommendation for an Ordinance. Stephen Cook, Senior Planner, gave a brief description of the case. Ms. Bolen is proposing to lease approximately 2,000 square feet of existing strip center retail space to open her retail merchandise store. A portion of the items (approximately 20%) that she intends to sell would be classified as used merchandise including consignment sales of antiques and vintage clothing. The remainder of her stock will be new merchandise. Used merchandise sales require a specific use permit within the Community Business District (C-2). The applicant has represented that this store is more of a specialty shop and is unlike the "large-format" retailers. Similar to a Half Price Books store, drop offs of Page 4 of 9 Planning and Zoning Minutes February 21, 2012 merchandise will be handled totally within the store. There should be no issues of outdoor storage or security based on donation/drop off areas associated with larger used merchandise stores. The Development Services Group (DSG) has evaluated the application and has found that it is in compliance with the standards of the City of Euless. Staff recommends approval of the SUP. Chairman McNeese asked for any proponents/opponents to come forward for any comments. Seeing none, the public hearing was closed. Mr. Saul Waranch, 7418 Malabar Lane, Dallas, Texas 75230, Property Manager for Highway 157 & Harwood Joint Venture, came forward to represent the owners and Ms. Brandi Bolen. Commissioner Huffman asked what Ms. Bolen's background is and does she have any experience in retail of this kind. Mr. Waranch stated that her background is not in retail and this is the start of a new venture for Ms. Bolen and her partner. __.. Commissioner Portugal stated that she is thrilled to see growth in Euless and wishes her success. Chairman McNeese asked the terms of Ms. Bolen's lease. • • Mr. Waranch stated that it is a three (3) year lease based on compliance with City of Euless standards. Commissioner Huffman made a motion to recommend approval of case #12-02-SUP with the following conditions: 1. The SUP would be tied to the business owner, Brandi Bolen; and, 2. The SUP would be tied to the business name, New to Me; and, 3. All merchandise shall be displayed within the store and not on the sidewalk; and, 4. The SUP shall be effective for a period of one year, after which a renewal of the SUP will be required. Commissioner Tompkins seconded the motion. Havens Survey, Abstract No. 685 and the Jesse Doss Survey, Abstract No. 441 to Glade Parks Residential, Lots 1-30, Block A; Lots 1-29, Block B; Lots 1-25, Block C; Lots 1-42, Block D; Lots 1-8, Block E. This property is located at 2800 Brazos Boulevard. Stephen Cook, Senior Planner, gave a brief description of the case. New residential construction of 128 residential lots and eight (8) open space lots on 27.334 acres land based on the Glade Parks Planned Development-Neighborhood Residential/Commercial Sub-District. The Development Services Group (DSG) has determined that the application is in substantial compliance with the Preliminary Plat requirements of the City of Euless and recommends approval. Commissioner Zahn'made a motion to recommend approval of case#11-05-PP. Commissioner Huffman seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Mennis, Commissioners Huffman, Portugal, Zahn, and Tompkins. Nays: None Abstention: None The motion carried (6-0-0) ITEM 5 CASE #12-01-SP - CONSIDER A REQUEST FOR A SITE PLAN. Consider a request for approval of a Site Plan for Glade Parks Residential proposed to be located on Glade Parks Addition, Lot 1, Block F out of the John H. Havens Survey, Abstract No. 685 and Jesse Doss Survey, Abstract No. 441, 2800 Brazos Boulevard. Mike Collins, Director of Planning and Economic Development, gave a brief description of the case. New residential construction of 128 residential lots and eight (8) open space lots on 27.334 acres of land and based on the requirements contained in the Glade Planned Development Neighborhood Residential/Commercial Sub-district. The Page 6 of 9 Planning and Zoning Minutes February 21, 2012 lots will be developed with a minimum size of 5,500 square feet and a width of fifty feet (50'). A requirement unique to the Glade Parks development is submittal of a site plan for the single family residential development. This process establishes a formal review and approval to verify conformance with the approved enhanced architectural elements for the residential design, as well as with the enhanced screening, entryway, and landscaping requirements. These requirements have been met or exceeded. The primary entryway off of Heritage Avenue will be heavily