HomeMy WebLinkAbout2012-04-10MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, April 10, 2012 A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:00 p.m. on Tuesday, April 10, 2012, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included Mayor Mary Lib Saleh, Mayor Pro Tem Donna Mickan, Council Members Tim Stinneford, Leon Hogg, Linda Martin, Glenn Porterfield, and Perry Bynum. During the Precouncil meeting: Mayor Mary Lib Saleh announced that she attended the Northeast Leadership Forum meeting on April 10, 2012, and stated that there are many projects going on and she is thankful for all who participate. City Manager Gary McKamie announced the following: • Hazardous Material Collection Day, April 14, 2012, 9:00 to 11:00 a.m.; • Texas Trash Off, April 14, 2012, 9 :00 a.m. to 12:00 p.m.; • Euless Development Corporation meeting, April 23, 2012, 5:30 p.m.; • "Team Up to Clean Up" event hosted by Atmos Energy, Accenture, and 6Stones, April 25, 2012, 8:30 a.m. to 6:30 p.m., closing ceremonies and barbeque, 5:00 to 6:30 p.m.; • Trinity High School Activity Center ground breaking, April 11, 2012, 5:30 p.m.; • Library's 7th Annual Edible Book Contest, April 11, 2012, 4:00 p.m.; and • The addition of eight public computers at the Library. City Manager McKamie presented an update related to the recent Community Powered Revitalization (CPR) blitz held on March 23 and 24, 2012. He recognized the corporate sponsorship and the many volunteers. Scott Sheppard, 6Stones Executive Director, announced that Congressman Kenny Marchant recognized the CPR program with an entry into the Congressional Records and presented City Manager McKamie with a framed certificate commemorating the entry. Police Technical Services Manager Gary Gregg provided an update regarding the city's public safety radio system, including the need to upgrade the system by 2015 and the cost associated with the upgrade. He explained that Euless and five other cities joined together to form the Northeast Tarrant County Radio Consortium (NETCO). Additionally, this item will be brought before the City Council for consideration prior to June 29, 2012. Parks Recreation Superintendent Michael Davenport announced the activities and performances planned for Arbor Daze 2012 that will be held on April 28 and 29, 2012, at the City Hall complex. Council Minutes Page 2 of 8 April 10, 2012 Police Captain Gary Landers presented the code update, including residential, and commercial code issues, and apartment inspections. Additionally, he highlighted the success of residential fence repairs along Mid - Cities Boulevard. Director of Public Works and Engineering Ron Young advised that the Tarrant Regional Water District (TRWD) storage capacity is at 98 percent. City Manager McKamie presented an update regarding the adoption of a Resolution by the Tarrant County Mayor's Council supporting continued water conservation, as well as the possibility of the City maintaining water restrictions even if the TRWD has lifted the drought and emergency stage(s). Director of Public Works and Engineering Ron Young presented the wastewater report for the January to March 2012 quarter. He presented a graph of wastewater calls by month for the quarter as well as maps delineating the geographic distribution of calls across the city. In summary, a total of 49 calls were received in the quarter with 14 being city calls. Senior Librarian Sherry Knight presented a library update related to e- books, including challenges associated with lending and concerns of the book distributors. Additionally, she stated that the American Library Association is working with publishers to try to reach a workable solution for e -book lending in libraries. City Manager McKamie reviewed the regular agenda items. PLEDGE OF ALLEGIANCE Council Member Linda Martin led the pledge of allegiance. ITEM NO. 1. PRESENTATION OF EMPLOYEE SERVICE PINS April 10, 2012 Fire Chief Wes Rhodes introduced Firefighter II Cliff Moore. Cliff was accompanied by members of the Fire Department. Mayor Saleh presented Cliff with a service pin commemorating his 15 years of service with the City. Police Chief Mike Brown introduced Police Sergeant Brandon Zachary. Brandon was accompanied by his wife, Susan, daughter, Ella, son, Ethan, and members of the Police Department. Mayor Saleh presented Brandon with a service pin commemorating his 15 years of service with the City. ITEM NO. 2. PRESENTATION OF PROCLAMATION Fire Chief Rhodes introduced retired Fire Battalion Chief Gary Thompson. Gary was accompanied by his wife, Delia, and members of the Fire Department. Mayor Saleh presented Gary with a proclamation in recognition of his retirement following over 34 years of service with the City of Euless. ITEM NO. 3. ANNUAL RECYCLING REPORT Greg Roemer, President, Community Waste Disposal (CWD) presented the annual recycling report. He reported that CWD collected 998 tons of recyclables within the city in 2011. Additionally, he acknowledged the City of Euless' recycling milestones with the presentation of a plaque, constructed of 100 percent recycled glass, recognizing the recycling of 998 tons in 2011, which saved 12,546 trees, 280,440 gallons of oil, and 5,166,000 gallons of water. ITEM NO. 4. SANTA USA PRESENTATION FOR FIRE AND POLICE DEPARTMENTS David Moon, Santa USA, gave a presentation regarding 2011 Santa USA. Additionally, he thanked and presented Mayor Saleh, Police Chief Brown, and Fire Chief Rhodes with a certificate of appreciation for their support of the Santa USA program. (City Secretary Note: This item was presented before Item No. 1) ITEM NO. 5. PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Library Administrator Kate Lyon, and Library Board Members Barney Snitz, Mike McGehee, and Loretta Doty proclaiming April 8 through 14, 2012, as National