HomeMy WebLinkAbout12-1393 05-22-2012 RESOLUTION NO. 12-1393 A RESOLUTION CALLING A RUNOFF ELECTION FOR PLACE FIVE OF THE EULESS CITY COUNCIL FOR A TERM OF THREE YEARS, DESIGNATING THE DATE OF SAID ELECTION; DESIGNATING POLLING PLACES; DESIGNATING EARLY VOTING HOURS AND PLACES; AND DIRECTING POSTING AND PUBLICATION OF NOTICE FOR SAID ELECTION. WHEREAS, pursuant to Sec. 2.021 of the Election Code of the State of Texas, and the Euless City Charter, it is provided that if no candidate for a particular office receives the vote necessary to be elected in an election requiring a majority vote, a runoff election for that office is required; and WHEREAS, a canvassing of the returns and declaring the results of a regular City Municipal Election held on May 12, 2012, was approved by the City Council on May 22, 2012; and WHEREAS, the canvass determined that, in the race for Council Member, Place Five no candidate received a majority of the votes cast; and WHEREAS, the two candidates receiving the highest number of votes for the office of Council Member, Place Five were Glenn Porterfield and Bruce German. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 There is hereby ordered a runoff election to be held in the City of Euless, Texas, on the 23"J day of June 2012, for the purpose of electing a Council Member to Place Five for a term of three years or until their successor has been duly qualified. The candidate receiving a majority of the votes cast for City Council Member, Place Five shall be declared elected to such office. SECTION 2 Steve Raborn, Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, 76111, is hereby appointed as Early Voting Clerk and Kim Sutter, City Secretary, 201 N. Ector Drive, Euless, Texas, shall serve as Deputy Early Voting Clerk. Applications for ballot by mail must be received by mail no later than the close of business on Friday, June 15, 2012 (Mailing Address: P. O. Box 961011, Fort Worth, Texas, 76161-0011; Attention: Steve Raborn, Early Voting Clerk.) SECTION 3 Early voting by personal appearance shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, and at the County's Main Early Voting location, 2700 Premier Street, Fort Worth, Texas, 76111. Early voting by personal appearance will begin on Monday, June 11, 2012, and will end on Tuesday, June 19, 2012, and the hours designated for early voting by personal appearance shall be as set forth below: June 11 —June 15 Monday— Friday 8:00 a.m. — 5:00 p.m. June 16 Saturday 7:00 a.m. —7:00 p.m. June 17 Sunday 11:00 a.m. —4:00 p.m. June 18-19 Monday—Tuesday 7:00 a.m. — 7:00 p.m. For purposes of processing ballots cast in early voting, the election officers for the Early Voting Ballot Board shall be appointed and designated in accordance with the provisions of the joint election agreement with Tarrant County. SECTION 4 All resident, qualified voters, determined by the laws of the State of Texas, the charter and ordinances of the City of Euless shall be qualified to vote at such election. For the purpose of said election, the entire city is hereby constituted into two voting precincts. Voting on election day, June 23, 2012, shall be conducted at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, 76039, and City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, 76039, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 5 Voting machines used for the conduct of the election, shall be procured, maintained, operated, scaled and the votes therefrom tabulated pursuant to procedures established and authorized by the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 6 The results of the elections shall be certified, canvassed, and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 7 The notice of the election hereby ordered and called shall be promulgated, published, and posted in keeping with the laws of the State of Texas, and the Charter and Ordinances of the City of Euless.