landscaped with the masonry screening developed with the name of the subdivision. A second primary entryway will be constructed off of Brazos Boulevard. Entering the divided entryway off of Heritage Avenue is intended to provide a clear view of the open space area to the east. Owned and maintained by the HOA, this landscaped area is designed as open space for the residents and to serve as a buffer to the adjoining potential entertainment structure located to the east and north of the subdivision. To maintain the park like setting, wrought iron style fencing will be installed along the rear of the lots abutting this open space. In the south west area of the development that abuts the wetlands area, home owners are permitted to construct wrought iron style fencing along the rear of the lots. • As a complement to the buffering effect of this open space, an eight foot (8') masonry screening wall will be constructed along the west and south sides of the potential entertainment structure. A controlled access gate for the residents will be installed at the southwest corner of this masonry fencing that will be owned and maintained by the HOA. At the time the commercial area is developed, a concrete trail and landscaped area between Red River Drive and Brazos Boulevard will be constructed on the potential entertainment structure side of masonry screening wall that will provide additional buffering. A six foot (6') masonry screening wall will be constructed along Heritage Avenue, Red River Drive, and Brazos Boulevard. All of the masonry screening walls will be of the same design. Between six (6) and twelve (12) months from February 2012, landscaping and a masonry screening wall with signage identifying an approved gas pad site are required to be installed by the master developer, Rubloff, at the northern boundary of the approved gas pad site. As part of the development of the subdivision, K HOV desires to install wrought iron type fencing and landscaping on the south side of Fort Davis Drive. Number 18 of the Notes establishes that the "builder and developer have agreed to coordinate the planning and construction of the landscaping and screening on the north side of the gas well site. The City Manager's Office, the Development Services Group (DSG) and other city staff have worked extensively with the developer and home builder to accommodate the unique features of this site and to meet the enhanced development standards of the Planned Development zoning. The DSG recommends approval. Page 7 of 9 Planning and Zoning Minutes February 21, 2012 Danny Satsky, 770 Black Forest Court, Southlake, Texas, Land Manager for K Hovnanian Homes, stated that he is proud of the product that the City staff and KHov have worked on for the past several months. These homes will have an average cost of $350,000 to $400,000. KHov has worked to make certain that the entry way and public open spaces represent the high level expected with this level of high end product. Commissioner Portugal made a motion to recommend approval of case#12-01-SP. Vice Chairman Mennis seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Mennis, Commissioners Huffman, Portugal, Zahn, and Tompkins. Nays: None Abstention: None The motion carried (6-0-0) ITEM 6 CASE #12-03-FP — CONSIDER A CONVEYANCE PLAT Consider a request for approval of a Conveyance Plat changing 27.334 acres of land out of the John H. Havens Survey, Abstract No. 685 and Jesse Doss Survey, Abstract No. 441 to Lot 1, Block F, Glade Parks Addition. Mike Collins, Director of Planning and Economic Development, gave a brief description of the case. A Conveyance Plat is a recordable document which is allowed by state law and city ordinance to create the subdivision of land without granting the owner of the subdivision any rights to developing the property. Conveyance plats are used in order to legally sell subdivisions of land without providing the usual development plans associated with the property. The one lot created by this conveyance plat is located within the Neighborhood Residential/Commercial area within the Glade Parks overall development. The acreage will be subdivided through preliminary and final platting to create a detached single-family residential development. The Development Services Group (DSG) has determined that the application is in substantial compliance with the Conveyance Plat requirements of the City of Euless and recommends approval. Commissioner Zahn made a motion to recommend approval of case#12-03-FP. Commissioner Tompkins seconded the motion. The vote was as follows: Ayes: Chairman McNeese, Vice Chairman Mennis, Commissioners Huffman, Portugal, Zahn, and Tompkins.