Library Week. Library Administrator Lyon announced the following events: Council Minutes Page 5 of 8 April 10, 2012 • 7th Annual Edible Books Contest judging, April 11, 2012; • Discover Sources for Free E -Books class, April 13, 2012; and • Friends of the Library Spring Book Sale, April 20 through 22, 2012. ITEM NO. 6. PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Lindsey Dula, Alliance for Children, proclaiming April as Child Abuse Prevention Month. Ms. Dula expressed her appreciation for the city's support, and recognized the partnership between the Police Department and Alliance for Children. CONSENT AGENDA (items 7 through 9) Council Member Martin motioned to approve the Consent Agenda items number 7 through 9. Council Member Stinneford seconded the motion. AUTHORIZED PURCHASE OF BULK GASOLINE AND DIESEL FUELS Authorized purchase of bulk gasoline and diesel fuels through an Interlocal Agreement with Tarrant County from Douglass Distributing Company. The estimated expenditure is $235,000 for unleaded fuel and $113,400 for diesel fuel. ITEM NO. 8. APPROVED RESOLUTION NO. 12 -1388 Approved Resolution No. 12 -1388, supporting an application to establish a Municipal Setting Designation for a tract of land, located in the City of Grapevine at 729 E. Dallas Road. ITEM NO. 9. APPROVED CITY COUNICL MINUTES Approved City Council minutes of the regular meeting of March 27, 2012. REGULAR AGENDA ITEM NO. 10. AUTHORIZED MAYOR TO EXECUTE AN ASSIGNMENT OF EASEMENTS AND RIGHTS -OF -WAY TO TRINITY RIVER AUTHORITY Council Minutes Page 6 of 8 April 10, 2012 Council Member Stinneford motioned to authorize the Mayor to execute an assignment of easements and rights -of -way to Trinity River Authority. Council Member Porterfield seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Mickan, Council Members Stinneford, Hogg, Martin, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11. AUTHORIZED CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT Council Member Porterfield motioned to authorize the City Manager to negotiate and execute a contract for architectural services for certain components of the Midway Family Life Center aquatic facilities with John Kirksey Associates, Architects, Inc., dba Kirksey, Houston, Texas. Council Member Bynum seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Mickan, Council Members Stinneford, Hogg, Martin, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 12. AUTHORIZED CITY MANAGER TO SOLICIT STATEMENTS OF QUALIFICATIONS Council Member Hogg motioned to authorize the City Manager to solicit statements of qualifications for Design Build Services related to the Euless Family Life Indoor and Outdoor Aquatic Center Pool and Water Features. Council Member Stinneford seconded the motion. City Manager McKamie stated that the fiscal year 2012 budget provides funds to design an aquatic center at the Euless Family Life Center. This item allows the city to solicit statements of qualifications from potential design firms to provide the swimming pool and water features. Additionally, he stated this item neither funds nor authorizes the construction of the center. City Attorney Wayne Olson stated that the requirement is for the City Council to make the determination that the design build method is the best value to the city. ITEM NO. 13. AUTHORIZED CITY MANAGER TO NEGOTIATE AND EXECUTE A WATER USE AND LICENSE AGREEMENT Council Member Martin motioned to authorize the City Manager to negotiate and execute a Water Use and License Agreement with Chesapeake Operating, Inc. for the use of a portion of the property being part of the Texas Star Addition, Block B, Lot 1, and House, Kitty Survey, A 678, Tract 3D, Euless, Texas 76040 (Texas Star Golf Course) for the purchase and transportation of water. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Mickan, Council Members Stinneford, Hogg, Martin, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 14. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 1953 Council Member Porterfield motioned to approve Ordinance No. 1953, amending Chapter 54, "Parks, Recreational and Cultural Facilities ", Article II, "Administration ", Division 1. "Generally ", Section 54 -32, "Hours of Operation; Posting of Signs "; Article III, "Parks and Recreation Areas ", Division 3, "Regulations ", Section 54 -106, "Parking Vehicles "; Section 54- 107, "Use of Roadways and Paths "; and adding a Section 54 -115, "Prohibited Activities" of the Euless Code of Ordinances. Mayor Pro Tem Mickan seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Mickan, Council Members Stinneford, Hogg, Martin, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 15. PUBLIC COMMENTS Linda Eilenfeldt, 411 Fountain Side Drive, Euless, expressed her appreciation to the City Council and city staff for the Wireless Emergency Notification System given the severe weather that took place April 3, 2012, and stated it is a pleasure to live in the City of Euless. Council Minutes Page 8 of 8 April 10, 2012 ITEM NO. 16. REPORTS City Attorney No report given. City Manager City Manager McKamie commended the Police and Fire Departments response to the severe weather that took place on April 3, 2012. Additionally, he acknowledged that the severe weather sirens are intended to notify people that are outdoors of an immense threat or danger and cannot always be heard from inside a building. He advised attendees of the ability to sign up for Wireless Emergency Notification System (WENS) through the city web site to receive text messages related to emergency situations. City Council Mayor Saleh announced that the City of Euless will hold the City Council candidates election on Saturday, May 12, 2012, to elect Council Members to serve in Place 5 and Place 6: Place 5 Glenn Porterfield Jay Jenson Bruce German ITEM NO. 17.
