Those present were Mayor Harold D. Samuels and Council Members Bobby Baker, Frank Douglass, Mary Lib Saleh. and Peter Staks. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - -- COUNCIL CHAMBERS The Euless City Council continued their meeting to the. Council Chambers at 7:06 p.m. for the consideration of scheduled items. Staff Members Present Tom Hart, City Manager H. Kay Godbey, Assistant City Manager Bob McFarland, City Attorney James Cribbs, City Attorney Paul Wiene.skie, City Attorney Susan Grim, City Secretary Steve Norwood, Asst. to City Manager John Craig, Director of Development K. B. Fuller, Police Chief Tom Corr, Director of. Administrative Services Rod Tyler, Assistant Director of Development Richard Clark, Police Captain Don Scott, Police. Investigator Linda Lux, Deputy City Secretary Visitors Jim Gariow Janice Wesson Charlie Miller Todd Smith and other visitors as shown in register 1991 -68 Euless City Council Regular Meeting April 9, 1991 - Page Two PLEDGE OF ALLEGIANCE Councilman. Peter Staks led the pledge of allegiance. INVOCATION The invocation was given by Councilman Bobby Baker. ITEM NO. 1: SPECIAL PRESENTATION Mayor Samuels presented the Lifesaving Award to Corporal Don E. Scott, Investigator in the Police Department, who risked personal :injury to save the life of 86 year old Gertrude Lulla.u, during an apartment fire on December 5, 1990. OLD BUSINESS ITEM NO. 2: SPECIFIC IJSE PERMIT #91 -01 -SP City Attorney Bob McFarland explained that the public hearing process had been held at the last Council meeting concerning billiards with liquor sales, a request by Janice M. Wesson and also concerning the satellite dish, a request of John Jones, He advised the Council and audience that these two items had been approved at the last meeting and the items were placed on tonight's agenda in error. Jim Garlow, pastor of Metroplex Chapel, was present regarding the billiards item and asked that. the Council rescind their decision regarding the sale of alcohol.. He outlined his reasons for his opposition to the business in the community and questioned. the Council. on the procedures of monitoring and enforcement of the stipulations imposed with the Specific Use Permit. In response to the Mayor's question of how many were present in opposition of the billiards parlor, approximately 40 people responded. City Attorney McFarland asked the City Secretary to transcribe the comments of the public hearing which dealt with the billiards request from the March 26th meeting and mail a copy of it to each person who requests it. Mr. McFarland stated that the Council went into much discussion with the applicant before the decision was made to approve the item. He stated that the Council added numerous stipulations before the approval was made. City Attorney McFarland stepped. out of the meeting temporarily. City Attorney James Cribbs took his place at the Council table. 1991 -69 Euless City Council. Regular Meeting April 9, 1991 ° Page Three ITEM NO. 3: SPECIFIC USE PERMIT 091 -02 -SP This item for a satellite dish 5'7iP higher than zoning regulations allow, a request by John R. Jones was placed on the agenda in error. It had been approved at the March 263, 1991, City Council meeting. ITEM NO. 4: APPROVAL OF SECOND AND FINAL. READING OF ORDINANCE NO. 1045 Councilman Baker moved to approve the second and final reading of Ordinance No. 1045, adopting certain rules for the operation and administration of the Euless Municipal Drainage. Utility System; imposing certain penalties and interest charges on delinquent drainage utility system payments. Councilwoman Saleh seconded the motion. Ayes: Council Members Baker, Douglass, Saleh and Staks Nays: None Mayor Samuels declared the motion carried. NEW BUSINESS ITEM NO. 5: APPROVAL OF FIRST READING OF ORDINANCE NO. 1047 Councilman Douglass moved to approve the first reading of Ordinance No. 1047, amending Section 1 1/2 15.4, "Ambulance Rates and Supply Charges" of Chapter 1 1/2, "Schedule of Fees" of the Code of Ordinances to delete the specific listing of charges for ambulance supplies. Councilwoman Saleh seconded the motion. Ayes: Council. Members Baker, Douglass, Saleh and Staks Nays: None Mayor Samuels declared the motion carried. ITFM NO. 6: CONSIDERATION OF AUTHORIZING CITY MANAGER TO PROCEED Councilman Staks moved to direct the staff to begin the investigation of the feasibility of issuing $2 million Drainage Utility System Revenue Bonds subject to the review of collections of the newly imposed Drainage Utility System fees of at least one full month. basis so that we would know that our tax rate will not be impacted. Councilman Baker seconded the motion. Ayes: Council Members Baker, Douglass, Saleh and Staks Nays: None Mayor Samuels declared the motion carried. 1991 -70 Euless City Council. MOVED TO APPROVE, COUNCILMAN STAKS SECONDED, AND COUNCIL MEMBERS BAKER, DOUGLASS, SALER AND STAKS BY ONE VOICE GENERAL CONSENT, APPROVED ITEMS 7 AND 8, MAYOR SAMUELS DECLARED THE MOTION CARRIED FOR. ITEMS 7 AND 8. ITEM N0. 7: APPROVAL OF BID AWARD NO. 90 -08 The bid for jail food was extended for another year to Scobee. Food, Inc,, Dallas, Texas, under the same terms and conditions of the contract awarded in 1990. ITEM NO. 8: APPROVAL OF BID AWARD NO. 90 -11 The hid for gasoline and diesel fuel was extended for another year to Advance Petroleum Distributing Company, Inc., Fort Worth, Texas, under the same terms and conditions of the contract awarded in 1990. STAFF REPORTS ITEM NO. 9: CITY SECRETARY'S REPORT The minutes of the March 26, 1991, City Council meeting were approved as written. ITEM NO. 10: REPORTS (A) City Manager City Manager Tom Hart stated he had nothing to report. (B) City Attorney City Attorney James Cribbs stated he had nothing to report. Leisure Faire '91 on Saturday and Sunday, April 13th and 14th. She also commented on how beautiful the roses are in front of the municipal complex. Councilman Baker stated that he has ordered nice weather for the Leisure Faire this weekend. THE CITY COUNCIL AT 8:20 P.M. WENT INTO EXECUTIVE SESSION TO DISCUSS PENDING LITIGATION AS AUTHORIZED BY V.T.C.S. ARTICLE 6252 -17, SECTION 2 (e).
